SPECIAL MEETING
APRIL 29, 1964
A special meeti-g of the Planning and Zoning Commission was called to order at
7:30 p.m. in the City Council chambers by Chairman A. Holmes Johnson.
Those present were Commissioners Kraft, Sutliff, Lamme, Smith, Felton, Anderson,
and Ole Johnson. Guests were Ed Metzger, Jack Metzgar, Jim Barr, Doug Preston,
Charles Powell, Smokey Stover, and Howard Fremlin.
A proposal was submitted by Ed Metzgar who, with his associates,, plans a 40
unit motel, restaurant, and bar on the remaining portions of Lot 4, 2, 1, 3,
Block 15, and vacated section of High Street. Mr. Metzgar showed the Com-
mission the plans for the proposed building and a tracing from the official
Kodiak 1980 Plan map showing the exact location which is in agreement with
the present long range planning. Mr. Metzgar requested approval of the
Commission on his proposal. Mr. Jim Barr, Consulting Engineer, stated that
Mr. Metzgar's plan a big move toward the 1980 Plan. Commissioner Johnson
asked Mr. Barr about the status of water and sewer on High Street. After
reviewing maps, Mr. Barr stated that all water lines come down Thorsheim
Ave. and that the sewer line was near but the building would interfere with
neighter. Commissioner Johnson moved, seconded by Commissioner Kraft, that
Mr. Metzgar's proposal be accepted. The motion was unanimously carried by
voice vote.
Two letters from Smokey Stover were read. The first protested the 30' right-
of-way being allowed for a secondary A, Mill Bay Road. lie stated that a 30'
right-of-way is inadequate; a 100' right-of-way is the minimum in State
specifications. In the second letter Mr. Stover presented a brief concern-
ing the specifications regarding road, streets, and alleys. Mr. Stover'
said that road, street, and alley rig'r.t-of-ways include and make available
water, sewer, and all public utilities; they help a community go ahead with
Federal Aid for public utilities without acquiring individual right-of-ways.
He further stressed that the Planning & Zoning Commission should take con-
sideration to right-of-way specifications. Commissioner Johnson stated that
a plat of the road system would aid the Planning and Zoning Commission. Mr.
Stover said he would present a plat and that the Borough should be vitally
interested in any sub -division. He brought out that the State may have to
maintain Borough roads so they should meet the standards of the State roads.
A letter from Neil Sutherland to the Commission was read regarding the Sub -
Division, U.S. Survey 1396. Mr. Sutherland stated that Mr. Hubbard had con-
tacted Mr. David James, State Right -of: --Way Agent, in regard to the subdivi-
sion, however, Mr. James had not given them any requirements or information,
therefore, Mr. Sutherland's company, with no other alternative, had pro-
ceeded with the sub -division.
It was brought out that the School District Platting Board had approved
the sub -division. Commissioner Anderson asked if it was legal for tle
School Board to have approved this without a duly constituted meeting or

quorum. A general discussion followed in which it was suggested that set-
back plans be made away from the right -a -way. Mr. Barr explained the sub-
division sa77ing that these were only 60, lots for plane tie-up, Commissioner
Smith moved that the party involved be asked to submit a plat with 100'
right-of-way shown. Commissioner Felton seconded the motion. A discussion
followed in .which Mr. Barr brought out the fact that the Commission had no
ordinance to back up such a request. Phil Anderson moved that the motion
be amended to read that the party come in and talk the matter over at their
earliest possible convenience, to benefit both parties, and to postpone
sale until after this meeting between both parties. Commissioner Lamme
seconded the motion. The motion carried 4 to 3 by voice vote. The original
motion was then voted on, as amended, and was passed unanimously.
Jim Barr suggested that the Commission draw up a set of regulations. Roy
Madsen advised the Commission that they can enact certain rules and regula-
tions under the Planning and Zoning Ordinance.
A letter to Ralph Jones from Henry J. LeGrue was read in which Mr. LeGrue
requested approval on his proposal to build a bar and restaurant ,:pith 20
rooms on the second floor to be located on the Selig property. Ole John-
son moved, seconded by Bill Lamme that the Commission was favorable to-
ward the proposal providing it meets the 1980 Plan('and`ordinances and that
the project -rill be compatable with the Urban Renewal plan. Motion carried.
Charles Powell reported to the Commission that he had written the State Div-
ision of Lands, at the request of the Assembly, objecting to the Department
of Highways' withdrawal of choice residential land or school land on the Mill
Bay -Mission Road cut-off road.
Commissioner Johnson brought to the attention of the Commission the junk
yards within the City. Commissioner Johnson moved that the Commission re-
quest the City Council to take immediate action on the junk yard ordinance
and enforce it. Bruce Smith seconded the motion which carried unanimously.
Commissioner Anderson asked Chuck Powell if there was any new information
on Port Lions. Chuck told the Commission that the engineers had advised
him that the new site was not feasible. Commissioner Johnson further stated
that he understood that the village would take the alternate site at Litnek
Bay.
Jim Barr asked the Commission for permission to show them him ideas on a
new boat harbor, breakwater, pier, etc. He asked for the support of the
Commission, if theyapproved, so that he may channel his ideas to the Corps
of Lngineers. He stressed that these were Lis own personal ideas and not
official.
There being no further business the meeting was adjourned at 10:05 p.m.
