1967-04-26 Regular MeetingKODIAK ISLAND BOROUGH ZONING COMMISSION MEETING - April 26, 1967 I CALL TO ORDER The meeting was called to order at 7:45 p.m. in the Magistrate's Courtroom, Donnelley Building, Kodiak, Alaska, by Chairman Arne Hansen. II ROLL CALL Present Absent Arne Hassen, Chairman Russ Williams (excused) John Waller John Welch Also present: J. L. Stansbury, Building Inspector; and 7 people in the audience III MINUIES OF PREVIOUS MEETING - April 12, 1967 Mr. Waller moved, seconded by Mr. Welch, that the minutes be approved as presented. Motion carried by unanimous voice vote. A. Assembly - 4/2C/67 B. Joint Assembly and P&Z - 4/24/67 C. Ordinance Committee - 4/25/67 There were no consents. A. Letter from Whitney-Fidalgo Seafoods, Inc. re CB Units, Townsite Blk 1 Lots 7 and B (CAse 127-B). Letter was read requesting use of the CB units to house cannery workers for five years. It was noted that Mr. Brun of Whitney- Fidalgo had telephoned and asked that the request be discussed even though he could not be present. He also wished their statement that they would conform to the Kodiak building code to be stricken from the letter. A previous letter from Mr. Stansbury to Whitney-Fidalgo, explaining why the buildings could not be used, was read. The Commission had previously concurred with the contents of this letter. The use proposed for the CB's is a non -conforming one, since the zoning is R-2, and the Commission agreed with Mr. Stansbury that the work done on them was more than normal maintenance. Mr. Stansbury reported that the majority of the work has already been completed. He has issued a stop work order and has condemned Building No. 1. If the building is not torn down in 90 days, a suit will be brought for the removal of the building. Mr. Stansbury intends to condemn the remaining buildings as they become vacant if they are also found to be unsafe, as he is doing with all similar buildings in the community. Mr. Stansbury recalled that Hopkins Construction Co. had also spent considerable time and money in planning a cannery worker's dormitory for these same lots, but that the Borough Attorney had advised that no excep- tion could be granted in an R-2 zone for any other type of residence. The Commission concurred that no exception could be granted in the current case. Mr. Waller moved that the request be denied. Motion seconded by Mr. Welch and carried by unanimous voice vote. VI PUBLIC HEARINGS KIBS272522 A. Re uest for Exce tion to Build, Store and Sell Crab Pots in Unclassified Zone - tISS 3100 Lot B - Ted Olafson Case 17 -A . Mr. Waller made a motion, r seconded by Mr. Welch, that the exception be approved. The meeting was recessed and the public hearing opened. Mr. Olafson stated that he would keep the pots back off the street. Mr. Duros spoke against the proposed exception. He said that there are some very nice homes in the area and that it is discouraging if such a business were to be allowed in the neighborhood, unles it could be done in a proper manner with a fence to obscure the view of the crab pots. But he didn't feel that such an arrangement could be effectively policed. A gentleman who lives next door to the lot stated that he has spent considerable effort clearing off his lot, and he felt this business would detract from the appearance of the neighborhood. He also felt that the welding might endanger his children, or that if the welding were done inside the building, it would be a fire hazard. There were no further comments, and the hearing was closed and meeting reconvened. Mr. Waller commented that it would be better to put this business into an area zoned for light industry, rather than in this neighborhood which is primarily residential. After further discussion, the motion to approve the exception failed by unanimous roll call vote. ZONING COMMISSION MEETING - April 26, 1967 2 VII ZONING ITEM - PRELIMINARY REVIEW - None VIII SUBDIVISIONS - PRELIMINARY APPROVALS - None IX SUBDIVISIONS - FINAL APPROVALS - None X OLD BUSINESS A. Request for Rezote Addn Blk 2 Lots 1 & 20 from R-1 to Business - Max Therkelsen Casen"! . A request for an opinion on this case had been requested from the Borough Attorneys. Mr. Madsen had telephoned a verbal opinion that he would not consider the rezoning of these two lots as spot zoning since they are historically business lots. He did not feel that specific plans for the business were required. However, he did suggest that more area be added to the rezoning, since there are other lots there which are historically business also. Mr. Hasaen commented that he thought, after reading Mr. Madsen's original opinion on spot zoning, that rezoning of the two lots would be considered spot zoning if no specific plans for a business were presented, since it would only be considered beneficial to one individual, unless it were a business which would serve the community. Mr. Therkelsen commented that no one was interested in buying the property for residential purposes, but several had shown interest in it as a business location. After considerably more discussion, it was agreed that a public hearing would be held at the next meeting on rezoning the two lots to business, unless the Therkelsens notified the Borough Office that they intended to add other lots to their request. It was agreed that there were quite a few businesses in the area. If more lots are added to the rezoning, it will be discussed further at the next meeting. XI PLANNING AND STAFF ITEMS A. Expansion of Business District. Mr. Waller made a motion that due to only 3 Commission members being present, the discussion on this matter should be r tabled until the next meeting. Seconded by Mr. Welch and carried by unanimous voice vote. B. Replacement for Mr. Breckberg. Mr. Hansen reported that he had requested one or two additional members in addition to the replacement. Herb Richmond's name had been suggested at the recent special joint meeting. Mr. Waller then suggested Ted Cross as a new member. XII AUDIENCE CON IMS A. Business Rezoning. Mrs. Therkelsen commented that she felt Mrs. Hajdu's suggestion to rezone the property on Mission Road on the beach side all the way to Spruce Cape was a good one. There was further brief discussion.
