Crowe, Borough Engineer SUBJECT: Case No. VS-85-058, Variance from 16.20.050(C) (as originally advertised); and Subdivision of Block 15, KODIAK TOWNSITE ALASKA; to Lots 1 and 2, Block 15 (City of Kodiak) Mr. Wayne Kotula, owner of Lot 6, Block 7, Aleutian Homes Inc. Subdivision, has petitioned the City of Kodiak to sell him the portion of Block 15 of Kodiak Townsite Alaska on which his driveway is constructed. Due to the terrain adjacent to Thorsheim Street, Mr. Kotula evidently had an agreement with the original owner of Block 15 to allow him driveway access across Block 15. Now that the City has purchased Block 15, Mr. Kotula desires to obtain title to this land, and the City Council has agreed to sell the land to him. This same land is part of a subdivision (Case 5-84-019) revising the location of Cedar Street, which was granted preliminary approval by the Commission on April 18, 1984 subject to inclusion of utility easements needed by local utilities being shown on the plat. A portion of Proposed Lot 1 is involved in the easement still being negotiated by KEA for their new transmission line. The land is zoned Business, and, as such, does not require a variance from minimum lot area requirements, as there are none. I recommend that this subdivision be returned to the applicant, and that the creation of Lot 1 be included on the final plat for Case No. S-84-019 when all of the utility easements are finalized, as any easement granted KEA for their new transmission line will affect Lot 1. amm Attachments cc: City of Kodiak Roy A.
