CALL TO ORDER
VICE CHAIR Schmitt called to order the February 17, 2021 regular meeting of the Planning &
Zoning Commission at 6:36 p.m.
PLEDGE OF ALLEGIANCE
VICE CHAIR Schmitt led the pledge of allegiance.
ROLL CALL
Commissioners present were Alan Schmitt, Kent Cross, Joseph Delgado and Matt Novello.
Absent was Sarah Harrington.
A quorum was established
Community Development Department staff present were Robyn Keefe and Laurie Pardoe.
COMMISSIONER Delgado move to excuse Commissioner Harrington.
ROLL CALL VOTE ON THE MOTION CARRIED UNANIMOUSLY.
APPROVAL OF AGENDA
COMMISSIONER Delgado moved to approve the agenda.

APPROVAL OF MINUTES
COMMISSIONER Cross moved to approve the December 16, 2020 minutes.

CITIZENS' COMMENTS — None.
PUBLIC HEARINGS
A. CASE 21-009. Request a conditional use permit to allow a 600 square foot attached
accessory dwelling unit in the RR — Rural Residential District on Lot 1A, Block 1,
Woodland Acres 2nd Addition (KIBC 17.65.040, 17.160.070 & 17.200).
COMMISSIONER Cross moved to a Conditional Use Permit to allow an attached accessory
dwelling unit in the RR -Rural Residential District on Lot 1 A, Block 1, Woodland Acres 2nd
Addition, and adopt the findings of fact for Case No. 21-009 listed in the staff report dated
January 29, 2021.
Associate Planner Keefe gave a staff report. She stated that the only concern would be a
possible increase in density on a legal non -conforming lot. However, investigation revealed
that there are multiple non -conforming lots of similar size in the surrounding area and
because there would not be any material change in the property there should not be an affect.
Vice Chair Schmitt opened the public hearing.
Vice Chair Schmitt closed the public hearing.
Commission discussion.
Commissioner Cross expressed that he believes these request indicate Planning & Zoning is
getting more request.
Commissioner Schmitt expresses support for the request.
FINDINGS OF FACT
1. Attached accessory dwelling units are a conditional use in the RR -Rural Residential zoning
district.
2. This conditional use results in virtually no physical changes to the property, preserving the
value, spirit, character and integrity of the surrounding area, which includes a mix of
commercial, residential and institutional uses.
3. This conditional use fulfills all requirements of KI BC 17.200 (Conditional Use Permits).
4. Granting this conditional use will not result in any material changes to the property in
question, and the first -floor garage conversion to an ADU will have no negative impacts to
properties nearby, many of which are non-residential. Thus, it will not be harmful to the public
health, safety, convenience and comfort.
5. The proposed use and development fulfills all requirements for setbacks, lot area (legally
nonconforming), buffers and other safeguards identified in KIBC 17.65 (RR — Rural
Residential District).
6. This Conditional Use Permit is not being used for a public use or structure.

COMMISSIONER Cross nominated Commissioner Schmitt for chair.

CITIZENS' COMMENTS — None.
STAFF COMMENTS
Secretary Pardoe reminded Commissioners of the APA training. She also reminded them that
APOC filings are due the following month and that if they are not filed, they could be subject to
fines. Finally, she reminded them that meetings will be in -person from now on.
COMMISSIONER COMMENTS
Commissioner Novello — commented that the Planning Commissioners conference sponsored
by the Alaska APA last year was a waste of time. He stated that he didn't realize it had been a
year already and that it will be his last year on the commission.
Commissioner Cross — will not be able to attend the March meeting. Agreed that the
commission is an important function.
Commissioner Delgado — Agreed that the training was a waste of time. Stated that he likes the
Zoom meetings and that he's trying to recruit people from the rural communities and would like
them to have the option of attending by Zoom. Will have to look at schedule to make sure he
doesn't have future conflicts. Likes being on the commission.
Commissioner Schmitt — Welcomed Robyn Keefe. Stated he will be gone April 19t" for the
regular meeting.
ADJOURNMENT
COMMISSIONER Cross moved to adjourn.
ROLL CALL VOTE ON THE MOTION CARRIED UNANIMOUSLY.
CHAIR Schmitt adjourned the meeting at 6.58 p.m.
