1966-11-09 Regular MeetingKODIAK ISLAND BOROUGH PLANNING & ZONING COMMISSION REGULAR MEETING - November 9 1966 I CALL TO ORDER Chairman Hansen called the meeting to order at 7:40 p.m. n the Magistrate's Courtroom, Donnelley Building, Kodiak, Alaska. II ROLL CALL Present Arnold Hansen, Chairman Henry Breckberg John Waller John Welch Russell Williams Also present: Jim Stansbury, Building Inspector; Sally Hendrix, Secretary, taking minutes. 111 MINUTES OF PREVIOUS MEETING - October 26, 1966 There were no comments and Chairman ordered minutes accepted as presented. IV MINUTES OF BOROUGH ASSEMBLY - November 3, 1966 Mt. Stansbury answered several questions regarding Jackson's Trailer Court. There was a question concerning the legality of the exception granted to the Kodiak Bible Chapel in Baranof Heights, Elk 4, Lots 6-8, which was for construction of a church in an R-2 zone. It was the consensus of opinion that this exception is not legal, per the Attorney's opinion that exceptions may not be granted in Residential zones. v CORRESPONDENCE - None VI PUBLIC HEARINGS A, Request for Setback Variance - East Addn Elk 40 Lot 7 - Robert Reynolds (Case 164-A) A public hearing was held with no objections from the audience. After some discussion, Mr. Wailer moved that the variance be granted. Seconded by Mr. Williams and carried by voice vote as follows: Yes - Mr. Hansen, MT. Waller, Mr. Welch, Mr. Williams; No - Mr. Erec berg. VII ZONING ITEMS - PRELIMINARY REVIEW A. Request for Temporary Exception to Use R-3 Apartments in R-2 Zone -- Erskine Adder. Blk 9 Lots 105 and 106 - Chris Berg, Inc. (Case 1-G) Application letter was read and case reviewed. Mt. stnbry reported that in October Mr. Starbird, representing Chris Berg, had asked Mr. White's permission to use the basements for offices, and had received the permission, Some time later Mr. Stansbury inspected the basements and found that people were living there, and it appeared that work was being performed to convert the basements into apartments. On another occasion he found carpenters working, and informed Mr. Starbird that unless the Planning and Zoning Commission had plans to rezone the area, legal action would be initiated against Chris Berg Inc. The Commission agreed that there is a great need for housing, but that an exception cannot be permitted in this case, per a previous attorney's opinion that exceptions cannot be granted in Residential zones. Mr. Waller moved thn the request be denied. Seconded by Mx. Welsh and carried by unanimous voice vote. VIII SUBDIVISION - PRELIMINARY APPROVALS - None IX SUBDIVISIONS - FINAL APPROVALS S - None OLD BUSINESS A. Buildin Ins ector re Rezonin of Erskine Addn Block 9. This was discussed under VIL-A above. There was further discussion on the necessity for the Borough to take a firm stand in enforcing the ordinances so that they will be respected in the future. Lezo_igas_. here followed a discuss ion on the present zoning map , and the following recommendations for changes were made: Mr. Williams moved that it be recommended to the Assembly that all of Allman Addition, Blocks 1, 2, and 3, now zoned R -; and all of the Allman Lalande Subdivision and the new Catholic Church Subdivision of USS 1396, now zoned Unclassified, be rezoned to Business. Seconded by Mr. wailer and carried by unanimous voice vote. Mr. Welsh moved that the following be rezoned to Business: . Erskine Blocks_.. 1, 2 3 (now g-31; Townsite Block 1 (now R-2, R -3 and Industrial) ; Towns .te° Block 3 (now R-3 ); USS 444 Tract C (now R-3); Game Commission Reserve (now R-3)41,15 1995 (now R-3); East Addn Block 33 (now R-2 and Industrial); East Addy. Blk 34 (now R -2 and Industrial) Paul's Subdivision (now R-2); Tolbert Subdivision (now R -1 and R-2); Southeast Addn 2910--now R -1 and Estelle Subdivision (now R-1). Seconded by Mr. Waller and carried by unanimous voice vote. Mt. Waller moved that East.Addn, Part of Block 30, and all of Blocks 31, 32 and 35, now zoned R-2, be rezoned to R-3. Seconded by Mr. Welsh and carried by unanimous voice vote. Mr. Waller moved that Lots 20-28 of the Thors a in Subdivision, now cloned R -3, be rezoned to Business. Seconded by r . Williams and carried by unanimous voice vote. XII AUDIENCE COMMENTS Mr. Stansbury praised the Commission's efforts to provide more business and R-3 area for Kodak. XIII ADJOURNMENT - Meeting was adjourned at 9:50 p.m. upon motion of Mr. Waller, seconded by Mr. Williams, and carried by unanimous voice vote.
