Assembly Regular Meeting
April 4, 2024
A regular meeting of the Kodiak Island Borough Assembly was held on April 4, 2024, in the
Assembly Chambers. The meeting was called to order at 6:30 p.m. Staff present were Borough
Manager Aimee Williams, Engineering and Facilities Director Dave Conrad, Borough Clerk
Nova M. Javier, and Assistant Clerk Irene Arellano.
INVOCATION
The invocation was given by Major David Davis of the Salvation Army.
2. PLEDGE OF ALLEGIANCE
Deputy Presiding Officer Smiley led the Pledge of Allegiance.
3. STATEMENT OF LAND ACKNOWLEDGEMENT

16. ASSEMBLY MEMBERS' COMMENTS
• Assembly Member Ames voiced his support on the failed Resolution Salonie
Creek Rifle Range lease and would like to see the amended lease back for
approval.
• Assembly Member Whiteside thanked the Kodiak College on their recent
scholarship and FAFSA Workshop Session. He also thanked Ms. Nancy Castro,
Student Service Admission Staff for her hard work.
• Assembly Member LeDoux explained his vote on the Salonie Creek Rifle Range
noting his concern with a lack of environmental study on lead contamination
area.
• Assembly Member Sharratt echoed Assembly Member Ames and LeDoux's
comments in support of the Salonie Creek Rifle Range lease. He would like to
see the resolution again with the items of concern being addressed first.
• The rest of the Assembly members had no comments.

RECOMMENDATION:
Mayor Arndt proclaims the month of May 2024 as Building Safety Month.
DISCUSSION:
Each year, in observance of Building Safety Month, people all over the world are asked to
consider the commitment to improve building safety, resilience, and economic investment at
home and in the community, and to acknowledge the essential service provided to all of us by
local and state building departments, fire prevention bureaus, and federal agencies in
protecting lives and property.

DECLARING THE MONTH OF MAY 2024 As BUILDING SAFETY MONTH
WHEREAS, The Kodiak Island Borough is committed to recognizing that our
growth and strength depends on the safety of homes, buildings, and
infrastructure in everyday life and when disasters strike; and
WHEREAS, our confidence in the resilience of these buildings can only be
achieved through the dedication of vigilant building safety inspectors, fire
prevention officials, architects, engineers, builders, tradespeople, design
professionals, laborers, and others in the construction industry who work year-
round to ensure the proper construction of Alaskan buildings; and
WHEREAS, the International Code Council is a nonprofit that brings together
local, state, and federal officials who are experts in the built environment to
create and implement the highest quality codes to protect us in the buildings
where we live, learn, work and play; and
WHEREAS, these modern building codes include safeguards to protect the
public from natural disasters such as hurricanes, snowstorms, wildland fires,
floods, and earthquakes; and
WHEREAS, "Mission Possible," the theme for Building Safety Month 2024,
encourages our citizens to consider the commitment to improve building safety,
sustainability, resilience, and economic investment at home and in communities,
and to acknowledge the essential service provided to all of us by local and state
code officials and federal agencies in protecting lives and property.
NOW, THEREFORE, I, Scott Arndt, Mayor of the Kodiak Island Borough do
hereby proclaim the month of May 2024 as Building Safety Month in Kodiak
Island Borough and encourage all citizens to join us as we participate in
Building Safety Month activities.

Changes To The Non -Bargaining
Match The Bargaining Unit Positions
With The Collective Bargaining
The Kodiak Island Borough has two salary schedules that cover all regular and temporary
employees (excluding contract employees); one for bargaining unit covered positions and one
for non -bargaining covered positions.
On August 6, 2023, the Collective Bargaining Agreement with the International Brotherhood of
Electrical Workers #1547 (Contract No. FY2024-06) approved a 2.0% pay increase effective
July 1, 2024, and another 2% pay increase effective July 1, 2025 for all bargaining unit
covered positions.
This ordinance updates the non -bargaining covered position's salary schedules to match the
annual pay increases the bargaining covered positions receive, thereby promoting equitable
compensation treatment between the Borough's two employee groups.

FISCAL IMPACT:
No impact, this is already built into the FY2025 Budget.

AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH ADOPTING
CHANGES TO THE NON -BARGAINING COVERED POSITIONS SALARY SCHEDULES TO
MATCH THE BARGAINING UNIT POSITIONS SALARY SCHEDULE CHANGES APPROVED
WITH THE COLLECTIVE BARGANING AGREEMENT (CONTRACT NO. FY2024-06)
WHEREAS, the Kodiak Island Borough has two salary schedules that cover all regular and
temporary employees (excluding contract employees); one for bargaining covered positions and
one for non -bargaining covered positions; and
WHEREAS, the bargaining unit employees salary changes are governed by the Collective
Bargaining Agreement with the International Brotherhood Of Electrical Workers #1547 (Contract
No. FY2024-06) which approved a 2.0% increase effective July 1, 2024, and another 2%
increase effective July 1, 2025, for all bargaining unit covered positions; and
WHEREAS, to promote equitable treatment between the two employee groups, the attached
non -bargaining covered position's salary schedules in Exhibit A contain the same 2% increase
effective July 1, 2024, and another 2% increase effective July 1, 2025, as contained in the
Collective Bargaining Agreement.
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH that:
Section 1: This ordinance is not of a general and permanent nature and shall not become a
part of the Kodiak Island Borough Code of Ordinances.
Section 2: The current non -bargaining covered salary schedules are hereby amended to reflect
the salary schedules set forth in Exhibit A, attached herein, which are adopted by
reference, and prior versions of the schedules are hereby replaced.
Effective Date: This ordinance shall be effective as of July 1, 2024.

RECOMMENDATION:
Move to adopt Resolution No. FY2024-21.
DISCUSSION:
The State of Alaska's Department of Natural Resources, Division of Forestry and Fire
Protection made grant funds available to volunteer fire departments. Both Fire Protection
Area No. 1 and Womens Bay Volunteer Fire Departments applied for grant funds. The criteria
to meet to be eligible for funding was:
• Serve a population of 10,000 or less
• Be registered with the Alaska Division of Fire & Life Safety
• Be NIMS Compliant
• Provide documentation of a minimum availability of 10% matching funds
Grant funds uses include:
• Increase firefighter safety
• Improve the firefighting capabilities of rural volunteer fire departments
• Enhance protection in wildland urban interface
ALTERNATIVES:
FISCAL IMPACT:
Not accepting grant award would be a loss of $6,975 of revenue for Fire Protection No 1, and
a loss of $6,067.39 of revenue for Womens Bay Volunteer Fire Department.

A RESOLUTION OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH AUTHORIZING

WHEREAS, the State of Alaska's Department of Natural Resources, Division of Forestry and
Fire Protection made grant funds available to volunteer fire departments; and

Thank you for applying for the 2024 Volunteer Fire Capacity (VFC) grants, formerly known as VFA. Forty-one (41)
fire departments applied for a VFC grant requesting a total of $266,198 in assistance. Forty (40) Alaska Fire
Departments will receive up to $7,000 per fire department. A total of $259,198 will be awarded. This is the letter of
official notification.
The enclosed spreadsheet lists all applicants and the amount requested/amount awarded. If a fire department is
awarded a grant, the amount awarded will be listed in the "Amount Awarded" column. If a VFD did not receive any
funding or will receive a partial award, please contact your respective DOF Fire Management Officer (FMO) with any
questions you may have.
• Checks will be distributed electronically by association with the VFD's SOA vendor number and the SOA
electronic payment agreement. Electronic disbursements are expected by no later than May 2024.
• To be eligible for a 2025 VFC grant, compliance documentation, such as copies of receipts for 2024 grant
expenditures, must be submitted to your nearest Forestry office before submitting a 2024 application.
• Volunteer Fire Capacity is an award of Federal Financial Assistance with funding from the USDA Forest
Service. Prime and sub -recipients to this award are subject to OMB guidance in sub -parts A through F of 2
CFR Part 200 as adapted and supplemented by the USDA in 2 CFR Part 400. Adoption by USDA of the OMB
guidance in 2 CFR 400 gives regulatory effect to OMB guidance in 2 CFR 200 where full text may be found.

The Volunteer Fire Capacity (VFC) program formerly known
as the Volunteer Fire Assistance (VFA) provides funding
assistance for training, supplies, equipment purchases,
and prevention activities on a cost share basis. The
program is available from the USDA Forest Service through
the State of Alaska, Division of Forestry & Fire Protection
and may be used for both wildland and structure
protection needs. The assistance is provided to increase
firefighter safety, improve the firefighting capabilities of
rural volunteer fire departments, and enhance protection
in the wildland urban interface. The amount available to
apply for is capped at $7,000. The 2024 VFC application
period will be open from November 1, 2023 -January 31,
2024.
Basic Volunteer Fire Capacity Criteria
• Serve a population of 10,000 or less
• Be registered with the Alaska Division of Fire & Life Safety
• Be NIMS Compliant
• Be in compliance with past VFC awards
• Provide documentation of a minimum of 10% matching
funds with application
VFC applications will only be accepted through the State of
Alaska, Division of Forestry's Online Line Application
System (OLAS) https://dnr.alaska.gov/olas/.
If, as a fire department, you have already registered
equipment in OLAS, use the same username and
password to access the 2024 VFC Grant Application. If you
are new to using OLAS, please register with your

number. Volunteer Fire Departments (VFDs) will need to
know their State of Alaska (SOA) vendor number to apply
and also be set up to receive funds electronically from the
State of Alaska. Once you have registered in OLAS, log in,
and go to the menu bar at the top of the page and click
'Volunteer Fire Capacity Grant Program', from there you
will be able to apply, view and/or print and sign all relevant
documents, and review the 2024 VFC Grant Manual. The

RECOMMENDATION:
Move to approve the letter supporting House Bill 173 an act relating to public construction
contracts.
DISCUSSION:
This letter is requested from the office of Representative Kevin J. McCabe. House Bill 173
seeks to modernize an outdated statute to better address the specific challenges of
construction in Alaska. Specifically, it updates the Little Davis Bacon Act (LDBA) public
construction contract thresholds in our state. The current threshold of $25,000 is deemed
inefficient due to various Alaska -specific factors and inflationary pressures over the past 11
years. HB173 proposes an increase of the threshold to $150,000 reflects a pragmatic
approach addressing this issue. By aligning the threshold more closely with the economic
realities faced by small business, the bill will enable them to compete more equitably for
municipal contracts.
Raising the threshold for LDBA prevailing wages fosters a business -friendly environment that
supports entrepreneurship and economic vitality. By providing relief to small business, House
Bill 173 will stimulate economic growth, create job opportunities, and enhance the overall
prosperity of the borough and across the state.

On behalf of the Kodiak Island Borough and its members, we are writing to express our strong
support for House Bill 173 (HB173), titled "An Act relating to public construction contracts; and
providing for an effective date." This legislative initiative marks a significant step forward in refining
the framework governing public construction contracts in Alaska, and it promises to foster a more
vibrant, equitable, and sustainable construction industry within our state.
The amendment to increase the applicability threshold of public construction contracts from $25,000
to IOD/$250,000 under AS 36.05.005 is a commendable adjustment. It reflects a realistic

medium-sized enterprises (SMEs) are duly burdened by stringent requirements on smaller projects.

The Planning & Zoning Commission has spent the past several months reviewing potential
changes to the accessory dwelling unit regulations. The draft ordinance attached to this agenda
item incorporates the following changes:
1. Removes the conditional use requirement for those ADUs that meet the development
standards.
2. The CUP remains for those ADUs that do not meet one or more of the development standards.
3. Refines the current definition of an accessory dwelling unit.
4. Splits the parking requirement up between ADUs within the City of Kodiak and those outside
of the city.
5. Simplifies the size restriction to a maximum of 800 square feet.
6. Removes the requirement that the owner of the property must live on the property.
7. Deletes requirements that are already in place through other ordinances such as building permit
compliance.

Manager's Department
ComFish — Attended several forum sessions to learn about the status of our Ports &
Harbors, Alaska Fish & Game, Mariculture, and Ocean Plastics Recovery. Also met
with Trident representatives for an update on the Kodiak plant and with Senator
Sullivan's new manager for the State of Alaska. Senator Sullivan and Representative
Stutes were here for their legislative updates and Senator Stevens participated in the
state update via Zoom.
Emergency Operations — Invited to meet with City of Kodiak representatives to discuss
the landslide threat due to heavy rains in the Kodiak Region. The second PSA that
came out shortly after 5PM tonight is attached to your packet.
DOT — Met with DOT and partner engineering and environmental firms for the ADA
Accessibility Sidewalk Improvement Project from Marine Way to Benny Benson and the
Otmeloi Project.
Port Lions — The Mayor of Port Lions has invited KIB to participate in a work session to
discuss land use, building permits, and zoning. They are curious about powers that the
KIB has and if they can adopt some of them as their own to protect their community.
KIB has received some clarifying information from our Attorney, however, more
questions need to be addressed before we have an answer.

Kodiak Rodeo & State Fair, INC — KIB received a letter from Board Treasurer, Marian
Royall, informing KIB of their desire to voluntarily decrease the occupancy of their
exhibit hall to under 300 people. This will allow them to remove the existing sprinkler
system. This is another item that requires some legal input. We will also be working
with our Building Official to ensure that this process is done correctly.
Fire Inspections — City of Kodiak Fire Department has started their inspections of KIB
properties. If there are discrepancies, we have thirty days to fix them. We are also able
to fix things on the spot if it is an easy fix. The main borough building, maintenance
building, projects offices, Red Cross building and the pool have been inspected thus far.
KISA Lease — Working with KIB Attorney to find out why certain language was added to
the lease. Also reviewing any restrictions that are in place due to insurance regulations.
Emergency Management Training — Kodiak Island Borough will be hosting Texas
A&M Engineering Extension Services (TEEX), Emergency Services Training Institute's
MGT -312- Senior Officials Workshop for All Hazards Preparedness and MGT 340 —
Crisis Management on June 10-11, 2024. All training will be delivered at Bayside
Volunteer Fire Department. Information about the training has been sent to KIBSD,
PKIMC, all four fire stations, Kodiak Police Department, the City of Kodiak, the Alaska
State Troopers, Alaska State Defense Force, and the Coast Guard Base Kodiak and Air
Station Kodiak Commanding Officers.
Upcoming Travel —
• PWSRCAC — April 30th — May 3rd (Assessing Director will sit at Manager's Desk
for the May 2nd Regular Meeting)
• Vacation — May 8-10, 2024 (E&F Director will sit at the Manager's Desk for the
May 9th Work Session)
Community Development
Planning & Zoning Commission — The Commission held a regular meeting on April
17, 2024. The Commission denied a rezoning request from the R2 zone to the R3 zone
for property located at 3201 Spruce Cape Road. The Commission also continued its
review of the ADU code amendment ordinance, the final vote before it goes to the
Assembly will take place on May 15tH
Multi -Hazard Multi -Jurisdiction Hazard Mitigation Plan — An in-person kick-off
meeting is scheduled for April 23, 2024, at 6 PM in the Assembly Chambers.
PLAN 2045 — Community Development staff working with Kodiak High School has
developed a logo contest for the new comprehensive plan. The logo contest is open to
all high school students. The contest closes on May 17. More information on the logo

Assessing Department
Board of Equalization (BOE) - The BOE (KIBC 3.35.050) meets Monday, May 6,
2024. Assessing had twenty-nine (29) logged appeals for the BOE. At the end of
Wednesday, April 17th, twenty-three (23) of the twenty-nine (29) appeals had been
withdrawn. One late appeal request will be considered by the BOE on April 23, 2024.
Current Projects -
• Property cleanup for Tyler Conversion
• Conversion meetings with Tyler began Tuesday April 2, 2024.
• Tyler assigned Assessing eleven (11) tasks this week, of which ten (10) were
completed by Wednesday April 17, 2024.
• Assessing and Finance need to meet to discuss some Tyler issues.
• Assessing is passing through the GIS information on its task list to IT
• Tyler has scheduled 5 (2 hour) meetings with Assessing in the month of April.
Certified Roll — Assessing will work with the BOE to get the roll certified by May 10,
2024.
Exemptions - 4 new exemption applications were received by the Jan. 15 deadline for
2024 for either non-profit religious or charitable uses. (KANA Marketplace, KCHC,
Alutiiq Museum and Calvary Baptist Church Bells Flats)
Engineering and Facilities
Alaska DOT Visit Regarding Rezanof Dr. Sidewalk Improvement Project -
Engineering staff has attended meetings with the DOT staff and engineers to hear all
the stakeholders concerns.
HFAB — Hospital Facilities Advisory Board — The next scheduled meeting is May 13,
2024, at the PKIMC Barometer Conference Room.
Old Mental Health Facility — Sampling took place April 12th and the 13th. Staff is
waiting for results.
Solid Waste Contract Committee — The next scheduled meeting is on May 14, 2024,
at 1:OOpm in the KIB Conference Room.
Landfill —
• Denali Commission Funding — If awarded, will be used to fund an
update to the Solid Waste Management Plan
• Equipment Grant - Staff has applied for the AML Heavy Equipment,
Road maintenance and Municipal Facilities Grant. Staff applied for a skid
steer loader and two dump trucks.
KIBSD —
• Engineering Staff was assisting on City Fire Inspections of facilities, during
the Community Pool Building inspection some violations were found. The
most impactful being the use of extension cords and power strips to
supply electrical power to the current chlorination system. All parties plan
to continue conversations on rectifying the issue.
• Petersen Roof — Regular bi -monthly meetings are continuing. Anticipate
on site work to begin in late April 2024. Weather dependent.
Leachate Treatment Plant —
• The contractor and engineering firm are working on rectifying the gallons
per minute flow deficiency.
Long Term Care — Contact has been made with the Providence real estate division.
R&R discussion and lease update is being started.
Finance Department
Property Taxes —
Real Property: The end of the Foreclosure process is approaching
for tax year 2022 and staff has sent warning letters to property owners.
Personal Property: Borough staff is continuing to file small claims
documents with the court for delinquent personal property accounts.
Property Assessment and Taxation Implementation Project — Staff is continuing to
meet with Tyler staff to review business rules and processes.
Staffing — We are still advertising for an accountant position.
IT Department
Exchange 2019 Upgrade — IT is working on upgrading our Exchange on premise
server to 2019 and migrating it and the Borough mailboxes to a new resource Forest
named Kodiak.gov.
Rename kib.local to kodiak.gov — IT is researching a project to rename the kib.local
Microsoft Windows forest to Kodiak.gov — this will align our systems with Microsoft best
practices and provide a solid foundation for subsequent additional infrastructure and
security measures. — currently in the early testing phase.
GIS- Aggregating and simplifying tools for Borough and public use:
i. Working on moving archival data to current GIS website for backwards compatibility.
ii. Working on the Parcel Fabric (Basically making the parcel lines more accurate to reality
through a long arduous process)
iii. Assisting Community Development with data for their Comprehensive plan.

iv. Working on Documentation of our GIS Data and what's critical/how we edit it/why we edit
it in this way.
V. Working on Identification of Missing Parcel IDs within our system.
vi. Completed the addressing of Karluk parcels, now working on Ouzinkie's
Network Security - Ongoing efforts to improve overall network security.
i. Active directory accounts review

V. System Patch policy and enforcement
vi. Ongoing efforts to upgrade server operating systems
vii. Working on a comprehensive network diagram for documentation.

text.
Alaska State and Local Cybersecurity Grant Program (SLCGP) – This is a grant
from the state of Alaska that is focused on improving the network security of the State
and Local governments in Alaska. It covers multiple years with multiple rounds of
funding for security audits and follow up projects.
i. Audit - IT is preparing for a security audit of the KIB systems that will be paid for
via a grant via the State of Alaska Statewide Cybersecurity Strategic Plan
(SCSP). We are finalizing the draft language for the RFP for this.
ii. Firewall Assessment — currently the Borough is not using the latest generation
firewall technology (which are application aware) to protect its public facing
assets such as the Borough web site and other infrastructure resources. IT is
currently assessing the costs and feasibility of upgrading them (PFSense) to a
Next Generation Firewall (NGFW)
iii. VPN Assessment — looking at improving the stability and usability of the Client
VPN technology implemented at the Borough. Ideally the VPN technology will be
automatic, and able to be used behind remote unmanaged firewalls.
iv. IDS Review – IT currently uses DarkTrace for its IDS, however the SLCGP has
kicked off a review of its capabilities vs other solutions which is ongoing.
Hyper V Virtualization Testing – IT is setting up a Microsoft based virtualization
platform utilizing old servers to test out Hyper -V and if it is a viable alternative to newly
expensive VMWare licensing after Broadcom acquired VMWare earlier this year.
Bayside Fire Department
Personnel Activity / Professional Development / Training
The Fire Department is proud to announce that three probationary firefighters have
been promoted to firefighter after a grueling 5 -hour live fire training event on Sunday
April 14th. Firefighters Kellen Zoellner, Andrew Park, & Jared Weems have completed
over 200 hours of recruit training over the past 9-12 months and successfully met
competence outlined in NFPA 1001 the Standard for Firefighter Professional
Qualification.
The BFD along with mutual aid partners Kodiak Fire & USCG Fire responded to a
structure fire on Saturday evening, the 13th of April at approximately 1907 hours at 3268
View Crest Lane. Bayside FD arrived in under 4 minutes from initial response and
established command and began firefighting actions with Engine Co. 11 placing a 2.5 -
inch handline into operation. The balance of the BFD response was on scene in under
10 minutes. BFD deployed the following apparatus and manpower to the incident,
Engine Co. 10, Engine Co. 11, Tender Co. 11, Squad Co. 11, & Fire -100 Chief of
Department, Fire -103 Department Safety Officer & Fire -109 Fire Department EMS &
Rehab Officer. The BFD deployed 13 firefighters in support of this incident. USCG FD
responded with 3 firefighters and Pumper to provide F.A.S.T. or Rapid Intervention for
firefighter safety & Kodiak Fire responded with a Pumper & Ambulance and 3
firefighters. Kodiak FD Chief Domer also responded to assist with maintaining
seamless emergency coverage for the community.
The fire was well advanced when initial calls were made to KPD Central Dispatch and
Fire Units were forced to attack the fire from the exterior and prevent extension. The
building was a storage only outbuilding two stories in height and 30x30 feet in size. The
building was very full of various storage and thus the fuel package was difficult to fully
extinguish. Structural collapse and instability precluded firefighters from overhauling the
debris to complete extinguishment. Incident Command requested a excavator to
complete overhaul and extinguishment. The Excavator arrived on scene Sunday
morning and final extinguishment of deep-seated pockets of fire was complete and Fire
Units cleared the scene by 1030hrs on April 14th. There were no injuries to civilians or
firefighters and damage was confined to the original storage structure and 3 disabled
motor vehicles parked against the structure. The fire is currently under investigation and
a comprehensive origin and cause report shall be promulgated and provided upon
completion.
The Bayside Fire Department extends gracious and heartfelt thanks to our mutual aid
partners and the critical work of our professional emergency service telecommunicators
at KPD who are truly Kodiak's First Responders.
Campus Upgrades and Maintenance - Clean-up of the campus continues, and new
plantings, beautification, and landscaping will begin to "pop up" in the coming months.
"Stuff to Just Make You Happy"
o The Fire Department will be holding an Awards and Appreciation Dinner on the
14th of June. Department service awards shall be presented. The event shall be
held at the Marketplace.
o The Fire Department will be holding a formal badge pinning / promotional event
in the coming month to recognize those members who have assumed new duties
and responsibilities in the department.

UPDATE: City & Borough Issue Flood Warning
APRIL 18, 2024 — KODIAK — Due to continued heavy rainfall, there is increased potential for
landslides in the Kodiak area. The City & Borough are advising residents to remain vigilant in
observing damage or dangerous slide activity and to report hazards to the Kodiak Police
Department at 907-486-8000.
As of 3:45 p.m. the National Weather Service issued a flood advisory and predicts heavy rainfall
through Saturday. City and Borough staff will continue to monitor throughout the evening as
conditions evolve and are actively working to mitigate and clean up flooding debris as
necessary. Additional updates will be made if necessary.
