Box 2842 Kodiak, Alaska 99615 Kodiak Island Borough Board Of Equalization Appeal No. 2020-066, Property ID # 20127 Dear Ms. Petrich, The Kodiak Island Board of Equalization met in public on May 18, 2020 and heard your appeal in the above referenced case. The meeting was properly noticed and convened in accordance with the law, and a quorum was present throughout. The Board heard from the Appellant and from the Assessor and considered the evidence and arguments. I hereby certify that the Board Of Equalization, pursuant to KIBC 3.35.050, considered the arguments and evidence presented and adopted the following motion: Motion by Ms. Laird, Second by Mr. Anderson. "I move to uphold the Assessor's evaluation for property 2020-066. The Board adopted the following findings and conclusions: 1. The appellant failed to provide adequate evidence to support unequal, excessive, or unfair valuation. 2. The appellant failed to provide specific proof that the closing of the cannery and the closing of the school had a negative economic impact for this period. 3. The assessor was able to confirm to us that the residential properties in the neighborhood were all assessed fairly. 4. The appellant presented arguments disputing the lot size and various plat documents which failed to provide clarity to the Board. The BOE determined it is not the role of the BOE to determine if the plat is correct or resolve disputes about the legal size of the lot. The Board then adopted its decision by a vote of 5-0. This motion was adopted by the vote of a legally sufficient number of votes, and all other requirements and proceedings incident to the proper adoption of the motion were carried out or otherwise observed. This constitutes the final administrative decision on this appeal. According to Appellate Rule 602 and KIBC 3.35.050(F), the Appellant or the Assessor has the right to appeal to the Superior Court of the State of Alaska from this final decision. Should you wish to exercise your right to appeal, you must do so within 30 days and notify the Borough Attorney within 30 days of the date of distribution of this decision. Failure to do so will forever bar you from any appeal of this decision.
