2024-02-21 Regular MeetingKODIAK ISLAND BOROUGH Planning and Zoning Commission Regular Meeting February 21, 2024 A regular meeting of the Kodiak Island Borough Planning and Zoning Commission was held on February 21, 2024, in the Borough Assembly Chambers, 710 Mill Bay Road. The meeting was called to order at 6:30 p.m. Staff present were Community Development Director Christopher French, Associate Planner Joe Grochmal and Community Development Permit Technician Bronwyn Currie. CALL TO ORDER PLEDGE OF ALLEGIANCE ROLL CALL Present were Kent Cross, Christopher Paulson, Linnea Johnson, Cort Neff, Sara Fraser and Craig Dagen. APPROVAL OF AGENDA Paulson moved to approve the February 21, 2024, Regular Meeting Agenda. Dagen second's motion. VOICE VOTE CARRIED UNANIMOUSLY 6/0 APPROVAL OF MINUTES Dagen moved to approve the January 17, 2024, Regular Meeting Minutes. Paulson seconds motion. VOICE VOTE CARRIED UNANIMOUSLY 6/0 CITIZENS' COMMENTS 1. Patrick Adams PUBLIC HEARING Case No. 24-006. Disposal By Lease - Rifle Range Lease Renewal. Common Address: 12044 Chiniak Highway. Staff recommends that the Commission make a positive recommendation to the Assembly for disposal of this parcel by lease. Applicant (Kodiak Island Borough) is seeking a Title 18 Land Disposal Review to consider disposal of USS 2539 (Chapter 18.20.060 A KIBC) with intent to renew the Borough's lease with the Kodiak Island Sportsman's Association for the purpose of operating the Salonie Creek Rifle Range. Kodiak Island Borough Planning and Zoning Commission Regular February 21, 2024 Meeting Minutes Paulson moved to adopt Planning and Zoning Commission Resolution No. FY 24-01 recommending disposal by lease of 12044 Chiniak Highway (Chapter 18.20 KIBC) and to adopt the findings of fact listed in the staff report dated February 14, 2024, entered into the record for this case as "Findings of Fact' for Case No. 24-006. FINDINGS OF FACT 1. The Borough has owned this parcel for several decades and has previously leased it to the Kodiak Island Sportsman Association. 2. Disposal by lease of this parcel satisfies a public need and enhances the health, safety, and welfare of Borough residents. 3. This request is supported by Public Facilities & Services goals and policies identified in the 2008 Comprehensive Plan. Fraser seconds motion. Joe Grochmal presented the Staff Report. ROLL CALL VOTE CARRIED UNANIMOUSLY 6/0 Ordinance 2024-04 - Code Changes to Accessory Dwelling Unit KIBC 17.160.070 and Related Sections of Title 17. Paulson moved to continue the public hearing to the regular meeting on March 20, 2024. The Planning & Zoning Commission has spent the past several months reviewing potential changes to the accessory dwelling unit regulations. The draft ordinance attached to this agenda item incorporates the following changes: 1. Removes the conditional use requirement for those ADUs that meet the development standards. 2. The CUP remains for those ADUs that do not meet one or more of the development standards. 3. Refines the current definition of an accessory dwelling unit. 4. Splits the parking requirement up between ADUs within the City of Kodiak and those outside of the city. 5. Simplifies the size restriction to a maximum of 800 square feet. 6. Removes the requirement that the owner of the property must live on the property. 7. Deletes requirements that are already in place through other ordinances such as building permit compliance.
