KODIAK ISLAND BOROUGH STAFF REPORT APRIL 18, 2024 4 ' s ASSEMBLY REGULAR MEETING SUBJECT: Approval Of A Letter Supporting House Bill 173 An Act Relating To Public Construction Contracts To Update The Little Davis Bacon Act (LDBA) Public Construction Contract Threshold In The State Of Alaska ORIGINATOR: Nova M. Javier, MMC, Borough Clerk RECOMMENDATION: Move to approve the letter supporting House Bill 173 an act relating to public construction contracts. DISCUSSION: This letter is requested from the office of Representative Kevin J. McCabe. House Bill 173 seeks to modernize an outdated statute to better address the specific challenges of construction in Alaska. Specifically, it updates the Little Davis Bacon Act (LDBA) public construction contract thresholds in our state. The current threshold of $25,000 is deemed inefficient due to various Alaska -specific factors and inflationary pressures over the past 11 years. HB173 proposes an increase of the threshold to $150,000 reflects a pragmatic approach addressing this issue. By aligning the threshold more closely with the economic realities faced by small business, the bill will enable them to compete more equitably for municipal contracts. Raising the threshold for LDBA prevailing wages fosters a business -friendly environment that supports entrepreneurship and economic vitality. By providing relief to small business, House Bill 173 will stimulate economic growth, create job opportunities, and enhance the overall prosperity of the borough and across the state. Kodiak Island Borough Office of the Borough Mayor 710 Mill Bay Road Kodiak, Alaska 99615 Phone (907) 486-9310 Fax (907) 486-9391 Email: clerks gkodiakak.us RE: Support for HB173 - An Act Relating to Public Construction Contracts On behalf of the Kodiak Island Borough and its members, we are writing to express our strong support for House Bill 173 (HB173), titled "An Act relating to public construction contracts; and providing for an effective date." This legislative initiative marks a significant step forward in refining the framework governing public construction contracts in Alaska, and it promises to foster a more vibrant, equitable, and sustainable construction industry within our state. The amendment to increase the applicability threshold of public construction contracts from $25,000 to IOD/$250,000 under AS 36.05.005 is a commendable adjustment. It reflects a realistic understanding of the current economic conditions and construction costs, ensuring that small to medium-sized enterprises (SMEs) are duly burdened by stringent requirements on smaller projects. This change is anticipated to enhance efficiency, reduce administrative overhead for businesses, municipalities, and the state, and open opportunities for more local contractors to participate in public construction projects. This legislative proposal aligns with our Borough's mission to promote economic growth and prosperity in Kodiak and the wider Alaskan region. By adjusting the applicability threshold, HB173 acknowledges the vital role that the construction industry plays in our local economy. It ensures that public projects can be executed more swiftly and cost-effectively, benefiting our community at large through improved infrastructure and job creation. We believe that the enactment of this bill will bring about positive outcomes for the construction sector, contribute to the economic resilience of Alaska, and ultimately enhance the quality of life for its residents. We urge all members of the House State Affairs Committee to support HB173 and facilitate its swift passage through the legislative process. Together, we can build a stronger foundation for the future of Alaska's construction industry and its contribution to our economy. We are eager to see the positive impact this act will have on our community and the state of Alaska. " House Bill 173 seeks to modernize an outdated statute to better address the specific challenges of construction in Alaska. Specifically, it updates the Little Davis Bacon Act (LDBA) public construction contract thresholds in our state. The current threshold of $25,000 is deemed inefficient due to various Alaska -specific factors and inflationary pressures over the past 11 years. Many states have either eliminated thresholds altogether or raised them to $1 million. This bill proposes raising the threshold to $150,000 to better reflect inflation and current industry costs. This adjustment would streamline processes, reduce administrative burdens, and enhance efficiency in public construction projects statewide. Moreover, it would encourage smaller contractors to bid on contracts and help address the labor shortage in the construction industry in Alaska. Furthermore, the increased threshold would address unique challenges faced in Alaska, such as high transportation costs in rural areas. Currently, even minor projects, like repairing 20 potholes, may necessitate compliance with LDBA regulations due to exceeding the threshold. Support for House Bill 173 is crucial for adapting regulations, ensuring equitable participation for local contractors, and fostering economic development in the face of inflation and workforce shortages. Let's modernize our approach to public construction contracts and propel Alaska forward. Thank you for your attention to this important matter. The balance of the BFD response was on scene in under 10 minutes. BFD deployed the following apparatus and manpower to the incident, Engine Co. 10, Engine Co. 11, Tender Co. 11, Squad Co. 11, & Fire -100 Chief of Department, Fire -103 Department Safety Officer & Fire -109 Fire Department EMS & Rehab Officer. Kodiak FD Chief Domer also responded to assist with maintaining seamless emergency coverage for the community. The fire was well advanced when initial calls were made to KPD Central Dispatch and Fire Units were forced to attack the fire from the exterior and prevent extension. The building was a storage only outbuilding two stories in height and 30x30 feet in size. The building was very full of various storage and thus the fuel package was difficult to fully extinguish. Structural collapse and instability precluded firefighters from overhauling the debris to complete extinguishment. Incident Command requested a excavator to complete overhaul and extinguishment. The Excavator arrived on scene Sunday morning and final extinguishment of deep-seated pockets of fire was complete and Fire Units cleared the scene by 1030hrs on April 14th. There were no injuries to civilians or firefighters and damage was confined to the original storage structure and 3 disabled motor vehicles parked against the structure. The fire is currently under investigation and a comprehensive origin and cause report shall be promulgated and provided upon completion. The Bayside Fire Department extends gracious and heartfelt thanks to our mutual aid partners and the critical work of our professional emergency service telecommunicators at KPD who are truly Kodiak's First Responders.
