Assembly Regular Meeting
July 18, 2024
A regular meeting of the Kodiak Island Borough Assembly was held on July 18, 2024, in the
Assembly Chambers. The meeting was called to order at 6:30 p.m. Staff present were Borough
Manager Aimee Williams, Engineering and Facilities Director Dave Conrad, Borough Clerk
Nova M. Javier, and Assistant Clerk Irene Arellano.
INVOCATION
The invocation was given by Major Dave Davis of the Salvation Army.
2. PLEDGE OF ALLEGIANCE
Mayor Arndt led the pledge of allegiance.
3. STATEMENT OF LAND ACKNOWLEDGEMENT

Regular Municipal Election starts on August V, 2024. He urged everyone to run
for a seat.
• Assembly Member Whiteside thanked Bayside Fire Department Chief Ellis and
his crew for hosting a fire extinguisher training for biologists, and he also
expressed his gratitude for their service.
• Assembly Member LeDoux thanked the Borough Manager for the thoroughness
of the manager's report that provides valuable information to both the assembly
and the public.
• The rest of the Assembly Members had no comment.

Manager's Department
Popular Annual Financial Report (PAFR) —
Each year finance submits the PAFR to the Government Finance Officers Association
(GFOA). For the year ending June 30, 2023, the Kodiak Island Borough has given an
award that is based on the information presented, reader appeal, understandability,
distribution, and other elements (such as whether the PAFR is a notable achievement
for the government given the government's type and size, and the PAFR's creativity and
usefulness). Congrats to the Finance Department.
Congressional Delegated Spending — Received word from Senator Murkowski's
office today that our hospital expansion project did not get funded this year. I spoke
with our federal lobbyist and spoke about how to make our project request stronger for
the next cycle.
Alaska Municipal League -
• The Summer Legislative Conference is being held in Kodiak this year. Both the
Alaska Municipal Manager's Association and the Alaska Conference of Mayors
have meetings on August 13th and then the main conference starts on August
14th and goes into August 15th. Registration for the session is now open at
https://www.akml.org/conferences-events/summerconference/
Kodiak Area Leadership Institute (KALI) —
On behalf of KALI, Dorinda Kewan reached out to invite the KIB Assembly to a lunch
and the regional government session that will tentatively be held during the morning on
Thursday, September 12tH
There are several topics that have been identified that KALI is interested in reviewing
with Kodiak Island Borough including the Capital Improvement Project process and the

Hazard Mitigation Plan update. This would be followed by updates from Senator
Stevens and Representative Stutes.
If four or more Assembly members want to attend, KALI is willing to put a "Notice of
Public Meeting" onto their agenda if it is necessary to do so. Please let me know if you
are interested in attending the Fall Forum for this session.

Multi -Jurisdiction Multi -Hazard Mitigation Plan Update —
The first draft of the update Hazard Mitigation Plan will be posted on Friday, August 2,
2024, on the borough website at https://tinyuri.com/2024kibhm, the document will be
posted for comments until September 6, 2024.
Hazard Mitigation Advanced Assistance Grant for Hydrology Study —
The request for proposals closes on August 2, 2024. Six consulting firms have
submitted intents to propose.
Assessing Department
Field Work —
Assessing staff will be doing in-person field inspections in Monashka, Bells Flats,
Chiniak, and Pasagshak. The second round of postcards are due to be mailed on
August 15.

SC/DV exemptions —
Fifteen applicants remain to be determined by the PFD and will be processed when the
information becomes available.
Exemptions —
• Assessing is working on an exemption application for New Valaam Monastery /
St. Micheals Skete that was timely filed but was incomplete. Assessing has
received the paperwork necessary to begin processing the application.
• Four other exemption applications were received by the Jan. 15 deadline for
2024. The Assessing Department has completed all of them. One of the
applicants has asked for a reconsideration and three have passed their appeal
periods.

• One agricultural deferment exemption was applied for by the May 15 deadline
but was returned for an incomplete application. The applicant has not provided
requested information to date.
Engineering and Facilities
Architect Visit —
Mr. Corey Wall and David From are scheduled to be in Kodiak August 14 — 16tH
Meetings are scheduled for the review and consultation for the final Medical Facilities
Space Analysis. Final presentation is anticipated in September 2024.
Women's Bay Playground —
Play equipment is on island. There is an intent to award issued for installation. There
was only one submission for installation. The contract will be before the assembly on
August 15, 2204. Site walk through will be performed after award is completed.
Saltery Cove Trail Improvement —
Finance staff is continuing process billing for the project working with ADF&G and ITN.
There will be extra funds left in that grant and so there will be a discussion regarding
possible additional work. Survey work is anticipated for September 2024.
KFRC —
• Cost associated with the GSA Lease Amendment Water Sampling has been
provided to GSA for approval. The cost is above the allotted amount due to the
quantity of faucets requiring testing and air freight to ensure hold times are met.
• Awaiting the follow up reports from the General Services Administration (GSA)
representatives specific to the building's fire alarms and sprinkler systems.
• Discussions have been held with the General Services Administration (GSA)
Awaiting feedback from GSA regarding decontamination system replacement.
HFAB — Hospital Facilities Advisory Board —
Awaiting design information from Providence for sterilization, steam generation, transfer
switches, etc.
Health Facilities Space Evaluation —
First draft of the Phase 1 report has been provided to staff for review. Architects are
scheduled to be in Kodiak August 14th through 16th. PKIMC , KCHC and KIB
representatives and will meet to discuss the draft and discuss the finalized version for
formal presentation by the end of September.
Old Mental Health Facility —

Requesting a work session agenda item to discuss policy decisions of the future of
these buildings.
Landfill —
• ADEC Solid Waste Inspection in the middle of September.
• Staff is continuing to investigate the Compliance Order by Consent (COBC)
associated with the storm water violations.
• Concrete floor ware section bid has been advertised.
• A Fall Commercial Hazardous Waste Event is scheduled for October 1St and 2nd
This event will target commercial entities for collection and disposal for
hazardous materials.
KIBSD —
Petersen Roof —
Job is progressing. The PVC membrane has been installed and the entire
roof is watertight. Substantial completion has been achieved. Metal siding
and coping is to be installed as materials arrive on site. Exterior Insulation
Finishing System (EFIS) has been discovered to contain significant rotten
wood components. This exterior finish will be waterproofed with flashed to
stabilize the assemblies and evaluated for a future project. Job site is
being inspected several times per day by E/F Staff.
Damage has been found associated with the fire alarm system. Conduits
and conductors were penetrated and compromised by the installation of
roofing screws. Water penetration has compromised detector devices.
Contractor has hired and electrician and fire alarm contractor to effect
repairs. Electrical conduit and conductor replacement has started 7/24.
The fire alarm system has been taken offline except for the sprinkler
alarms due to multiple callouts. Both the City of Kodiak Fire Chief and
Coast Guard Fire have been briefed and concur with the status. Daily
updates are being provided to each department. This is a priority repair
and will continue to be inspected and monitored each day. The KIBSD
Staff and Superintendent have been notified and toured the facility on
7/24.
East Elementary —
• Sink hole has been excavated. Large logs and woody debris have been
found withing two to three feet of the paved surface. This information
needs to be retained for the future for any paving project. Anticipate
additional potential settling on the section of parking area as the wood
fiber continues to break down. Water was seen in the excavation which
added to the creation of the initial sink hole. Excavation has been filled

with drain rock and will be capped with D1. Asphalt will be patched when it
becomes available.
Leachate Treatment Plant —
Staff continues to process as much leachate as the plant will allow to reduce the stored
quantity.
• Site inspection held today with the staff providing a punch list for completion.
Anticipate contractor to return to the site at the beginning of September to
complete final work. Awaiting final shipping dates for the new pump / impeller
configuration.
• An offer has been made for the Operator Trainee Position. Pending applicant
finding housing prior to acceptance.
Finance Department
Annual Audit —
Final audit will be completed in September.
Property Taxes —
2024 tax bills are out — if you did not get one, please contact the finance
department. For those opting to pay two half payments, the first payment is due August
15th. If making the single payment, or have missed the August 15th date, the total due
must be paid by October 15th to avoid penalties and interest.
Property Assessment and Taxation Implementation Project —
Staff is continuing to meet regularly with Tyler and are in the process of creating a test
environment. Prior to moving data to the new environment, we will be working on data
cleanup and verification. Current go -live date is June 25, 2025.
Digital Budget Project —
Staff has begun the implementation of a digital budget book. This will be effective for
the FY2025 budget.
Staffing —
We are still advertising for a general accountant position.
IT Department
Security Audit —
Audit proposal winner has been picked, prepping notices and contract for approval
Power Outage Protocol —
Implementing a KVM to aid this process
Business Continuity and Disaster Recovery —

Reviewing Email retention policy for KIB implementation.
Network Management -
Identifying current network cabling for an updated logical network diagram.

• Working on cybersecurity policies for KIB
• Reviewing and testing SIEM and Endpoint Security software for a fit with Kodiak
Island Borough.
Hardware —
Refreshing twenty-two laptops for Borough employees and Assembly Members —
Assembly laptops are being configured for deployment.
Software -
GIS —
• Upgrading our backup systems
• Updating our Win911 systems
• Updating our Rockwell LTP monitoring systems and hardware
• Bells Flats and Spruce Cape trail have been scanned for Google Street View
• Assessing has tasked GIS with reviewing — 7800 property records for
accuracy and updating our GIS data. 300 records left to update.

RECOMMENDATION:
Move to adopt Resolution No. FY2023-03C.
DISCUSSION:
The Borough Clerks office along with the Borough Manager, Assessing Director, and
Community Development Director have determined the need to revise the various retention
series to comply with and consider recent and existing laws and regulations, reflect industry
best practices, and to meet the present needs of the Borough as a whole.
The revisions to the current retention schedule for Assessing, Community Development, and
contracts in the Clerk's Office set out in this resolution are limited to said departments. The
remaining categories of records will keep the same retention schedule until changed by a
future resolution.
These changes were reviewed by the Borough Attorney and are reflected in the attached
Exhibits A, B, and C.

VARIOUS SECTIONS OF THE KODIAK ISLAND BOROUGH RECORDS RETENTION
SCHEDULE AND CENTRAL FILING SYSTEM TO REFLECT AMENDMENTS TO THE
ASSESSING DEPARTMENT, COMMUNITY DEVELOPMENT DEPARTMENT, AND
CONTRACTS RECORDS SERIES IN THE CLERK'S OFFICE
WHEREAS, Kodiak Island Borough Code 2.40.120 provides for a records management,
program creation and administration, and approval of the Records Retention Schedule by
resolution; and
WHEREAS, staff determined the need to revise the current RRS to comply with and consider
recent and existing laws and regulations, reflect industry best practices, and to meet the present
needs of the Borough; and
WHEREAS, the Borough Deputy Clerk, serving as the records administrator, consulted with the
Borough Manager, Borough Clerk, Assessing Director, Community Development Director, and
the Borough Attorney to finalize the proposed amendments to various departments records
series; and
WHEREAS, the Assembly finds that it is in the best interest of the Kodiak Island Borough to
amend the RRS to reflect changes in the Assessing Department, Community Development, and
Borough Clerk's Contracts records series.
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH that the Borough Assembly adopts and incorporates Exhibits A, B, and C which
reflect revisions to the Assessing Department, Community Development, and Borough Clerk's
Contracts records series. The remainder of the Borough Records Retention Schedule remains
unchanged.

DISCUSSION:
Kodiak was designated as an eligible crab community (ECC) and in connection with such
designation, the Kodiak Island Borough and the City of Kodiak have the authority to jointly
exercise certain rights of first refusal (ROFR) with respect to processor quota shares (PQS)
allocated under the Program. The City of Kodiak and the Kodiak Island Borough have jointly
designated the Kodiak Fisheries Development Association (KFDA) as the region's Eligible
Crab Community Entity (ECCE) having the authority to do so on their behalf.
The Kodiak Fisheries Development Association is composed of seven (7) Directors. Two
seats are City appointees, two are Borough appointees, and the remaining three are jointly
appointed by the Borough and the City. The bylaws of the Kodiak Fisheries Development
Association (KFDA) state, in part, that Directors shall serve for three-year terms and until their
successors are appointed and qualified.
The terms for the two Borough Appointees expired in July, and the Clerk's Office has
contacted Mr. Bonney and Mr. Bongen. Mr. Bonney has not submitted an application, but he
has indicated his desire to remain on the board for another three years. Mr. Bongen has
stated that he is unable to continue serving on the Board.
The Borough advertised both of these positions in the Kodiak Daily Mirror, and no other
applications were received.

A RESOLUTION OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH
DESIGNATING THE "KODIAK FISHERIES DEVELOPMENT ASSOCIATION" AS
KODIAK'S "ELIGIBLE CRAB COMMUNITY ENTITY" IN CONNECTION WITH THE BERING
SEA/ALEUTIAN ISLANDS CRAB RATIONALIZATION PROGRAM
WHEREAS, the North Pacific Fishery Management Council has adopted the Bering Sea /Aleutian
Islands crab rationalization program (the "Program") as Amendments 18 and 19 to the Fishery
Management Plan for Bering Sea/Aleutian Islands King and Tanner Crabs; and
WHEREAS, Congress amended the Magnuson -Stevens Fishery Conservation and Management
Act to require the Secretary of Commerce to approve and implement the Program; and
WHEREAS, the National Marine Fisheries Service issued a Final Rule implementing the Program
on March 2, 2005, that takes effect on April 1, 2005; and
WHEREAS, under the Program, Kodiak is designated an "Eligible Crab Community Entity" (ECCE),
and in connection with such designation, the City of Kodiak and the Kodiak Island Borough have
the authority to jointly exercise certain Rights of First Refusal (ROFR) with respect to Processor
Quota Shares (POS) allocated to entities in Kodiak and certain communities in the Northern Gulf
of Alaska, upon a proposed transfer of such POS for use in processing outside of the community
within which it is initially allocated; and
WHEREAS, to exercise their ECCE ROFR, the City of Kodiak and the Kodiak Island Borough must
jointly designate an entity (an ECCE) having the authority to do so on their behalf at least thirty
(30) days prior to the ending date of the initial application period for crab quota shares under the
Program; and
WHEREAS, the Kodiak Island Borough Assembly has determined that it is in the Borough's best
interests to designate an entity having the authority to exercise Kodiak's ROFR;
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH
that the "Kodiak Fisheries Development Association" (the "Association") is hereby designated as
Kodiak's ECCE, to represent the Kodiak Island Borough in connection with exercise of Kodiak's
ROFR under the Program; and
BE IT FURTHER RESOLVED THAT the Articles of Incorporation and Bylaws of the Association are
hereby approved, and that the incorporators of the Association identified in the attached Articles
of Incorporation are hereby authorized to incorporate the Association under the laws of the State
of Alaska, and to take such actions as may be necessary or convenient to cause the Association
to be qualified by the National Marine Fisheries Service as the Kodiak's ECCE.

cannot be provided through the ordinary governmental budget; and

through the utilization of volunteers; and
WHEREAS, these organizations provide services that fit within the adopted powers of the
Kodiak Island Borough; and
WHEREAS, these organizations have submitted applications requesting funds; and

RECOMMENDATION:
Move to advance Ordinance No. FY2025-04 to public hearing at the next regular meeting of
the Assembly.
DISCUSSION:
The existing disposal procedures outlined in the Borough code and the Records Retention
Schedule (RRS) do not currently include a provision for the manager or department directors
to retain records beyond their designated retention periods. Following collaboration between
the Clerk's Office staff, the Manager, and the Borough attorney, proposed revisions to
Sections 2.40.150 and 2.40.160 have been recommended to allow for the possibility, under
valid circumstances, of extending the retention period for records which have administrative
value by an additional five years. Any extensions exceeding the initial five-year period would
require approval from both the manager and clerk. This proposed change is in the best
interests of the Borough.

AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH AMENDING
KODIAK ISLAND BOROUGH CODE TITLE 2 ADMINISTRATION AND PERSONNEL,
CHAPTER 2.40 RECORDS MANAGEMENT, SECTIONS 2.40.150 AND 2.40.160 TO ALLOW
EXEMPTIONS FOR THE DISPOSAL OF RECORDS THAT HAVE ADMINISTRATIVE VALUE
WHEREAS, KIBC Section 2.40.160 prescribes the process for review and disposal of records
at the end of their respective retention periods; and
WHEREAS, neither the disposal process in KIBC Section 2.40.160, nor the records retention
schedule, currently provide a process for the manager or a department director to decide to retain
a record beyond the end of its retention period; and
WHEREAS, the Manager and Clerk recommend that language be included under KIBC
2.40.160 for an opportunity for the manager or a department director to elect, for valid reasons as
determined in their discretion, to retain a record scheduled for disposal for an additional period of
up to five years before being reviewed again for disposal; and
WHEREAS, the Assembly finds that providing the manager and department directors the
opportunity to choose to retain particular records for a limited period beyond the normal disposal
date is in the Borough's best interests.
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH that:
Section 1: This ordinance is of a general and permanent nature and shall become a part of the
Kodiak Island Borough Code of Ordinances.
Section 2: Title 2 Administration and personnel, Chapter 2.40 Records Management, Section
2.40.150 Noncurrent Records Not To Be Maintained In Office Files to read as
follows:
Records no longer required in the conduct of current business by any office of the borough shall
be promptly transferred to the records center at the time such action is designated on an approved
records retention schedule. Such records shall not be maintained in current office files or
equipment. The manager and department directors may request that a record transferred
to the records center be held up to five years longer than the period provided for in the
records retention schedule if the manager or department director identifies a borough
administrative purpose lustifVing a longer retention period for a record which is no longer
needed for conduct of current business.

A. The clerk shall dispose of borough records if the following requirements are met:
1. The time for retention of the records under the approved retention schedule has elapsed

administrative, or financial value, and are not required to be retained for any other
purposes; and
3. The clerk has provided the list of records eligible for disposal to the manager and

4. The borough attorney determined that the records do not need to be retained for a longer
period for purposes of any pending or threatened litigation or other legal purposes.
B. The manager and department directors may choose to, at their discretion and for
identified borough administrative purposes, exempt a record scheduled for disposal
for an additional period of up to five years before it is re-evaluated for disposal. Any
extension beyond an initial extension period of up to five years must be approved by
the manager and clerk. A record retention extension form must be filled out to justify
the exemption before a record is removed from the disposal list.
C. The clerk shall dispose of records eligible for disposal by destruction, by returning it to the
original owner, or by any other means deemed appropriate based upon the records. Records
eligible for disposal which are of a confidential nature shall be disposed of by means
determined to be appropriate by the clerk which does not compromise their confidential
nature.
D. The clerk shall provide a report to the borough assembly including a description of all records
that are scheduled to be disposed and of obsolete records disposed during the preceding
year. The clerk shall maintain a permanent 1^^ documentation of all records which have been
destroyed.
Effective Date: This ordinance takes effect upon adoption.

Place License Renewal Application For Sizzler Burger And Peking Restaurant

RECOMMENDATION:
Move that the Kodiak Island Borough Assembly object to the renewal of Restaurant and
Eating Place license #2611 for the reasons identified in the Clerk's investigation and directs
the Clerk to advise the Alcoholic Beverage Control Board of the objection.
DISCUSSION:
On June 11, 2024, the Clerk's Office received the renewal notice for License #2611 Sizzler
Burger & Peking Restaurant. Pursuant to KIBC 5.01.020 the Clerk's Office investigated and
has been advised that circumstances relating to the license renewal application support an
objection by the governing body in order to protect the Borough's interests. Specifically, the
Borough has an interest in licensed premises having proper building permits and zoning, and
an interest in the information set out in the license application being accurate and complete.
Those interests are adversely impacted and need to be protected due to the absence of the
correct business address on the application and the apparent lack of operations or permitting
for work on the premises.
The following particular concerns/interests were brought up from the Clerk's investigation:
Community Development Department
• A correct business address on the license renewal application hinders the Community
Development department from determining if the restaurant's use complies with
zoning regulations, specifically KIBC 17.15.020 Conformity with regulation required
and KIBC 17.15.060 Zoning compliance.
Fire Marshall
There is a need to conduct a fire and life safety inspection before he can recommend
approval.
Building Official
• The business location has been gutted by the building owner without any permits.
There is a belief that the business has not been in operation for two years.
Included in the packet is information from the City of Kodiak meeting packet for their July 25,
2024. The City Council will be considering a resolution protesting, subject to rescission, the
renewal of Restaurant or Eating Place License No. 2611.

1. Issue a letter of protest.
2. Issue a letter of non -protest.

OTHER INFORMATION:
Per AS 04.11.480, a local governing body may protest the renewal by sending the AMCO
director and the applicant a protest and the reason for the protest in a clear and concise
statement within 60 days of the date of the notice of filing of the application. The Borough
must also provide evidence of proof of service upon the applicant and proof that the applicant
has had the opportunity to defend the application before the local governing body's meeting.
In addition to Alaska Statutes 04.11.480, regulations in 3 AAC 305.085 states the local

Dear Ms. Yun,
This letter is to inform you that the review of Liquor License # 2611 renewal application for Sizzler
Burger and Peking Restaurant is scheduled to be heard by the Kodiak Island Borough Assembly on
August 1, 2024. The meeting will start at 6:30 p.m. in the Borough Assembly Chambers at 710 Mill
Bay Road, Kodiak.
According to Alaska Statutes 04.11.480, and regulations in 3 AAC 305.085, the local governing body
has the authority to protest renewal of a liquor license for public policy reasons or due to license -
related issues. Pursuant to KIBC 5.01.020 the Clerk's Office investigated and has been advised that
circumstances relating to the license renewal application support an objection by the governing body
in order to protect the Borough's interests. Specifically, the Borough has an interest in licensed
premises having proper building permits and zoning, and an interest in the information set out in the
license application being accurate and complete. Those interests are adversely impacted and need
to be protected due to the absence of the correct business address on the application and the
apparent lack of operations or permitting for work on the premises. The following particular
concerns/interests were brought up:

Development department from determining if the restaurant's use complies with zoning
regulations, specifically KIBC 17.15.020 Conformity with regulation required and KIBC
17.15.060 Zoning compliance.

• The business location has been gutted by the building owner without any permits. There is a
belief that the business has not been in operation for two years.
3 AAC 305.085(d) calls for a local governing body to provide an applicant with a reasonable
opportunity to defend the application before a meeting of the local governing body. This opportunity
is now scheduled for the August 1, 2024, regular Assembly meeting. We encourage you to attend the
August 1, 2024, regular meeting. You will be given opportunity to provide comments regarding the
liquor license renewal application at this meeting.

Upon inspection the property known as 116 W Rezanof Drive use has changed, and is no longer a
restaurant.
The owner of the building is renovating without permit. The owner of the liquor license states that all
her equipment is in storage.
Assessing has two accounts. One account for Mrs. Kim's business personal property and one for the
owner of the building, who's address is NOT the address on the business personal property account. .
Upon discussion with GIS, Assessing has been informed that the address that we have on the business
personal property account is not right and therefore, incorrect on the application, though Assessing has
determined that this is not Ms. Kim's fault.
While Assessing has contacted GIS for address changes/verification, contact with Ms. Kim verified that
her equipment is no longer at the property nor is the restaurant operating at this time.
Assessing would ask that the renewal application be updated with corrected information to be able to
decide if a protest is warranted.

applicant. The restaurant does not currently operate at the property listed on the application. The
applicant told our staff that they no longer have a lease at the location listed on the application.

5.01.020 License renewal procedure.
A. Upon receipt of notice from the Alcoholic Beverage Control Board of the board's receipt of
intent to approve the renewal of a new liquor license:
1. The clerk shall investigate to determine if the borough has an interest which can be protected
by protesting the approval of the application for renewal; and
2. The clerk shall check with the state troopers on the number of trouble reports at the place of
business.
B. If the clerk determines that the borough has no interest in protesting the renewal, the clerk
shall advise the Alcoholic Beverage Control Board of continued nonobjection to renewal in writing.
If it is determined that the renewal could be protested based on unpaid taxes or trouble reports, it
shall be scheduled for review by the borough assembly.
AS 04.11.330. Denial of License or Permit Renewal.
(a) [See delayed amendment note] An application requesting renewal of a license shall be denied
if
(1) the board finds, after review of all relevant information, that renewal of the license would not
be in the best interests of the public;
(2) the license has been revoked for any cause;
(3) the applicant has not operated the licensed premises for at least 30 eight-hour days during
each of the two preceding calendar years, unless the board determines that the licensed premises
are under construction or cannot be operated through no fault of the applicant;
(4) the board finds that issuance of an existing license underAS 04.11.400(d) has not encouraged
tourist trade;
(5) the requirements of AS 04.11.420 - 04.11.450 relating to zoning, ownership of the license, and
financing of the licensee have not been met;
(6) renewal of the license would violate the restrictions pertaining to the particular license under
this title or the license has been operated in violation of a condition or restriction imposed by the
board;
(7) renewal of the license is prohibited under this title as a result of an election conducted under
AS 04.11.507 ;
(8) the application has not been completed in accordance with AS 04.11.270
(b) [See delayed amendment note] An application for renewal of a license may be denied if the
applicant is delinquent in the payment of taxes if the tax liability arises in whole or in part out of
the licensed business.
(c) An application requesting renewal of a conditional contractor's permit shall be denied if

(1) the board finds, after review of all relevant information, that issuance of the permit would not
be in the best interests of the public;
(2) the application has not been completed in accordance with AS 04.11.270.
(d) [See delayed amendment note] Notwithstanding (a)(3) of this section, a recreational site
license issued under AS 04.11.210 may be renewed if the license was exercised at least once
during each of the two preceding calendar years.
(e) [Effective January 1, 2024] The requirements of (a)(3), (5), and (7) of this section do not apply
to a manufacturer direct shipment license issued under AS 04.09.370
AS 04.11.480. Protest.
(a) [See delayed amendment note] A local governing body may protest the issuance, renewal,
relocation, or transfer to another person of a license by sending the board and the applicant a
protest and the reasons for the protest within 60 days of receipt from the board of notice of filing
of the application. A protest received after the 60 -day period may not be accepted by the board,
and in no event may a protest cause the board to reconsider an approved renewal, relocation, or
transfer. The local governing body may protest the continued operation of a license during the
second year of the biennial license period by sending the board and the licensee a protest and
the reasons for the protest by January 31 of the second year of the license. The procedures for
action on a protest of continued operation of a license are the same as the procedures for action
on a protest of a renewal application. The board shall consider a protest and testimony received
at a hearing conducted under AS 04.11.510(b)(2) or (4) when it considers the application or
continued operation, and the protest and the record of the hearing conducted under
AS 04.11.510 (b)(2) or (4) shall be kept as part of the board's permanent record of its review. If
an application or continued operation is protested, the board shall deny the application or
continued operation unless the board finds that the protest is arbitrary, capricious, and
unreasonable.
(b) [See delayed amendment note] If the permanent residents residing outside of but within two
miles of an incorporated city or an established village wish to protest the issuance, renewal, or
transfer of a license within the city or village, they shall file with the board a petition meeting the
requirements of AS 04.11.510 (b)(3) requesting a public hearing within 30 days of the posting of
notice required under AS 04.11.310 , or by December 31 of the year application is made for
renewal of a license. The board shall consider testimony received at a hearing conducted under
AS 04.11.510 (b)(3) when it considers the application, and the record of a hearing conducted
under AS 04.11.510 (b)(3) shall be retained as part of the board's permanent record of its review
of the application.
(c) [See delayed amendment note] A local governing body may recommend that a license be
issued, renewed, relocated, or transferred with conditions. The board shall consider
recommended conditions and testimony received at a hearing conducted under
AS 04.11.510 (b)(2) or (4) when it considers the application or continued operation, and the
recommended conditions and the record of the hearing conducted under AS 04.11.510 (b)(2) or
(4) shall be kept as part of the board's permanent record of its review. If the local governing body
recommends conditions, the board shall impose the recommended conditions unless the board
finds that the recommended conditions are arbitrary, capricious, or unreasonable. If a condition
recommended by a local governing body is imposed on a licensee, the local governing body shall

assume responsibility for monitoring compliance with the condition, except as otherwise provided
by the board.
(d) In addition to the right to protest under (a) of this section, a local governing body may notify
the board that the local governing body has determined that a licensee has violated a provision
of this title or a condition imposed on the licensee by the board. Unless the board finds that the
local governing body's determination is arbitrary, capricious, or unreasonable, the board shall
prepare the determination as an accusation against the licensee under AS 44.62.360 and conduct
proceedings to resolve the matter as described under AS 04.11.510 (c).
(e) [Effective January 1, 2024] If the location or proposed location of a license is within the
boundaries of more than one local government, each local governing body may protest the
issuance, renewal, relocation, or transfer of a license.

SUMMARY AND DISCUSSION:
The City of Kodiak is in receipt of a Restaurant or Eating Place License (REPL) application for renewal no.
2611 from the Alcohol Beverage Control Board for Sizzler Burger & Peking Restaurant. A local governing
body may protest the approval of an application pursuant to AS 04.11.480 with clear and concise reason for
protest within 60 days of receipt of the notice and allowing the applicant an opportunity to defend the
application.
The City Clerk received the renewal and sent inquiry to the Fire Marshal, Finance Director, Chief of Police, and
Building Official to review the license and ensure the establishment was in compliance with Kodiak City Code.
The Finance Department is recommending the City Council protest this license renewal due to non -remittance
of sales tax. It was also noted from City staff that the licensee is not operating from the physical address on their
application.
The City Clerk sent a letter to Sizzler Burger and Peking Restaurant on July 18, 2024, notifying them of the
recommendation to protest at a regular Council meeting.
A resolution is before Council to protest, subject to rescission, for the renewal of the REPL No. 2611 Sizzler
Burger & Peking Restaurant for non-compliance of City Code Sections 3.08.140 failure to remit sales tax.
ALTERNATIVES:
Adopt, amend, postpone or do not adopt the resolution.

WHEREAS, the City of Kodiak received an application for renewal of Restaurant or
Eating Place License No. 2611 on June 11, 2024; and
WHEREAS, staff reviewed the application and the Finance Director issued a
recommendation to protest based upon the submittal of Sizzler Burger & Peking Restaurant's
application dated December 26, 2023, to AMCO declaring business operations in 2022 and 2023,
but not having remitted sales tax to the City of Kodiak for those years; and
WHEREAS, the Building Official reviewed the application and indicated the physical
location of 116 W. Rezanof Dr. is a vacant building and that it was renovated without the permits
required by Kodiak City Code; and
WHEREAS, the Fire Chief reviewed the application and indicated that 116 W. Rezanof
Dr. is not compliant with fire inspection requirements, due in part to the lack of a building permit
application; and
WHEREAS, per Alaska Statute 04.11.480, a local governing body may protest the
issuance, renewal, relocation, or transfer to another person of a license by sending the board and
the applicant a protest and the reasons for the protest within 60 days of receipt from the board of
notice of filing of the application; and
WHEREAS, if a protest is filed, the board will deny the application unless the board
finds that the protest is arbitrary, capricious, and unreasonable.
NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Kodiak,
Alaska, hereby protests, subject to rescission, renewal of Restaurant or Eating Place License No.
2611 Sizzler Burger & Peking Restaurant for non-compliance with City Code Section 3.08.140;
to wit, failure to submit sales tax returns in 2022 and 2023;
BE IT FURTHER RESOLVED that the City Clerk is instructed to communicate this
protest to the Alaska Alcoholic Beverage Control Board;
BE IT FURTHER RESOLVED that this protest shall be rescinded upon the applicant
filing accurate sales tax returns, with remittance of taxes owed, for 2022 and 2023;

Have you ever considered what NOK's lands mean to you as a shareholder? While the value of NOK
lands does not appear within issued financial statements or shareholder equity (because NOK's
lands were transferred under the ANCSA as a resource transfer, they are treated as a non -monetary
exchange)., NOK's 20,17.+ acres of land area very important piece of what being a NOK shareholder
means. In addition to the companies NOK owns, the businesses we're in, and the plans we have our
lands are a huge part of NOK's history and our future.
Looking Back
A significant part of NOK's activities throughout the past So years have centered around our lands.
NOK harvested over 1 billion board feet of timber since 1979. As a result, NOK received substantial
returns from its investment in the Koncor Forest Products Company joint venture For many decades,
especially throughout the 198o's and go's.
Looking Ahead
Part of NOK's efforts to ensure future vi'brant forests following early harvests included reforestation
with a geneticafly superior seed source designed to grow 75% faster. As a result, seedlings planted
several deeades ago have now grown to become ready for potential thinning to further enhance their
g=rowth potential.
Currently, NOK is working to create an overall forest management plan that will be used to help guide
overall management activities, in part, through available federally funded grant projects designed
to increase the value of NOK's lands that were previously harvested. In this way, maximum future
benefits can be realized for generations to Borne.
Protecting Area Ecosystems
Another way that NOK's lands have benefited current and future shareholders and Kod-iak arca
ecosystems overall was NOK's 2o18 sale of Portage Lake area lands. This 1,866 acre, $9.75 million
land sale to the Exxon Valdez Oil Spill Trustee Council, not only served to protect one of the most
productive habitats in the Gulf of Alaska, but also resulted in direct shareholder Heritage distribution
of 1o% of sale proceeds in 2o18, zolg and zozo.
Shareholder & Community Use
Closer to home, NOK's lands in and near Kodiak have served to suppo-rt community growth through
subdivision development and community business operations including equipment land space rental.
NOK's long-time land use collaborations with Afognak Native Corporation and Ouzinkie Native
Corporation have established a strong overall land use policy with a cornprehensive system for
ensured shareholder enjoymen�and benefit.
