KODIAK ISLAND BOROUGH Assembly Regular Meeting January 16, 2025 A regular meeting of the Kodiak Island Borough Assembly was held on January 16, 2025, in the Assembly Chambers. The meeting was called to order at 6:30 p.m. Staff present were Borough Manager Aimee Williams, Community Development Director Christopher French, Finance Director Dora Cross, Deputy Clerk Lina Cruz, and Assistant Clerk Irene Arellano. ASSEMBLY MEMBERS' COMMENTS • Assembly Member Whiteside thanked the community members for attending the School Board meetings and he announced the upcoming Kodiak Island Borough and City of Kodiak Joint Fisheries workgroup meeting on January 22, 2025. • Assembly Member Griffin expressed his gratitude and congratulated Dennis Irwin, the newly appointed member of the Solid Waste Advisory Board. He also thanked all those who participated in the School Board meetings. He shared the exciting news that enrollment at the Kodiak College has increased and classes have resumed. • Assembly Member Johnson expressed his disappointment regarding the vetoed contract design for pool repairs. He looked forward to a fully comprehensive pool repair plan contract in the near future. Additionally, he was pleased to learn that airport parking enforcement will be implemented soon. Lastly, he mentioned he will keep advocating for regulations concerning Airbnb rentals. • Assembly Member Ames thanked the public for their participation in the Assembly meetings. He also thanked the Assembly for their dedication and effort in making decisions. • Assembly Member LeDoux expressed his gratitude for the insightful discussion regarding the restaurant eating place license renewal protest letter, acknowledging the challenging and intricate nature of the decision. He extended his thanks to the Borough Manager and the staff for their thorough reports. Ordinance No. FY2025-14, which reallocates funds from the American Rescue Plan Act. • Assembly Member Smiley pointed out his thought on issues causing the decline in student enrollment in the school district. He also expressed his concerns that Charter Schools are not required to test their students, making state -mandated testing optional. He believes that the State of Alaska would greatly benefit from requiring all students, regardless of their school type, to participate in these assessments noting that this would be a crucial step in evaluating whether children are truly learning. 17. DISCUSSION: A fisheries disaster determination was made for the 2021-22 and 2022-23 Bristol Bay King Crab and Bering Sea Snow Crab fisheries resulting from an unpredicted crab die -off. Disaster funds were subsequently determined and made available for distribution to eligible communities based on each community's proportion of the estimated gross revenue value. Kodiak Island Borough is eligible for these funds due to the history of Bristol Bay and Bering Sea crab landings made in Kodiak and the associated severance taxes collected on those landings. The Borough Manager received notification that the KIB is eligible to receive $53,182.40 of the disaster funds to help mitigate losses in fish (severance) tax revenue. Kodiak Island Borough Code 3.25 authorizes the Assembly to accept grant funds and requires that grant funds not designated for a specific purpose be appropriated via ordinance. ALTERNATIVES: Postpone, amend, or fail to advance the ordinance. FISCAL IMPACT: $53,182.40 increase to the Fisheries Economic Development project budget. FY2025-12 AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH ACCEPTING AND APPROPRIATING GRANT FUNDS FOR THE 2021-22 AND 2022-23 BRISTOL BAY RED KING CRAB AND BERING SEA SNOW CRAB FISHERY DISASTER DECLARATION WHEREAS, on May 9, 2023, the U.S. Secretary of Commerce made a disaster determination for Alaska's 2021-2022 and 2022-2023 Bristol Bay King Crab and Bering Sea Snow Crab fisheries, under the Magnuson -Stevens Fishery Conservation and Management Act in response to the March 3, 2022, and October 21, 2022, requests from Governor Dunleavy; and WHEREAS, National Oceanic and Atmospheric Administration (NOAA) Fisheries allocated $94,489,726 and $96,621,465 to address losses to the affected management areas in response to the disaster determination; and WHEREAS, the Alaska Department of Fish and Game (ADF&G) works with affected stakeholders and NOAA Fisheries to identify funding priorities and develop spend plans for each fishery disaster. ADF&G drafted a spend plan to disperse the allocation of these funds and sent the final spend plan to Pacific States Marine Fisheries Commission (PSMFC) for administration; and WHEREAS, the PSMFC has provided notification that the Kodiak Island Borough is eligible to receive a one-time payment of fifty-three thousand, one hundred eighty-two dollars and forty cents ($53,182.40) to compensate for the borough's lost income due to this fishery disaster; and WHEREAS, Kodiak Island Borough Code 3.25.040.0 requires that grant funds which are unlimited as to use, or subject only to general limitations, be appropriated by ordinance and include an appropriate budget amendment. Disaster funds are to be distributed pro rata to eligible communities based on each community's proportion of the combined total 2019/20 and 2020/21 estimated gross revenue value for both species. The KODIAK ISLAND BOROUGH is eligible to receive a one-time payment of $53,182.40. Municipalities and boroughs rely on revenue generated from BBR and BSS crab fishery landings and other economic activities related to the BBR and BSS crab fisheries. The state's Fishery Business tax rate is 3% for shore -based crab landings and is shared 50/50 with the state and municipalities/boroughs where the landings occur. If landings occur in the bounds of a municipality and borough, landing tax revenues are shared 50/50 between each entity. A local raw fish tax, ranging from 2% to 3.5%, is applied in various municipalities and boroughs, depending on the location and species. Funds were allocated to affected communities to help mitigate losses in fish tax and other economic losses due to the fishery disaster. Direct payments to municipalities and boroughs are based on the port of landing where BBR crab deliveries occurred. The following criterion is proposed for community eligibility: • BBR or BSS crab must have been landed in the community during the 2019/20 and/or 2020/21 season based on the port of landing from ADF&G Fish Ticket data. Landings of BBR and BSS occurred in five communities represented by five municipalities and two boroughs during the 2019/20 and 2021/22 seasons: 1) Unalaska, 2) Akutan, King Cove and Aleutians East Borough, 3) St. Paul, and 4) City of Kodiak and Kodiak Island Borough. DISCUSSION: Staff has complied nine (9) personal tax accounts that have been determined uncollectable for various reasons. All legal resources have been exhausted by staff in pursuing collections. It is staff's desire for Borough accounts to be current and properly reflect the financial status of receivables in accordance with Generally Accepted Accounting Principles. FY2025-13 AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH WRITING OFF THE PERSONAL PROPERTY DELINQUENT TAXES, PENALTIES, INTEREST AND FEES OF THOSE NON -COLLECTABLE ACCOUNTS WHEREAS, it is the desire of staff to have the Kodiak Island Borough's accounts to be current and properly reflect the financial status of the Borough in Accordance with Generally Accepted Accounting Principles; and WHEREAS, part of the routine practice to bring the accounts current in compliance with Generally Accepted Accounting Principles includes classifying and writing off as uncollectible those accounts determined to be uncollectible; and WHEREAS, the Kodiak Island Borough Code does not identify a specific method for writing off delinquent accounts determined to be uncollectible; and WHEREAS, the Kodiak Island Borough Assembly has previously requested that accounts to be written off be identified and the write-off of the accounts be approved by the Assembly by ordinance; and WHEREAS, staff has compiled nine personal tax accounts which have been determined to be uncollectable for various reasons; and WHEREAS, all resources to legally collect the delinquent tax accounts identified for write off have been exhausted by staff. The possible solutions that NRCS can offer are still more of a long-term solution. Staff is continuing to work on short term solutions to help including researching the necessary steps to grant an easement to KIB property in the area. Financial Statements — As requested in the work session last week, KIBSD financial statements were sent to the Assembly on January 31, 2025. Administrative Official — Assessor Seema Garoutte will be the Administrative Official for the February 20th and March 6th regular meetings. Property Assessment and Taxation Implementation Project — Staff is back to regularly scheduled meetings with the Tyler Implementation team. Main focus is still with the Assessing department and the project is currently 21 % complete. Go -live date is still expected to be June 25, 2025. Electronic Timesheet Implementation Project — Staff is working with the vendor to set up business rules and processes. Go -live date is expected to be mid -April, depending on IT's workload and staffs training availability. Community Development Multi -Jurisdiction Multi -Hazard Mitigation Plan Update The final draft of the plan document is scheduled for a review by the Borough Assembly at its work session on February 27, 2025, and regular meeting on March 6, 2025. Assessing Senior Citizen / Disable Veteran exemptions — A total of 33 Seniors and 4 Disabled Veterans did not file for 2025. Of those, 6 Senior Citizens and one Disabled Veteran (new file) have provided us with late file applications. Village travel dates for SC/DV exemptions: Assessing and KANA will be presenting to the Assembly on February 27cn Page 23 of 81 AGENDA ITEM #11.A. Values - Assessing has not seen a leveling or decrease in values for properties. Sales continue to increase compared to assessed values. Notice of Values will be mailed on February 26, 2025. Appeal period begins February 27, 2025, and runs through March 28, 2025. Alaska Taxable reports the Kodiak Island Borough's assessed rates to be at 79% of the market value. The regulation is to say above 80% of the market value. Tyler Conversion — • Assessing continues to run queries for cleanup and is preparing for file transfer as well as verifying the data in the new system. Assessing has also been tasked with coordinating both Tyler IT and KIB IT for information on where the information lives in our PACS system and where Tyler needs to pull from. • The Apex sketch test is scheduled for the end of January. To date, Assessing has sketched over 3600 properties into the new software, of the just over 5000 properties with improvements. 0 • Several issues with the Harris software have popped up during our cleanup. Assessing has 5 open tickets with Harris as of 02/05/2025. Engineering and Facilities KIB in the Spotlight — Dave Conrad and Jena Hassinger presented in Anchorage at the Alaska Forum for the Environment about the history and operation of the Kodiak Island Borough Landfill this week. Multi -Facility Elevator Modernization RFP— EF Staff have advertised a Request for Proposals for the Multi -Facility Elevator Modernization Project, which includes the two elevators at PKIMC and one elevator at the Kodiak Middle School. The proposals were due February 4 and EF Staff received one proposal from TK Elevator Corporation. The proposal has been sent to the ARB Board for evaluation and will be presented to the Assembly for consideration of approval at the February 27 Work Session. Borough Building - Borough building abatement associated with the roof drain piping has been scheduled for 2/15-2/16. Roof drain will be repaired by plumbers and staff after clearance. Borough Building Boiler Installation — Project continues with the pipe insulation being completed. KIB continues to have difficulty in communicating with the contractor. Luckily, the heat has been consistent and adequate to date throughout the facility. Mental Health Buildings — • The contractor has begun hazardous material sampling and anticipates mobilizing the last week of February and begin demolition the first week of March. The contractor plans to perform abatement and demolition in both facilities in a single mobilization effort. Page 24 of 81 AGENDA ITEM #11.A. All non -hazardous material will be removed for disposal at the KIB Landfill. ACS / GCI has been contacted and scheduled to remove the communication and fiber lines at the facility • KIB staff removed small vegetation on the exterior of the facilities. KFRC — • A quote has been obtained for the replacement of the failed seawater pump. Once approved, there will be an 18-20 week lead time on materials. • A proposal was requested from Long Technologies for the verification and possible installation of existing gauges, monitors, and flow meters to improve remote monitoring. • The replacement of the existing ozone decontamination system will be advertised soon. Staff has discussed with the manager and are reviewing the package with the engineering consultant prior to advertising to ensure completeness. No movement on these GSA items: Awaiting GSA revised contract amount for required water testing. No return contact has been received. The due date for sampling and receipt of data will be extended to reflect the delay. Staff continues to wait for a request for additional electrical circuits have been priced for GSA consideration to accommodate additional chillers for NOAA. Project to be funded on the next fiscal year's budget. Landfill — Baler building tipping floor requires caulk be applied in the relief cuts. Product has arrived and the crew will be onsite 2/8-2/9 to install. During the demolition of the existing floor, it was discovered that, at some point, an approximately 6-inch overlay of material had been applied throughout the baler building. This material was largely unconsolidated and was not structurally attached to the existing slab. As a result, the overlay thickness for this project increased from the originally designed max of 4 inches to 8 inches. This brings the overall slab thickness to approximately 17 inches opposed to the original design of 10 inches with 2 inches of wear layer. This triggered the need for a structural analysis of the baler floor structure, which will result in the restriction of certain vehicles being used simultaneously or in specific location on the floor. Based on the findings, certain operational adjustments will be required to ensure the safety of the baler staff, patrons, and the physical structure. Staff is continuing to investigate the Compliance Order by Consent (COBC) associated with the storm water violations. A well installation RFP was drafted to gather data to inform the cause of the storm water violations. Unfortunately, there were no bidders for the project. Page 25 of 81 AGENDA ITEM #11.A. KIBSD — Peterson School Roof — (no change) KIB staff is awaiting a final determination for the final repair of the flashing that failed. Anticipate the warranty work will not be completed until spring. Roof has not had any additional leaks reported. Service Areas — Follow up meetings with the AKDOL (Department of Labor) will be held to ensure the new contracts are compliant with Wage and Hour regulations. The following is a synopsis of actions and IKAC discussions that took place at that meeting. This report is not all inclusive. REGIONAL CITIZENS' ADVISORY COUNCIL Report from Alyeska Pipeline Service Company Klint VanWingerden, Director of Operations for the Valdez Marine Terminal (VMT), updated the Board on Alyeska's plan to address concerns raised in a Council -sponsored report titled "Assessment of Risks and Safety Culture at Alyeska's Valdez Marine Terminal." That report, authored by PWSRCAC contractor Billie Pirner Garde, was released in 2023. VanWingerden noted that Alyeska's team of personnel who were tasked with reviewing the report had focused on it as an opportunity to improve operations. The team developed a plan to understand the issues, recommend changes, and take action based on the report's three recommendations to Alyeska. VanWingerden summarized what Alyeska has done so far to address the concerns, and what tasks are ongoing. Highlights include: • Morales reported that a potential new fire -fighting foam is performing well in testing. Alyeska has been looking for a new product to replace the current foam, which contains PFAS, a chemical that is associated with human health concerns. • Alyeska has extended its 10-year contract with Edison Chouest Offshore (ECO) for an additional 5 years. In 2018, ECO took over as the contractor that provides Alyeska's Ship Escort Response Vessel System (SERVS) with escort tugs and a variety of response equipment and personnel. The contract will now expire in 2033. Swiss reported that the plan was approved by the Alaska Department of Environmental Conservation (ADEC) in November 2024, allowing operations to continue in accordance with the plan. However, ADEC had previously set several conditions of approval that must be met. One of these conditions requires further analysis of the secondary containment liners under the crude oil storage tanks at the terminal's East Tank Farm. These liners, made up of catalytically -blown asphalt, are part of a system that is intended to contain oil in the event of a spill and prevent contamination of surface and Highlights from January 2025 meeting of the PWSRCAC Board of Directors I www.pwsrcac.org Page 28 of 81 AGENDA ITEM #11.A. groundwater. These underground liners are hard to inspect, and the Council is concerned about the condition of the nearly 50-year-old liners. Alyeska receives a 60% "prevention credit" from ADEC based on the integrity of these liners. This credit allows Alyeska to plan for a smaller spill, thus reducing the amount of equipment and responders committed to be on hand to begin a quick response. The credit is contingent upon the asphalt liner meeting ADEC's "sufficiently impermeable" standard and able to contain spilled oil to allow cleanup to be completed before surface and groundwater contamination occurs. Cracks and damage have previously been discovered in some areas, so the Council has concerns about the liner's integrity. After ADEC's decision to renew the plan, PWSRCAC submitted a Request for Informal Review to ADEC's Spill Prevention and Response Director to require that submissions in response to the liner be subject to public review, that a schedule for completing liner inspections be incorporated into the plan, and to require corrective action if inspections demonstrate that the existing liner does not meet the "sufficiently impermeable" standard. A decision in response to our request is expected by February 24, 2025. Law could adversely affect fishing vessel response program Joe Lally, the Council's Director of Programs, updated the Board on a law, and subsequent potential Coast Guard policy and regulations, that may affect the fleet of fishing vessels that are contracted and trained by SERVS to help respond in case of an oil spill. In 2023, in response to enactment of a provision in the National Defense Authorization Act, the U.S. Coast Guard released a Work Instruction that would unnecessarily impose onerous inspection requirements to vessels that tow boom and other response equipment during oil spill drills and actual incidents. This is problematic because the vessels that participate in the response fleet were built for purposes other than oil spill response, and a significant number of them are uninspected. If implemented, these inspection requirements would pose significant operating and response challenges, potentially delaying a response. Additionally, many of the vessels who have not been subject to this type of inspection before, may be excluded from participating in the response program altogether. The Council has been participating in a workgroup to help develop a solution that would allow the current fleet to remain in operation. Members include the Council, Cook Inlet Regional Citizens Advisory Council, Alyeska/SERVS, Alaska Chadux Network, Cook Inlet Spill Prevention and Response, Inc., Washington State Maritime Cooperative, Southeast Alaska Petroleum Response Organization, and American Waterway Operators. Workgroup members are engaging with the Coast Guard and legislators to determine a path forward on this issue. Weather buoy outages During several agenda items, the Board discussed the recent outage of NOAA's Seal Rocks weather buoy (Station 46061), which collects and transmits data about weather conditions near Hinchinbrook Entrance. The Entrance is the narrow passage between Hinchinbrook and Montague Islands through which tankers pass between Prince William Sound and the Gulf of Alaska. The wind and wave data from the Seal Rocks buoy is the primary source of information that the U.S. Coast Guard uses to make critical navigation safety decisions for outbound laden tankers. During the U.S. Coast Guard's report to the Board, CDR Sarah Rousseau explained that while the buoys are important, they are not the only source of data about weather conditions in the area. She noted that the U.S. Coast Guard also receives reports from Alaska Marine Highway vessels; SERVS tugs; spot reports from the National Weather Service; and other local mariners. In recent years, the Council has been voicing support for NOAA's National Data Buoy Center to receive additional funding for more timely repairs to the Seal Rocks weather buoy, and the other important weather buoys in the Gulf of Alaska, when outages occur. Coast Guard to implement regulations for marine cybersecurity During the U.S. Coast Guard's report, CDR Sarah Rousseau stated that the Coast Guard is implementing regulations for marine cybersecurity. She noted that the new regulations will require reporting of incidents, additional training of mariners, cybersecurity staff person, a cybersecurity assessment, as well as a plan to include cybersecurity components into drills and exercises. She noted that prior to this upcoming regulation change, all cybersecurity efforts have been voluntary. She noted that she expects the final rule to be in place this July. The U.S. Coast Guard is currently seeking public comments on a possible 2-to-5-year delay in the implementation schedule of these new cybersecurity regulations that affect U.S. flagged ships. Those comments must be submitted by March 18, 2025. Details are available on the U.S. Coast Guard's website: www.tinyurl.com/USCG-Rule-Cybersecurity Reports accepted: Long -Term Environmental Monitoring Program The Council accepted the 2024 Summary Report for the Council's Long -Term Environmental Monitoring Program (LTEMP) and the associated Technical Supplement by Dr. Morgan Bender of Fjord & Fish Sciences. The report and supplement provide data and results from the 2024 sampling excursions in Port Valdez and the northern Gulf of Alaska coast. During the excursions, samples from mussels, sediment, and seawater were collected at a combination of regions that are near current oil industry activities, sites that were polluted by Exxon Valdez oil, and reference sites. The samples were analyzed for the presence of hydrocarbons. This pilot study provides a summary of 23 metals identified in sediments collected near two monitoring sites in Port Valdez. Her analysis showed that some of the metals could be above the threshold for negative effects. Report accepted: Calculations Used in Tank Vent Headspace Report The Council accepted a report by Bill Mott of Taku Engineering titled "2022 Tank Pressure/Vacuum Pallet Damage: Crude Oil Storage Tank Headspace Gas Assessment." In this report, Mott summarized the calculations and key assumptions (due to the limited available data) used in a previous report related to a 2022 incident. In that incident, pallets or vents on several of the terminal's crude oil storage tanks were damaged due to excessive snow load and ice accumulation. The previous report found that the existing monitoring points are inadequate for identifying high oxygen content in a single tank headspace, and there were areas of combustible gas concentrations in all of the tanks operating at a slight vacuum that had major unrepaired vent damage. Page 42 of 81 AGENDA ITEM #14.A.1. 4.0 RESPONSIBILITY OF BIDDERS. Only responsive Bids from responsible Bidders will be considered. A Bid submitted by a Bidder determined to be not responsible may be rejected. Nothing contained in this section deprives the Owner of its discretion in determining the lowest responsible bidder. Before a Bid is considered for award, a Bidder may be requested to submit information documenting its ability and competency to perform the work, according to general standards of responsibility and any special standards which may apply. It is Bidder's responsibility to submit sufficient, relevant, and adequate information. Owner will make its determination of responsibility and has no obligation to request clarification or supplementary information. 5.0 NON -RESPONSIVE BIDS. Only responsive Bids will be considered. Bids may be considered non -responsive and may be rejected. Some of the reasons a Bid may be rejected for being non- responsive are: a. If a Bid is received by the Owner after the Deadline for Bids. b. If the Bid is on a form other than that furnished by the Owner, or legible copies thereof, or if the form is altered or any part thereof is detached; or if the Bid is improperly signed. c. If there are unauthorized additions, conditional or alternate Bids, or irregularities of any kind which may tend to make the bid incomplete, indefinite, ambiguous as to its meaning, or in conflict with the Owner's Bid document. d. If the Bidder adds any unauthorized conditions, limitations, or provisions reserving the right to accept or reject any award, or to enter into a contract pursuant to an award. This does not exclude a Bid limiting the maximum gross amount of awards acceptable to any one Bidder at any one Bid opening, provided that any selection of awards will be made by the Owner. e. If the Bid does not contain a Unit Price for each pay item listed, except in the case of authorized alternate pay items. £ If the Bidder has not acknowledged receipt of each Addendum. g. If any of the Unit Prices Bid are excessively unbalanced (either above or below the amount of a reasonable Bid) to the potential detriment of the Owner. h. If a Bid modification does not conform to Article 10.0 of this Section. 6.0 BIDDER'S EXAMINATION OF CONTRACT DOCUMENTS. It is the responsibility of each Bidder before submitting a Bid: a. To examine thoroughly the Contract Documents, and other related data identified in the Bidding documents (including "technical data" referred to below): 1. To consider federal, state, and local laws and regulations that may affect cost, progress, or performance of the work, 2. To study and carefully correlate the Bidder's observations with the Contract Documents, and other related data; and b. To notify the Owner of all conflicts, errors, or discrepancies in or between the Contract Documents and such other related data. c. Bid is premised upon performing the work required by the Contract Documents and such means, methods, techniques, sequences, or procedures of construction as may be indicated in or required by the Contract Documents, and that the Contract Documents are sufficient in scope and detail to indicate and convey understanding of all terms and conditions for performance of the work. 7.0 BID FORM/SCHEDULE. a. Bids and bidding information shall be submitted on the Bid Form/Schedule and other documents provided and as stipulated in the Invitation to Bid. b. All blanks on the Bid Form/Schedule shall be filled out. c. All requested Alternates shall be bid. If no change in the Base Bid is required, enter 110.19 d. The Bidder shall make no stipulations on the bid form nor qualify the Bid in any other manner. e. All documents requiring a signature shall be signed by the person or persons legally authorized to bind the Bidder to a contract. A Bid by a corporation shall further give the state of incorporation and have the corporate seal affixed. A Bid submitted by an agent shall have the current power of attorney attached certifying the agent's authority to bind the Bidder. 8.0 SUBMISSION OF BIDS. All information required for bidding shall be submitted in accordance with the Invitation to Bid. The Bidder shall assume full responsibility for timely delivery at the location designated for receipt of Bids. Oral, telephonic, telegraphic, facsimile or other transmitted bids will not be considered. Alteration of bids by facsimile may be permitted as provided in section 10.0(c). 9.0 DISCREPANCIES IN BIDS. In the event there is more than one Pay Item in a Bid Schedule, the Bidder shall furnish a price for all Pay Items in the schedule, and failure to do so may render the Bid non -responsive and cause its rejection. In the event there are Unit Price Pay Items in a Bid Schedule and the "amount" indicated for a Unit Price Bid Item does not equal the product of the Unit Price and quantity, the Unit Price shall govern and the amount will be corrected accordingly, and the Bidder shall be bound by said correction. In the event there is more than one Pay Item in a Bid Schedule and the total indicated for the schedule does not agree with the sum of the prices Bid on the individual items, the prices Bid on the individual items shall govern and the total for the schedule will be corrected accordingly, and the Bidder shall be bound by said correction. 10.0 BID MODIFICATIONS AND UNAUTHORIZED ALTERNATIVE BIDS. a. A Bid may not be modified, withdrawn, or canceled by the Bidder for 90 days following the time and date designated for the receipt of Bids, and each Bidder so agrees in submitting a Bid. b. Prior to the date and time designated for receipt of Bids, a Bid submitted may be modified or withdrawn by the Bidder. c. See the Bid Modification form which must be used to modify a bid after it has been submitted. The bid modification form may be delivered in person, by mail or by fax to the Contact Person listed in the Invitation to Bid. Withdrawn Bids may be resubmitted up to the date and time designated for the receipt of Bids provided that they are then fully in conformance with these Instructions to Bidders. 11.0 BID PROTESTS A formal written protest shall be filed by an aggrieved bidder within ten (10) business days after announcement of the Notice of Intent to Award. The written protest shall, at a minimum, include the following: Name, address, and phone number of protesting contractor; Authorized signature of the protesting contractor, or the contractor's representative; Identification of the proposed award; Copies of all relevant documents; Reason for the bid protest. Protests will be evaluated by the BOROUGH MANAGER. The decision of the BOROUGH MANAGER shall be final. 12.0 AWARD OF CONTRACT. Award of a contract, if it is awarded, will be on the basis of materials and equipment described in the Drawings or specified in the Technical Specifications and will be made to the lowest responsive, responsible Bidder whose Bid complies with all the requirements prescribed. Unless otherwise specified, any such award will be made within the period stated in the Notice Inviting Bids that the Bids are to remain open. Unless otherwise indicated, a single award will be made for all the Bid items in an individual Bid Schedule. If the Owner has elected to advertise this Project with a Base Bid and Alternates, the Owner may elect to award the contract for the Base Bid, or the Base Bid in combination with one or more Alternates selected by the Owner. In either case, award shall be made to the responsive, responsible bidder offering the lowest total Bid for the work to be awarded. Kodiak Island Borough Special conditions Project: KFRC Elevator Maintenance Services Contract Number: FY2025-42 SC 01 General Statement The Special conditions set forth conditions and requirements unique to this Project and are supplemental to, and supersede, the Kodiak Island Borough "General Conditions." SC 02 Scope of Work The Scope of Work of the Base Bid of this Contract shall include providing all labor, materials, tools, equipment, transportation, supervision and facilities necessary to: Base Bid Contractor shall provide all services necessary to inspect, maintain, test, and certify the Kodiak Fisheries Research Center (KFRC) elevator as required by safety Code for Elevators and Escalators, ASME A17.1-2013, which includes: Four (4) quarterly inspection, maintenance, testing, and certifying of the elevator per year. One (1) category 5 test (required every five (5) years) will need to occur in 2025. The maintenance and service must be performed by trained personnel directly employed and supervised by the Contractor. All work shall be performed in accordance with the State of Alaska Department of Labor & Workforce Development adopted American Society of Mechanical Engineers (ASME) A17.1 — 2013, Safety Code for Elevators and Escalators and the latest edition of the "American Standard Safety Code for Elevators, Dumbwaiters, and Escalators". The Contractor shall perform all work ordered by the State of Alaska Elevator Inspector to ensure that the elevators and related equipment meet or exceed State of Alaska ANSI A17.1 code requirements. The Contractor shall evaluate the performance of the elevator and its equipment as often as needed, but at least once per quarter. Quarterly Inspection, Maintenance, and Testing: The Contractor shall provide a schedule of each inspection or evaluation to be done to the Borough. The Contractor shall submit a report of each completed inspection or evaluation to the Borough in writing within ten (10) days of completing said inspection or evaluation. Safety switches, load weighing switches, hoist way switches, governors, governor components, tension sheaves, compensating sheaves, platforms, car and counterweight safety devices, counterweight guides, roller guides, counterweight sheaves. Fixtures including; car and hall buttons, car and hall lantern, position indicators, keyed switches, lamps, and emergency light and bell. Perform routine inspections and tests of vertical platforms in accordance with 8 AAC 77.025(a). Category 1 inspections, annual, and five-year (Category 5) full load test as required by ASME Al7.1 2013 Safety Code for Elevators. The Borough has thirty (30) days from the date of quarterly services provided to report any malfunctions or deficiencies to the Contractor. In the event the elevator malfunctions between scheduled inspections or maintenance visits due to the maintenance performed, the Contractor shall provide a qualified service representative for the purpose of repairing the elevator within a reasonable amount of time. The Contractor shall be responsible for all part or material costs to remedy such malfunctions or deficiencies. Alternate Bid(s) The Scope of Work of the Additive Alternate No. 1 Bid of this Contract shall include providing all labor, materials, tools, equipment, transportation, supervision, and facilities necessary to perform Emergency work in case of elevator failures, which will be compensated via time and materials. Contractor is to outline their hourly rates, overtime rates, and parts markup as outlined in the bid schedule. All travel time should be included into the hourly rates. The Contractor shall make all reasonable efforts to complete the work during normal work hours, and reasonable efforts to avoid extravagant expenditures in order to fix emergency malfunctions or deficiencies that have been reported. SC 03 Time of Completion The Term of the contact is for an initial four-year period from February 7, 2025 until June 30, 2029. Upon satisfactory performance, determined solely by the Borough Manager, the Borough may exercise the option to extend the contract for up to three (3) additional one (1) year periods by providing notice of the exercise of the option to extend at least sixty (60) days before expiration of the current term. If the Borough provides a notice of extension, the Contractor shall accept or reject the extension within thirty (30) days of the date the notice is sent by the Borough. The parties may mutually agree to continue services after expiration of the final term on a month -to -month basis on the same rates until a new contract can be awarded. Following the initial 3-year term, requests for rate increases may be entertained by the Borough, and if acceptable, will be incorporated into each contract extension agreement. SC 04 Documentation During the duration of this contract the Contractor will coordinate with the Borough to have and maintain an information library that will be located in the elevator closet on site at all times. This information library shall consist of manufacturer's equipment maintenance schedules, equipment schematics, layouts, parts list, etc., and other basic information needed to properly maintain the included elevator systems. The Contractor shall, within thirty (30) days of the award this contract, submit copies of the schedules, checklists, reports, and tests which will be used for conduction and recording all preventative maintenance for the Borough's information and to be stored in the information library. The Borough reserves the right to request additions or alterations to these documents as they deem necessary. Upon termination of the contract, the Borough shall become sole owners of all the above referenced records. SC 05 Suitable Materials During the term of this contract, unless otherwise specified, all materials, supplies, or equipment offered by a Contractor shall be new from the original equipment manufacturer (OEM), unused, of recent manufacture, and suitable for the manufacturer's intended purpose. Obsolete or unavailable OEM parts must be replaced with the highest quality parts available to the Contractor. Minor consumable parts can be stocked at the location of work. The Contractor must also stock minor parts specific to the specified elevators in their warehouse. Major parts not stocked must be shipped next day air when required. The Contractor warrants all articles, materials, and equipment supplied under a contract resulting from this request for quote to the specifications of this contract, to be fit and sufficient for the use specified, to be merchantable quality, and to be free from defect of materials or workmanship. Equipment, articles, and/or materials received which do not conform to the above warranties, may be held at the Contractor's risk of loss or damages, or returned at the Contractors expense at the discretion of the Borough. SC 06 Special Site Conditions The Kodiak Island Borough owns the Kodiak Fisheries Research Center and is responsible for maintaining the building and safety for tenants and public use. Any work that may in some way disturb the tenants or public visitors needs to be coordinated with the Engineering and Facilities office 907-486-9343 at least two weeks prior to work starting. If the there is a larger amount of refuse or debris generated by the project. The Kodiak Island Borough landfill fees may be waived. The Contractor will be responsible for hauling demolished materials and construction waste out to the Kodiak Island Borough Baler facility is located at 1203 Monashka Bay Road. SC 07 Hazardous Waste Generation Every effort to minimize or eliminate the generations of hazardous waste shall be used by the Contractor in the performance of the work of this Contract. SC 08 Site Preservation, Restoration, Cleanup and Environmental Reporting The Contractor shall be solely responsible for damage to public or private property caused by their operations. The Contractor shall take all precautions necessary to control dust. The Contractor shall notify the Kodiak Island Borough of any claims of damage and shall clean and restore any property so damaged at the sole expense of the Contractor. All spills or releases of any hazardous substance shall be reported to the appropriate governmental agency as well as notice to the Kodiak Island Borough. Contractor shall be responsible for all associated cleanup costs and fines. At all times during the work, keep the premises clean and orderly. Upon completion of the work, repair all damage caused by equipment and leave the Project free of rubbish and excess materials of any kind. SC 09 Permits The Contractor shall obtain all licenses and permits that are required to do the work. SC 10 Order of Award of Alternative Bids Additive Alternate and/or Deductive Alternative Bids will be awarded, if any are awarded, in any order determined to be the most advantageous combination by the owner. SC 11 Payment Payments shall be in accordance with Article 13, Payments to Contractor and Completion, in Section 00710- General Conditions Contract. All invoices for payment must be submitted on and invoice with an accompanying Application for Payment and updated Schedule of Values (if applicable). Disbursement of money to a person, firm or corporation will be made only after all the various receivable accounts of the general government and any municipal utility or enterprise have been reviewed for outstanding balances owed, and the disbursement will be reduced by setting off the amount of any delinquent indebtedness due the Kodiak Island Borough from such person, firm or corporation. All contracts to which the Kodiak Island Borough is a party which will or may involve the disbursement of Kodiak Island Borough funds shall contain the following clause, or its substantial equivalent: "Disbursement of money by the Kodiak Island Borough hereunder shall subject to set-off pursuant to the provisions of the Kodiak Island Borough Code." SAf r-errf- 2-bz-�M ARPA Priority List Justification �(5 2 `v - C• The Kodiak Island Borough received $2,524,709 of ARPA funds through the State and Local Fiscal Recovery Funds. The first half of the funds were distributed in October 2021 and the second half was delivered in October 2022. Funds were allocated with resolutions Fiscal Year 2022-16, Fiscal Year 2023-09 and Fiscal Year 2023-09A. Those allocations obligated $778,157 of the total funds. As we approached the deadline to obligate these funds, $1,746,553 of the funds remained. To ensure that the funds were obligated before the deadline, staff compiled a list of projects that would be eligible. Those projects were presented to the Assembly for approval and prioritization. After the Assembly discussion, staff was asked to put these items into a recommended priority order. The finance department prioritized the projects with three things in mind. 1) Funding a variety of projects 2) Benefiting a variety of funds and 3) Being mindful of ensuring Kodiak residents see the benefit of all of the allotted funds. As you review the order, you will see that the PFAS-free turnouts for Bayside and Woman's Bay Volunteer Fire Departments are placed at priority #1 and #2. These are both expenses that did not have a funding source dedicated to them before this list was created. By being listed #1 and #2, they will be the first expense items that are covered by these ARPA funds. (These two items will use $171,338 and benefit Fund 250 — Fire Protection Area #1 and Fund 250 Women's Bay Fire Department) The next item on the list is the East Elementary Roof Design. This item is approved via Contract Fiscal Year 2019-10v which is the contract that we have with Jensen Yorba Wall for design services. This is a pre-existing project — Project Number 22004. This use of ARPA money in the amount of $33,377 will benefit the General Fund. Number four on the list is where there was some discussion at the work session last week. The recommended order in the Ordinance has six months of Health Insurance Premiums listed in this position which will cover the expense of $493,492 and will benefit the General Fund, Landfill Enterprise Fund, Bayside Volunteer Fire Department, and KFRC Enterprise Fund. There was a suggestion that number nine on the list and number four on the list be switched to bring the abatement of the buildings previously used as the mental health buildings closer to the top of the list. Staff is still recommending that the list remains as presented in the ordinance. Due to the use of priority order, each project can only be funded when the project listed above it is complete. For example, if the abatement project is moved to number four on the list, then no expenses could be covered on numbers five through twelve until all $1,310,000 on that project is spent. Staff is recommending the items listed from four through eight are prioritized before the abatement project because they are items that have expenses and would need to be reported on April 30°i. If we do not list those project expenses, we will not be able to use any of the ARPA funds on these projects. Listing the projects as recommended is a guaranteed way to spend an additional $839,092 before the abatement project is reached at number 9. Now when we arrive at Number 9 on the list, we will have $907,461 remaining to be assigned to the abatement project and the expenses for numbers 1 through 8 would be covered. The suggested order acts as an insurance policy that protects the borough if something caused the abatement contract to stall or not be finished by the ARPA spend deadline of December 31, 2026. In summary, staff recommends no changes to the list, we do however, request that the word "fud" on line 29 of the ordinance be amended to "fund". At present, there are no water capacity (transmission or flow, treatment and distribution) issues impacting housing growth. However, the City has high levels of inflow and infiltration (I&I) within our sanitary sewer system an( the wastewater treatment plant reports increases in flow during high rain events. The attached spreadsheet compiled b) WWTP provides capacity and I&I information about each of the City's sewer lift stations. One of our main capacity issue: relates to I&I issues caused by the high level of annual precipitation combined with snowmelt runoff and the increase o sewer and gray water flows into the treatment plant. Based on discussions with the PW Director relative to new housing developments, Near Island is the most promising as we only utilize 50% of our capacity. Outside of city limits, Spruc( Cape is at 60% capacity. A study with DOWL Engineering for Natives of Kodiak is underway to examine Spruce Cap( housing expansion. We are working to identify and address I&I issues in Kodiak with the following tasks: o Purchase of an upgraded Centrifuge - $376k (equipment minus installation costs) to increase capacity to address the additional amount of sewage coming into Kodiak's WWTP due to increased or new housing developments. o Continue to work with Stephl Engineering to assist with analyzing I&I in our sanitary sewer collection system. o Place flow meters throughout the City sewer system to get a more accurate picture of sewer lines and man holes needing rehabilitation. o Plan smoke testing and camera viewing of sewer infrastructure to identify areas that require corrective measures o GIS Mapping of entire water & sewer system as a tool for preventative maintenance and to replace critical infrastructure & gauge capacity. o Replace pump at Lift Station 1B (Mill Bay Beach). o Design & construct phase 2 of Lift Station 5 By -Pass (phase I completed this summer). o Infrastructure upgrades at WWTP - Replace hydronic building heating system, electrical upgrades, centrifuge and clarifier upgrades. o Secure funding for infrastructure projects. • Public Works continues to address water production and breaks/leaks. • Working with vendor In -Pipe Technologies regarding the feasibility of installing a micro -hydro turbine at the Monashka Pump House to offset the $30k per month electric bill. Although the start of Woodland Drive has recently had improvements to the ditches and culverts to assist in rain and snow/ice melt, the second half of Woodland Drive experiences ongoing and worsening drainage issues which get progressively worse near the end of the road. Our property at 4043 Woodland Drive has been experiencing worsening and significant drainage issues. The slope of the road and inadequate and complete lack of ditches and culverts help funnel water into our driveway and property. Two steep uphill driveways across the street from drain water and snow/ice melt into our driveway and property. This has resulted in ice buildup on our driveway that at times becomes impossible to drive on, and makes snow removal difficult. This has resulted in often dangerous driveway conditions. Water pooling at the bottom of the driveway at the base of the house has resulted in our basement flooding and the house beginning to shift on its foundation. Action taken so far by property owners: 2022 — Brechan Construction completed a property drain clean out and added drain line, cost approx. $5,000 2022 - Letter written to Kodiak Borough Assembly, issue not addressed 2024 — Brechan Construction completed a pad buffer at the top of the driveway and installed a larger French drain system and yard drainage. Cost $13,990 2022, 2023, 2024 — Multiple repeated conversations with service district representative have consistently resulted in no action being taken. Action requested of the Kodiak Borough: We respectfully request that the Borough take action on Woodland Drive to address drainage issues including an analysis of ditches and culverts, and driveway code adherence. May 19, 2022 To: Kodiak Island Borough, Kodiak Service District 1, Scott Arnt I am the property owner of 4043 Woodland Drive in Kodiak Service District 1. 1 am also a remote property owner in Kizuyak Bay, & in Afognak Bay. I pay my property taxes every year and have for around 20 years. The two remote properties I receive no service from the borough. My property and residence on Woodland Dr receives minimal road service, on a dirt road with a popular local trail at the end of the street. I currently have an issue with drainage from the road at the top of the driveway due to the two driveways up the hill from my driveway. Water from the neighboring properties uphill driveways run and drain across the road, all the way down my drive way. In the winter, this creates a dangerous sheet of ice on my downhill driveway, often making it difficult or impossible to drive up or down with four-wheel drive vehicles. This situation also makes snow removal in my driveway challenging. My driveway was impossible to use several times this winter due to the upland driveways draining into my driveway. During rainy times, sheets of water run down my driveway creating massive puddles of water at the base of my house that take days to drain. Earlier this spring, the crawl space of my house started flooding as a result of the volume of water coming down my driveway. am currently having new drainage installed around my house to help with the massive amount of water that collects at the base of my house. This is a costly and time consuming effort, and will not solve the issue created in the winter with the icing of my driveway, and won't keep up with the drainage during times of high rain. As I am responsible for my property as the property owner, I am respectfully asking that the Kodiak Island Borough/Service district 1 Road Maintenance please address the drainage issue on the road near the 4000 block of Woodland Drive to alleviate the dangerous conditions created by the upland driveway drainage. As a property owner in the Kodiak Island Borough it would be a nice to see my property tax money address the issue that is on Kodiak Island Borough land. This road is not only important to myself as a homeowner, but also to the many that walk and drive the road to access the public trail.
