The Kodiak Island Borough (KIB) has previously partnered with the Kodiak Island Borough School
District (KIBSD) fuel contracts. The KIBSD went out to bid for fuel contracts and awarded their three-
year contract to Petro Star Inc. dba North Pacific Fuel.
This memo is to demonstrate Kodiak Island Borough's agreement to the contract and award to Petro Star.

Move to authorize the Manager to approve Contract No. FY2021-31 Facility Heating Fuel Oil and
Highway Fuel for Kodiak Island Borough Facilities and Vehicles with Petro Star Inc. dba North Pacific
Fuel.
DISCUSSION:
The Kodiak Island Borough School District in cooperation with the Kodiak Island Borough have
advertised and received bids for FY2022 Heating Fuel and Highway Fuel. The bids include #1 and #2
Heating Fuel and #2 low sulfur equipment fuel. The completed bid packages have been received by the
district and forwarded to the KIB Staff for review and recommendation to the Assembly for consideration
and approval. The KIBSD Board has approved the contract award for the school district at their last
regular meeting. Contract start date is July 1, 2021.

The KIBSD and the KIB have jointly cooperated for multiple years with a shared bidding process. This
joint effort results in a cost saving for both entities due to a larger shared volume total. All relevant bid

KIBSD/KIB HIGHWAY FUEL BID SPECIFICATION
The Kodiak Island Borough School District (KIBSD) and the Kodiak Island Borough (KIB) are
soliciting bids from qualified firms for the supply of "Highway Fuels" for the Districts Motor
Vehicle Fleet to include School Buses, and KIB facilities and generators.
The District shall award two (2) contracts, one for KIBSD Motor Vehicle Fuel and one for
KIBSD Pupil Transportation Fuel, for the following:
A three-year contract commencing July 1. 2021 and ending June 30. 2024 to the
contractor submitting the lowest margin above the averaged Seattle OPIS rack
price per gallon for the period commencing March 8 and ending April 6. 2021 for
each gallon delivered or supplied to the KIBSD. The contractor's margin must
remain firm for the teen of the contract.
Documented price fluctuations throughout the contract period may change the delivered price per
gallon monthly in direct proportion the averaged daily Seattle OPIS rack price per gallon for the
previous month. Documentation of these price fluctuations, the calculations and the resulting
new price(s) per gallon shall be faxed or emailed to the KIBSD Maintenance Office by noon on
the second business day of the month.
Example: If the Vendor's cost was $1.00, plus $.10 tax, plus a $.18 margin ($1.28 per gal) and
the averaged price change for the previous month was two cents per gallon, the price increase or
decrease to KIBSD would increase ($1.30) or decrease ($1.26) two cents per gallon for the new
month.
The price per gallon for the month of July 2021 shall be the averaged Seattle OPIS rack price per
gallon for the month of June 2021 plus any appropriate tax, (the District is exempt from most
fuel taxes under Title 15 of the Alaska Administrative Code) plus the Vendors margin.
All accounting and reporting shall at be separated into two (2) distinct contracts accounts, one
for KIBSD Motor Vehicle Fuel, one for KIBSD Pupil Transportation Fuel and KIB facilities
fuel. Each account shall be further broke down by vehicle or facility.
The Vendor's delivery location must allow for easy and safe access to the pumps by large motor
vehicles (school buses).
The KIBSD reserves the right to reject any or all bids.
Please note that the following estimated annual quantities are for bid information only and
are not to be interpreted as guaranteed deliverable quantities.

Daily Mirror and the Anchorage Daily News on March 5, 10, 16 and 24, 2021. The invitation to bid was
also published on the District's website. The bids were publicly opened at the District's Finance Office
at 2:05 P.M. on March 26, 2021.
Attached to this memo are the terms and conditions of the bid along with the scoring matrix. Please note

NYMEX REBOUND PUSHES WEST COAST PRICES HIGHER
03/24/21 - The prices of crude oil and refined product futures contracts are taking
a breather heading into Wednesday evening, pulling back slightly in electronic
trading after a session that saw all contracts soar significantly higher.
Most contracts saw gains of 4% to 6% during the regular trading session, as
buyers raced back in and erased the impact of Tuesday's price rout. The rally's
impetus was the unusual news that a massive container ship had gotten wedged
crossways in the Suez Canal, disrupting traffic in a crucial supply line for the
petroleum trade between Europe and Asia.
Prices, which have been sliding for nearly two weeks now, are still off recent
highs, but there are indications today's gains might hold once traffic resumes flow
in the canal.
The April contract for West Texas Intermediate crude oil gained $3.42, to
$61.18/bbl during the regular trading session, a rise of about 6%. Gains for the
May contract were $3.38, to $61.16/bbl. The May contract for Brent crude ended
Its session at $64.41/bbi, an increase of $3.62, while June prices added $3.39, to
$64.25/bbl. Crude prices, however, were giving back about 30cts of their gains in
electronic trading at about 4:30 p.m. ET.
April RBOB saw gains that were even larger, shooting up 9.26cts, to
$1.9890/gal, a gain of about 4.9%. May prices added 9.16cts, to $1.9875/gal. Both
contracts, however, were about 80pts off their settlement price later Wednesday
evening.
ULSD futures saw the front -month contract tack on 7.67cts, to $1.8256/gal, or
4.4%, while May's gains were 7.63cts, to $1.8265/gal. After-hours losses for both
contracts are about 45pts.
The news of the container ship's grounding overshadowed a bearish federal
Inventory report, which showed stocks of petroleum products rising during the
week ending March 19. Crude oil inventories added 1.9 million bbi and are now
5% over seasonal averages after five consecutive weeks of inventory increases.

1) Page 2, second paragraph - it states a contract will be awarded to the contractor
submitting the lowest margin above the averaged OPIS Rack per gallon for the period of
March 8 to April 6, 2021.
a. That sounds to me like KIBSD would like a prior months OPIS Seattle average as
your price basis. So the OPIS Seattle average for March 2021, would become the
price basis for April 2021 deliveries to KIBSD — right? YES.
b. I guess I am trying to understand how you want proposals by March 26, but you
are including the OPIS Seattle average out to April 6, 2021. Shouldn't we use the
average of March 1 thru 25, 2021? YES.
2) Page 2, 5'h paragraph — it states, "the delivered price per gallon for the month of July
2021 shall be the averaged Seattle OPIS Rack price per gallon for the month of plus the
contractor's margin."
a. It seems that is not a complete sentence — meaning "averaged Seattle OPIS Rack
price per gallon for the month of (Which Month) plus contractors margin"
Please refer to the 01 paragraph example.
3) Page 4, you have shown KIBSD, KIB & Providence facilities, fuel type and gallons. I
would like to confirm that the fuel type shown for each location will remain the same for
the entire calendar year — meaning if it says "91" than it is the expectation that 91
Heating Fuel will be delivered to that location year round?
It can change depending on the seasonal variations.
4) Page 5, I don't see any reference to possible applicable Federal, State or Local taxes. Are
you expecting a Delivered price per gallon excluding taxes?
Please add taxes on a separate line on the bid sheet.

The Kodiak Island Borough School District (KIBSD), and the Kodiak Island Borough (KIB)
request bids for the supply of "Highway Fuels" for the District's Motor Vehicle Fleet to include
School Buses. A specification sheet is attached.
* All prices must be as delivered.
* Quotations must be received by 12 p.m. on March 26, 2021 at the KIBSD Shipping
and Receiving Office, 722 Mill Bay Road, Kodiak, Alaska. They will be opened on
March 26, 2021 at 2:00 p.m. in the KIBSD Business Department in room F145.
* A Local vendor preference of up to 10% may be given to vendors maintaining offices in

KIBSD/KIB HIGHWAY FUEL BID SPECIFICATION
The Kodiak Island Borough School District (KIBSD) and the Kodiak Island Borough (KIB) are
soliciting bids from qualified firms for the supply of "Highway Fuels" for the Districts Motor
Vehicle Fleet to include School Buses, and KIB facilities and generators.
The District shall award two (2) contracts, one for KIBSD Motor Vehicle Fuel and one for
KIBSD Pupil Transportation Fuel, for the following:
A three-year contract commencing July 1, 2021 and ending June 30, 2024 to the
contractor submitting the lowest margin above the averaged Seattle OPIS rack
price per gallon for the period commencing March 8 and ending April 6, 2021 for
each gallon delivered or supplied to the KIBSD. The contractor's margin must
remain firm for the term of the contract.
Documented price fluctuations throughout the contract period may change the delivered price per
gallon monthly in direct proportion the averaged daily Seattle OPIS rack price per gallon for the
previous month. Documentation of these price fluctuations, the calculations and the resulting
new price(s) per gallon shall be faxed or emailed to the KIBSD Maintenance Office by noon on
the second business day of the month.
Example: If the Vendor's cost was $1.00, plus $.10 tax, plus a $.18 margin ($1.28 per gal) and
the averaged price change for the previous month was two cents per gallon, the price increase or
decrease to KIBSD would increase ($1.30) or decrease ($1.26) two cents per gallon for the new
month.
The price per gallon for the month of July 2021 shall be the averaged Seattle OPIS rack price per
gallon for the month of June 2021 plus any appropriate tax, (the District is exempt from most
fuel taxes under Title IS of the Alaska Administrative Code) plus the Vendors margin.
All accounting and reporting shall at be separated into two (2) distinct contracts accounts, one
for KIBSD Motor Vehicle Fuel, one for KIBSD Pupil Transportation Fuel and KIB facilities
fuel. Each account shall be further broke down by vehicle or facility.
The Vendor's delivery location must allow for easy and safe access to the pumps by large motor
vehicles (school buses).
The KIBSD reserves the right to reject any or all bids.

The Kodiak Island Borough School District (KIBSD), the Kodiak Island Borough (KIB) and
Providence Kodiak request bids for the supply and delivery of #1 and #2 heating fuel to the road
system schools, KIB facilities and Providence Kodiak and supply to non -road system schools. A
specification sheet is attached.
* All prices must be as delivered to the listed facilities.
* Quotations must be received by 12 p.m. March 26, 2021 at the KIBSD Shipping and
Receiving Office, 722 Mill Bay Road, Kodiak, Alaska. They will be opened March 26, 2021
at 2:05 p.m. in the KIBSD Business Department in room F145.
* A Local vendor preference of up to 10% may be given to vendors maintaining offices in
Kodiak if all other factors are equal.
* The KIBSD reserve the right to reject any or all bids.

KIBSD/KIB FUEL BID SPECIFICATION
The Kodiak Island Borough School District (KIBSD), the Kodiak Island Borough (KIB) and

Each separate entity shall award:
A three-year contract commencing July 1, 2021 and ending June 30, 2024 to the

price per gallon for the period commencing March 8 and ending April 6, 2021 for
each gallon delivered or supplied to the KIBSD, KIB or Providence Kodiak. The

price change for the previous month was two cents per gallon, the price increase or decrease to
KIBSD, KIB or Providence Kodiak would increase ($1.20) or decrease ($1.16) of two cents per
gallon for the new month.
The delivered price per gallon for the month of July 2021 shall be the averaged Seattle OPIS
rack price per gallon for the month of plus the contractor's margin.
All accounting and reporting shall be separated into three distinct contracts/accounts, one
for the KIBSD, one for the KIB and one for Providence Kodiak.
The contractor's delivery system shall ensure adequate fuel levels be maintained at all times.
Costs associated with deliveries made outside of normal working hours are to be borne by the
successful contractor.
The KIBSD reserves the right to reject any or all bids.
PROTECTION OF PROPERTY AND SPILL PREVENTION: The contractor shall not
damage or contaminate existing buildings, equipment, asphalt pavement, soil, and vegetation
(such as trees, shrubs and grass) on the contracting agency's property. If the contractor damages
or contaminates any such buildings, equipment, asphalt pavement, soil or vegetation, or other
facilities, they shall replace the damaged items or repair the damage at no expense to the
contracting agency and to the satisfaction of the contracting agency. Further, should the
contractor fail or refuse to make such repairs or replacements, the contracting agency may have
said repairs or replacement accomplished, and the contractor shall be liable for the cost thereof
which may be deducted from the amounts due under this contract.
The contractor shall take all measures as required by law to prevent petroleum, oil or lubricant
(POL) spills (including, but not limited to, any spilling, leaking, pumping, pouring, emitting,
emptying, or dumping into or onto any land or water). In the event the contractor spills any POL
(including, but not limited to, gasoline, diesel fuel, fuel oil, lubrication oil, hydraulic oil or
aviation fuel), the contractor shall be responsible for the containment, clean-up, and disposal of
the POL spilled. Should the contractor fail or refuse to take the appropriate containment, clean-
up, and disposal actions, the contracting agency may do so itself. The contractor shall reimburse
the contracting agency for all expenses incurred including fines levied by appropriate agencies of
federal or local governments.
SPILL CLEAN-UP: The contractor will be responsible for all fuel spill(s), caused by their neg-
ligence that may occur during transit or fueling operations. Contractors must immediately report
spillage to the local Alaska Department of Environmental Conservation (DEC), and to the United
States Coast Guard District Office (USCG), as required by law, and clean-up the spillage. Failure to
do so will cause the contracting agency to take corrective action and charge the contractor for all
related costs.
COMPLIANCE: The contractor must comply with all federal, state, local and borough regulations,
codes and laws; be liable for all required insurance, licenses, permits, and bonds; pay all applicable
federal, state, local and borough taxes.

are not to be interpreted as guaranteed deliverable quantities. Weather conditions and
building occupancy will determine actual consumption.
