2024-10-17 Regular MeetingKODIAK ISLAND BOROUGH Assembly Regular Meeting October 17, 2024 A regular meeting of the Kodiak Island Borough Assembly was held on October 17, 2024, in the Assembly Chambers. The meeting was called to order at 6:30 p.m. Staff present were Assessing Director Seema Garoutte, Borough Manager Aimee Williams, Borough Clerk Nova M. Javier, and Assistant Clerk Irene Arellano. 1. INVOCATION Cadet Joe Duran of the Salvation Army gave the invocation. 2. PLEDGE OF ALLEGIANCE Mayor Arndt led the pledge of allegiance. 3. STATEMENT OF LAND ACKNOWLEDGEMENT We are gathered on the traditional homeland of the Sugpiaq(Alutiiq people, and we acknowledge the 10 tribes of the Kodiak Alutiiq Region. We recognize the Alutiiq culture that enriches our community to this day. 4. ROLL CALL Present were Mayor Scott Arndt, Assembly Members Jared Griffin, Ryan Sharratt, Scott Smiley, and Bo Whiteside. SMILEY moved to excuse Assembly member Ames who was absent due to personal leave and Assembly member LeDoux who was absent due to medical reasons. ROLL CALL VOTE ON THE MOTION FAILED TWO TO TWO: Griffin and Whiteside (NOES); Smiley and Sharratt (AYES). 5. APPROVAL OF AGENDA AND CONSENT AGENDA SMILEY moved to approve the agenda and consent agenda. VOICE VOTE ON THE MOTION CARRIED UNANIMOUSLY. 6. *APPROVAL OF MINUTES (Approved under consent agenda) A. BOROUGH MANAGER'S REPORT Borough Manager Williams provided a manager's report, and it was included in the meeting packet. 12. MESSAGES FROM THE BOROUGH MAYOR Mayor Arndt encouraged the community to go out and vote during the absentee in - person voting or to cast their votes in the general election on November 5. 13. CONSIDERATION OF CALENDAR - UNFINISHED BUSINESS A. Contract No. FY2019-25B, Amendment #2, With Waste Connections Of Alaska, Inc. DBA Alaska Waste For Residential And Commercial Solid Waste Collection And Recycling Services The motion on the floor was "move to authorize the Borough Manager to execute Contract No. FY2019-25B, Amendment #2, With Waste Connections Of Alaska, Inc. DBA Alaska Waste For Residential And Commercial Solid Waste Collection And Recycling Services'. SMILEY moved to postpone indefinitely Contract No. FY2019-2513, Amendment #2, With Waste Connections Of Alaska, Inc. DBA Alaska Waste For Residential And Commercial Solid Waste Collection And Recycling Services. SMILEY moved to authorize the Borough Manager to execute Amendment No. 2 to Contract No. FY2019-22B for Professional Legal Services with Keene & Currall, P.P.C. ROLL CALL VOTE ON THE MOTION CARRIED UNANIMOUSLY: Whiteside, Griffin, Sharratt, and Smiley. 14.B. RESOLUTIONS 1. Resolution No. FY2025-09, Ratifying And Certifying The Results Of The October 1, 2024, Regular Municipal Election SMILEY moved to adopt Resolution No. FY2025-09. ROLL CALL VOTE ON THE MOTION CARRIED UNANIMOUSLY: Griffin, Sharratt, Smiley, and Whiteside. 14.C. ORDINANCES FOR INTRODUCTION 1. Ordinance No. FY2025-08, An Ordinance Of The Kodiak Island Borough Accepting And Appropriating Grant Funds For The 2020/2021 Statewide Salmon Disaster SMILEY moved to advance Ordinance No. FY2025-08 to public hearing at the next regular meeting of the Assembly. ROLL CALL VOTE ON THE MOTION CARRIED UNANIMOUSLY: Sharratt, Smiley, Whiteside, and Griffin. 14.D. OTHER ITEMS 1. Administration Of Oath Of Office To Newly Elected Officials Borough Clerk Nova M. Javier administered the Oath of Office to newly elected Assembly member Scott Smiley. I2. Presentation To Outgoing Assembly Member James Turner l_. ASSEMBLY MEMBERS' COMMENTS Assembly member Griffin, drawing inspiration from the Parable of the Good Samaritan, expressed his thoughts on fostering neighborliness amid the heightened tensions of the Presidential election. Assembly Member Whiteside announced the upcoming Kodiak Island Borough and City of Kodiak Joint Kodiak Fisheries Workgroup meeting on Wednesday, October 23, at noon in the City Conference room. He emphasized the importance of community input when making their decisions on how to allocate resources to effectively support the fishing industry. Assembly Member Smiley expressed his gratitude to everyone who voted for him, emphasizing his commitment to serving the best interests of the entire community. He recognized the staff for providing the necessary information that helps the Assembly in making informed decisions, as well as everyone who comes and speak during citizen comments. Additionally, he thanked the Assembly for their ongoing support throughout the years and shared his intention to step down from the Deputy Presiding Officer position. Assembly Member Sharratt admired Assembly member Griffin's deep comments and echoed Assembly member Smiley's remarks. He emphasized the importance of citizen's feedback, noting that it helps them understand different perspectives. He also complimented the Borough Manager Aimee Williams for her professional execution of her duties. He highlighted the importance of asking tough questions and seeking clarification when the community raises concerns, or questions related to contracts, committees, and service districts, as these issues are under the Assembly's responsibility. He pointed out that he chooses to be neighborly to those who might not speak up as much. He thanked the Assembly members for their efforts and during these challenging times in the United States, he urged everyone to foster a spirit of neighborliness. 17. EXECUTIVE SESSION A. Discussion Of Potential/Pending Litigation On KANA Marketplace Property Tax SMILEY moved to convene into executive session under the authority of KIBC. 2.30.030 (F)(1)(a) to discuss pending litigation to which the Borough is a party and to provide direction to the Borough Manager regarding that litigation. After the vote, Mayor Arndt recessed the regular meeting at 7:41 p.m. and convened the executive session at 7:42 p.m. Upon returning from the executive session, Mayor Arndt reconvened the regular meeting at 8:07 p.m. and announced that direction was given to the Borough Manager on how to proceed. 18.
