Eckluni, Benson, Foster and Crow 193-A . The case was reviewed and plat
studied and discussed. is. Haney moved, seco:xled by fir. Welch, that the plat
be approved subject to the Lngineer's approval. The meting was recessed and
public hearing opened. There were no cotm�c-nts, and the hearing was closed and

L. Request for Exception for Gravel Site Leased to Kodiak Land Co. in Bells Flats --

before the incorporation of the Borough. Iir. Best stated that altS:ugh the
Gnmission previously approved this special land use, a public hearing was over-
looked and is techuiically required. Ix. Uallace yawed, seconded by fir. Haney,
that the exception be granted. i:eeting was recessed and hearing opened. Air.
Cornelius, in the audience, states: that the site was established in 1954 and
is located outside of the land selected by the Borough. he asked why it is
subject to Borough restrictions. Mr. Ualler explained that the whole island
is part of the Borough and subject to Borough regulations, even though the land
is not owned by the Borough. lix. Cornelius asked if this hearing were merely
a ted)nicality, and i1r. Waller replied that it zras, since both the Commission
and the Assembly previously approved this special land use. i:r. Taylor from
the audience stated that he had applied for an exception in Bell's
Flats but was told that he could not apply for a rezoning or an exception until
he owner: the land involved. He asked haw this exception could be applied for
since the land is not owned by the Kodiak Land Co. i>;r. Gdaller replied that
this land has been under the control of the Kodiak Land Co. for as long as the
Borough has been in existence and is under a formal lease from the State. IT.
Taylor did not think that a lease was sufficient. Mr. [?alley advised him to
take this matter up with the Borough Attorney. There were no other coaments
and the hearing was closea and meeting reconvened. motion carried by unanimous
roll call vote. The reasons given by the Comussion for the decision to grant
the exception were that this property has a historical use as a gravel site;
it will not endanger public health, safety or welfare; and gravel is a necessity
for the cacmunity.

C. Request for Exception for Sanitary Fill Site at Ibnashka Bav -

th exception be granted. The meeting was recessed and public hearing opened.
Mr. Erwin asked where the site was located, and it was pointed out on the map.
PI•. Erwin stated that, as property owner of the area next door to the site, he
is against it because it would create a rat problem and a health hazard. He
stated that there have been many more rats in the area of the present dump
than there were before. He thought that the f]1,1 area would drain through his
property, polluting his water supply. He felt that t1 is location of the fill
r' site would lower the value of his property, and he felt that the garbage should
either be barged out or incinerated. It was suggested that if the fill site
were used, as much material as possible should be burned. However, 11r. Berg,,
representing the VFW recreation site on the far side of the proposed fill site,
objected to burning because it would get into the water and ruin the beach area.
Otherwise, he had no objection to a land fill site as such, if it were maintained
according to the best practices, including being filled every day. The problm$%n
with the previous sites is that they have not been properly maintained. 11ter
further discussion, the hearing was closed and meeting reconvened. Vx. wallape
asked if other sites had been investigated. Hr. Best replied that they had,
but that this site was the most suitable, since the alternatives would either,
be in the watershed or beyond the Navy Base, which is not feasible distance- '
wise. 1r. Keiser felt that if the new site were properly maintained with the
proper attendants present and the proper equipment, the rats and other problems
could be sufficiently controlled. is. Waller was coriaer,nea about paper blowing
around and being a nuisance. It was felt that all of these problems should be
taken under consideration when writing the contract with the : spoeal company
and that tine proper requirements for maintenance should be included. fir. welch
felt that the decision on the exception should be postponed rniuii g further
study and the possibility of caai.ng up with a more agreeable arrangedieit. Mr.
Welch moved, seconded by Ix. I-taney, that action be tabled until the next
meeting to give the Coanission time to look into the matter further. IAtion
carried by unanimous roll call vote.

A. t for Exception for Borrow Sites in Bell's Flats - Borough Assembly (CAse
20 A . The map of the proposed sites was studied. ir. Best stated that the.
Nixons' area would be eliminated, fir•. Waller pointed out that the area near
the road hau been misused and cluttered, and the river dammed up. mr. Best
stated that by issuing leases to the area, the contractors would be required
to clean this up. i•s•. Waller asked if the depth of the sites had been cleared
with Fish and Game. Mr. Best stated that the lessees would have to meet these
requirements, but that the Borough leases would not atta-1pt to overlap the
Fish and Game regulations. A question was raiser claims,
as to the native clai, since
they had objected to the sale of gravel as well as the sale of land. ir. Best
stated that the Borough already had T.A. to this land. for. Haney movea, seconded
by vir. Valch, that a public hearing be held on this request on ifay 8. The
Commissioners will look at the area involved in the meantime. Potion carried
by unanimous roll call vote.
VIII SUBDIVISIONS, PRELIl'TIiQ M
A. Request for Approval of Advertising for vacation of New Kodiak Subdivision,
Blk 3, Lots 1-6 - ASHA (Case 112- 2 The flat was studied. The extension of
Wilton Uute's lot toward the State Highway vaas discussed. It was thought that
this was to allow access into the service station from the highway. Ar. Haney
moved, seconded by iir. jelch, that the acivertising for the public hearing on
the vacation be approved. ,lotion carried by unanimous roll call vote.
B. Bell's Flats Alaska Subdivision - State Division of Lands (Case 196-A).
C. Ruasian _v r Alaska Subdivision -State Division of CAse 98-E .
The cases were reviewed and plats studied. It was deciued to take care of the
zoning later when the plats are finalized. fir. Haney moved, seconded by IIr.
Welch, to accept the 'State Division of Lands preliminary plats of these
subdivisions. viotion carried by unanimous roll call vote.
P9r. Royal Large from the audience inquired about opening up land near the rifle
range in which he and others are interested. tie would like to either buy or
lease the property. he woulu be willing to pay for the survey costs. He would
prefer the lots to be large ones. This area has been selected by the Borough,
and PIr. Large was referred to the Assembly with his request.

D. Port Lions Seoonc, Addition - State Division of Lands (Case 195-A). The case
was reviewed and map studied, iir.raney asked if any waterfront property was
being set aside for more canneries, ow. Best states that the City Council
had preferred residential tracts along the water. After further ci.scussion,
e1r. Haney moved, seconded by 11r. Wallace, that the Commission concur with the
Assembly's approval of the Division of Lands' preliminary plat. motion
carried by wianimous roll call vote.
L. Rupreanof Strait Subdivision - State Division of Lands (Case 202-A). Case
r-- was reviewed and plat studied. i1r. Haney moves:, seconded by k1r. welch, to
concur with the Assembly's acceptance of the Division of Lands plat and the
road easements. Motion carried by unanimous roll call vote.

A. Zoning in Port Lions. ar. Culler askew if it would be possible for Port Lions
to have a zoning advisory committee to recaomand zoning there to the Ccnriission.
iir. Best stated that he had suggested this arrangement to Port Lions, and that
they will recai menu the zoning that they desire.
B. Road Easement in Dnashka Bay Subdivision. nr. Best stated that two lots in
the subdivision are temporarily being withheld from the over-the-counter sale
to allow for them to Le replatted to include the extension of Bay View Drive,
through to the Erwin hanestead. This must first be approved by the Assembly
and then will be brought before the Co mission.
