The meeting was called to order at 7.40 p.m. in the Courtroom of the iiew state

closed and the pu:,lic hearing opened. ;ir. Anderson, Ir. Joiner, and 'Y. 'esnidal
spoke in favor of the rezoning. Thhey felt that enabling people to rent out a
second living unit in their hones xmuld help pay for them and for taxes, and
would _help to alleviate hodiak's housing shortage. A letter from J. 'i7. Llledge,
in favor of the rezoning, was read. :::r. Thonssen, after learning that the two-
family units which could be built in the area h:ould have to meet the various
requirements of the ordinance, such as setbacks and height limitations, expressed
no objection to the rezoning. :xs. Andrich and Ts. ;'elson spoke against the
rezoning. They purchased property in the area because it is one of the few
2-1 areas in Loclia;, and feared that if people sold their hors and both units
were rented out, that people would not take as good care of them. iir. Schott
irq red a: -)out off-street parking if the area should be rezoned. It bras
pointed out that the ordinance requires off-street narking to Le required for
each duelling unit. The question was raised as to x4iat authority the Cmmission
has over individuals who violate the zoning regulations. It was stated that the
Borough could take suchh individuals to court and force them to amply with the
ordinances. Tne hearing was closed and the meeting reconvened. irs. Gellis
asked if all the families in the two blocks had Teen contacted concerning the
rezoning. iir. i-uhderson replied that Sr. Lassen had not been contacted, and '
that i Sr. John Stewart had declined to ca-ment. T'ne question was called and
the motion carried by unanimous roll call vote. The Camdssion agreed that the
reasons given by the audience for tie rezoning •aaz sufficient justification for i'

A. Request for Variance - Lots 24 and 25. Block 2. Allman Addition -• Ron Chase
(lase dud-w . iir. btansoury stated that he naa retusea to issue a building
permit to Jr. Chase to enlarge or alter his present building on these lots,
since it was a non -conforming business use in a residential zone, and the
ordinance specifically denies such enlargement or alteration. ;r. Stansbury
did not understand ha, a variance could apply in this case, since there would
then be no difference be�men a variance and an exception, He thought that an
exception would apply in the case of a non -conforming use, rather than a
variance. It was pointed out that the Borough Attorney had researched this
natter and found that a variance could also apply in such a case. The questions
were raised as to liar such a use would fit in with the Comprehensive Plan, and
uinether this building would be safe for another story. Also, it was pointed out
that 50 percent more narking would be needed, and :;rs. Gellis stated that it had
been decided previously that sufficient parking could not be provided. IIr.

It was pointed out that in the case of a request for a variance, a public
hearing was mandatory. Ir. Brothers withdrej his motion, and 1 Irs. Gellis
withdrew her second. i1r. "elch moved for a public hearing to 1,e held at the
next meeting. :lotion died for lad- of a second. It was then found that a plat
had not been submitted with .Ar. Chase's application. Since a plat is one of
the requirements for an application for a variance, the Commission agreed to
table further action on the request until the next meeting, pending submission
of the required plat.

Case lI -D . i,r. Hartman's letter of application was react. IT. Swan -lay
stated that tills case waz jimi.lar to that of `zr. Chase, since 'Jr. Hartman is
trying to enlarge a building which bae a non-confonning use. It was pointed out
that the Attorney felt that a residence could legally be Permitted in a business
zone. iowever, the Caanission felt that the Zoning Ordinance did not permit
residences in business zones. It was suggested that Hr. :zrtman's lot be
rezoned to R-3, since it is contiguous to R-•3 zoning, and since this would
permit him to enlarge his house. Ur. Brothers moved, seconded by 'ins. Gellis,

VIII SUBDIVISIGOS, PR&Z Mc AW F.2EUU1
A. Request for Vacation and Replat of Entire Urban Renewal Project. A letter from
ASHA outlining the suggested procedure for accanplishing Ms wias read. The
letter suggested that actual survey not be required until the lots are sold.
This procedure would allay some title transfers which are nay being held up
because certain blod-,s have not been platted and recorded. It would then also
alla,T these lots to again he placed on the tax roll. The plats were studied.
i,rs. Gellis moved for tentative approval of the plats, and approval of the
