January 17, 2024
A regular meeting of the Kodiak Island Borough Planning and Zoning Commission was held on
January 17, 2024, in the Borough Assembly Chambers, 710 Mill Bay Road. The meeting was
called to order at 6:30 p.m. Staff present were Community Development Director Christopher
French and Community Development Permit Technician Bronwyn Currie.

PUBLIC HEARING
Adams Variance, Case 24-005
Should the Commission agree with the staff recommendation and the proposed findings of fact,
the appropriate motion is:
1. Move to approve the variance request to allow an increase in the maximum lot coverage
for accessory structures within the R1 zoning district from 10% or 3,634 square feet to

11.63% or 4,229 square feet on LISS 3099 Lot 20, commonly known as 2546 Spruce
Cape Road.
The applicant requests a variance to the 10% maximum lot coverage for accessory structures
within the R-1 zoning district. The applicant proposes to demolish three existing accessory
structures that total approximately 897 square feet in area. The applicant plans to keep a shed
that is approximately 268 square feet in area. The applicant proposes to construct a 3960-
square-foot accessory structure to store materials that are currently stored outside on the
property. In addition, the applicant is conducting extensive site work on the property to address
long-standing drainage issues. The total proposed accessory building square footage after
construction of the new accessory structure would be approximately 4,229 square feet, which is
an accessory structure coverage of approximately 11.63%; therefore, the variance request is for
approximately 1.63% percent or 592.73 square feet.
Staff recommends based on the review outlined within the staff report that the Commission
approve the variance as requested.
Subject to the following findings of fact:
Finding 1: The existing drainage issues on the subject property are exceptional physical
circumstances to warrant the approval of the variance. Mitigating the drainage issues requires
extensive site disturbance and will limit the location of building additions to the principal
structure and the location of any additional structures to the property.
Finding 2: Strict compliance with the code provision in conjunction with the drainage issues on
the site would cause unnecessary hardship and practical difficulty to the purported needs of the
applicant.
Finding 3: The granting of this variance would not cause material damage or prejudice to other
properties because the applicant is correcting longstanding drainage issues on the subject a
property and is addressing existing outdoor storage with the construction of the new accessory
structure. In addition, the subject site is large enough to accommodate the new accessory
structure without negatively impacting surrounding smaller properties.
Finding 4: The requested variance would not be contrary to the objectives of the comprehensive
plan because the current comprehensive plan does not contain objectives related to the specific
provision in which relief has been requested and there are no other objectives that would be
related to this variance request.
Finding 5: The applicant's action did not cause the need for the variance; the variance is
requested to reduce outdoor storage on the property and the location of the accessory structure,
and its size is based on drainage mitigation measures that impact additions to the principal
structure and the location of new accessory structures on the property.
Finding 6: The applicant has stated that the accessory structure is needed to store accessory
items to the residence on the property. The applicant is not proposing the addition of a land use
to the property that is not permitted by the R-1 zoning district.
