Debt Service Update – attached to this memo is an update on Debt Service Refunding. The
State of Alaska Department of Education and Early Development (DEED) has notified the KIB
that the FY22 reimbursement for eligible school general obligation bonds will be 36.8662%. The
FY22 KIB budget was based on a 50% reimbursement rate there is a projected shortfall of
$713,767.00.
ARPA Funding – Staff continues to work to understand and confirm allowable reimbursement
and potential funding for projects associated with health and community wellbeing. In the near
future, an MOU with KCHC, PKIMC and the KIB will be presented for consideration for
potential use of ARPA funds. Analysis, planning and design for facility enhancements will be
based on estimated community need. These evaluation projects will establish the necessities for
the Kodiak community’s potential future medical requirements.

KIBSD – Joint meeting has been postponed for October 28. Awaiting confirmation of attendance
prior to finalizing date and time for this meeting.
A meeting is scheduled for October 25th with KIBSD maintenance staff to discuss snow removal
and ice control.

Saltery Cove – MOU has been reviewed and received from Island Trails Network. Staff
performing final review and attorney review prior to presentation to the assembly for review,
comment, and approval
E/F – Salonie Creek - Anticipate this anadromous stream culvert replacement to begin next
week. The Salonie Creek Road will be closed to KISA and all traffic until the completion and
acceptance of the bridge installation. Progress will depend greatly on precipitation and creek
flow.
Solid Waste –
AK Waste / KIB met today to discuss issues. Staff and AK Waste to prepare a list of suggested
contract clarifications and changes to improve service. The list will be presented to the assembly
for consideration.
The 2021 annual Solid Waste Program Class I Landfill Permit # SW1A005-23a was conducted
on September 13, 2021. The KIB received a Final Score of 99.0% - 411 of 415 possible points.
Best inspection number since I have been involved. Congratulations are due to the landfill and
administrative employees that all contribute to this evaluation number.
Solid Waste Advisory Board meeting is scheduled for October 27, 2021, at the Assembly
Chamber.
USDA Grant / Loan Application – Application has been finalized and submitted. Discussions
with USDA staff have confirmed that up to 45% of a project cost may be awarded in a grant
form, low interest loans are at 1.75% for 30 years. Interim financing for design and construction
on an accepted loan will be required.
KFRC – Design and planning of the required decontamination system is moving forward. Staff
and consultants are working on a target due date prior to the end of the calendar year.
A schedule and delivery timeframe will be prepared by November 1, 2021.
CDD – Interested parties have contacted staff for both residential and commercial subdivision
development.
Manger Recruitment – Staff is preparing packets for the assembly members. Packets will be
available at the Clerk’s Office by 10:00am, Monday, October 25th.

Service Contracts Update and discussion, Service Area Contracts, Personnel Manual Review,

DISCUSSION:
The local regular municipal election was held on Tuesday, October 5, 2021. The
Canvass Board met on October 13, 2021 and examined in detail all Early Voting, Ballot
By Mail, Write-In, Personal Representative, and Questioned Ballots, Optical Scan
Receipts, Original and Duplicate Tally Books From Each Of The Precincts Of The
Kodiak Island Borough.
Borough Code 7.40.020 Certification of the election; states that as soon as possible
after the canvass of returns is completed, the Borough Assembly shall meet t o receive
the report of the canvass board and if after considering said report, the assembly
determines that the election was validly held, the election shall be certified by resolution
and entered upon the minutes of the meeting.

A. As soon as possible after completion of the canvass, the assembly shall meet in
public session to receive the report of the canvass board. If, after considering said
report, the assembly determines that the election was validly held, the election shall

B. If the canvass board reports a failure to comply with provisions of state law and
borough ordinance or illegal election practices occurred and that such failure is
sufficient to change the outcome of the election, the assembly may exclude the

votes cast in one or more precincts where such failure or illegal practices occurred
from the total returns or may declare the entire election invalid and order a new
election.
C. If the canvass board reports an apparent discrepancy in the returns of one or
more precincts, the assembly may order a recount of the votes cast in said
precinct(s). Such recount shall be conducted immediately by the canvassing board
and the results reported to the assembly.
D. In case of failure to elect a candidate because of a tie vote, the assembly shall
immediately cause the canvass board to recount the votes. If there is still a failure
to elect because of a tie after completion of the recount, the election shall be
determined fairly by lot from among the candidates tying in a meeting of the
assembly and under its direction.
E. Upon certification of a valid election the assembly shall direct the clerk to deliver
to each person elected to office a “certificate of election” signed by the clerk and
authenticated by the seal of the borough. [Ord. FY2009-19 §2, 2009; Ord. 86-22-O
§2, 1986].

Superior Courts, staff is recommending the changes brought forth in this ordinance.
These changes will bring Section 3.35.030 more in line with Alaska State statues,

the Assembly and the public.

46 contained in AS 29.45.030(e).

49 1. A waiver may only be granted for the year in which an application is filed. A delay in
50 filling an application shall be presumed to lack good cause for the delay
51 and may be denied unless the assembly finds good cause for the delay as
52 defined in subsection (D)(2) of this section.

54 2. “Good cause” shall mean extraordinary circumstances beyond the control of the
55 applicant, including but not limited to a medical condition or disability, impaired mental
56 capacity, family emergency, death in the family, or similar serious condition or event that
57 substantially impaired the applicant’s ability to file a timely application. “Good cause”

59 not mean late filing due to the applicant’s inadvertence, oversight, or lack of knowledge
60 regarding the filing requirements or deadline, financial hardship, or failure to pick up or
61 read mail or to make arrangements for an appropriate and responsible person to pick up
62 or read mail.

64 E. Applications for Exemptions. The borough assessor shall grant or deny all applications
65 for exemptions, except for community purpose exemptions, which must be granted by the
66 borough assembly.
67 1. Strict Enforcement of Deadlines to File an Exemption Application and Annual
68 Certification.
69 a. Properties qualifying for an exemption under this section must be owned and in
70 use on January 1st of the applicable tax year. There shall be no proration of taxes
71 under this section.
72 b. Written application for real property exemptions under this section, including any
73 required supporting documentation, must be received by the assessor no later than
74 January 15th of the tax year in which the exemption is requested.
75 c. Once an exemption based upon the use of the property has been approved, the
76 assessor will review the subject property’s exempt status annually, and may require
77 the exempt party to provide annual certification that the exempt use of the property
78 remains consistent with the use described and approved in the original application.
79 Senior and disabled veteran exemptions must be reapplied for and reviewed by
80 the assessor annually.
81 d. Reapplication for the exemption shall be required upon any change in the
82 ownership or use of the property, and shall meet the deadlines prescribed under this
83 chapter.
84 e. The deadline for filing an application for exemption, filing a reapplication if
85 necessary, requesting an administrative review from the assessor, and filing an

the assembly shall declare a seat vacant when a member misses three consecutively

The Clerk's Office received notice from Meagan Christiansen, Special Projects Support
Staff, that Ms. Culbertson's has not attended any meeting since January 27, 2020. Ms.
Culbertson is an original member appointed to the Consolidation Committee by Mayor
Rohrer. She has provided no further communication regarding attendance or interest in
the committee.
Mr. Griffin was appointed to the Borough Assembly on September 30, 2021 and

The Clerk will administer the Oath of Office to Newly Elected Officials
DISCUSSION:
Kodiak Island Borough Code 2.25.030 Dictates that:
Before taking office, an assembly member shall affirm in writing that the duties of the
office will honestly, faithfully, and impartially be performed. The oath shall be filed with
the clerk.
It is also stated in KIBC 2.25.020 that the term of an assembly member is three years
or until a successor is selected and qualified. The regular term of office begins on the
first Monday following a certification of the election and upon taking an oath of office.
The Borough Clerk will administer the Oath of Office to the newly elected officials and
they will officially take office on Monday, October 25.

A CONSOLIDATION COMMITTEE
WHEREAS,the October 4,2016 local election included an advisory question on the ballot that
asked,“Should the Kodiak Island Borough pursue the idea of consolidating the Kodiak Island
Borough and City of Kodiak into a single unit of govemment?";and
WHEREAS,the results of the advisory question were in favorwith 1,235 Yes and 919 No votes;
and
WHEREAS,consolidating the Kodiak Island Borough and City of Kodiak into a single unit of
government would require a petition to the Local Boundary Commission;and
WHEREAS,the petition requires detailed information about how the two governments would
be combined and the new government that would be fonned;and
WHEREAS,Resolution No.FY2018-25 approved the solicitationof proposals for research and
analysis services for the possible consolidation of the City of Kodiak and Kodiak Island Borough
governments,but there were no proposers;and
WHEREAS,Assembly members have voiced agreement that a coordinated effort between the
two local governments and members of the public is needed to gather information and propose a
plan for consolidating the two governments,and prepare a petition to the Local Boundary
Commission;and
WHEREAS,the Intent of this consolidation is to combine only the City of Kodiak and Kodiak

Section 1:Created Membership.The formation of the committee willconsist of the following
nine members:
1 Borough government representative and 1 alternate

The Borough Manager and City Manager,or their designees,shall serve as Ex-Of?cio members
Section 2:Organization.The chairperson shall be assigned by the Borough Mayor and the vice
chairperson shall be elected by the committee.The chairperson shall report to the entire
Assembly on behalf of the committee.
Section 3:Appointments.The Mayor shall appoint the members of the committee subject to
con?rmation of the Assembly.
Section 4:Powers and Duties.The responsibilities of the committee are to offer
recommendations to the Assembly related to consolidating the Kodiak Island Borough and City
of Kodiak governments Into a new local government;and to prepare a draft petition for the Local
Boundary Commission.
The committee willmeet regularly to research,discuss and recommend decisions regarding the
details required for the consolidation of the Kodiak Island Borough and the City of Kodiak;and
report periodicallyto the Assembly the ?ndings of the committee.
Section 5:Administrative Assistance.The Manager shall provide staff assistance to the
committee including scheduling,meeting space.a work plan preliminary research on topics of
concern,and document creation/tracking/editing.
Section 6:Reporting.The committee chairperson shall report to the Assembly during a public
meeting.
