CALL TO ORDER
VICE CHAIR SCHMITT called to order the November 18, 2020 regular meeting of the Planning &
Zoning Commission at 6:30 p.m.
PLEDGE OF ALLEGIANCE
VICE CHAIR SCHMITT led the pledge of allegiance.
ROLL CALL
Commissioners present were Harrington, Cross, Novello, Schmitt, and Delgado. Absent was
Townsend. Community Development Department staff members present were Erin Welty and
Laurie Pardoe.
COMMISSIONER CROSS moved to excuse Commissioner Townsend who was absent due to
personal reasons.
VOICE VOTE ON MOTION CARRIED UNANIMOUSLY.
APPROVAL OF AGENDA
COMMISSIONER CROSS moved to approve the agenda.
VOICE VOTE ON MOTION CARRIED UNANIMOUSLY.
APPROVAL OF MINUTES
COMMISSIONER CROSS moved to approve the October 21, 2020 minutes.
VOICE VOTE ON MOTION CARRIED UNANIMOUSLY.
CITIZENS' COMMENTS — None.
PUBLIC HEARINGS
A. CASE 21-006. Request a variance to allow an 8' x 40" container to temporarily encroach
on an RR1 —Rural Residential One District zoned, twenty (20) feet into the front yard
setback and five (5) feet into the west side yard setback on Lot 2B, Block 7, Miller Point
Subdivision 1st Addition.
COMMISSIONER CROSS moved to grant a variance to allow an 8' x 40" container to temporarily
encroach on an RR1 —Rural Residential One District zoned lot, twenty (20) feet into the front yard

setback and five (5) feet into the west side yard setback on Lot 213, Block 7, Miller Point
Subdivision 1st Addition subject to two conditions of approval and to adopt the findings in the staff
report dated November 4, 2020 as Findings of Fact for Case S21-006.
Director Welty gave a staff report.
Vice Chair Schmitt opened the public hearing.
Siene Allen spoke in favor of her variance request.
Vice Chair Schmitt closed the public hearing.
Commission discussion.
CONDITIONS OF APPROVAL
1. One 8' x 40' container may be placed in the front and side yard setback for no longer than
two years from the approval of the variance.
2. No extension shall be granted for this variance. Any continuation of the encroachment will
be required to be submitted as a new variance request.
FINDINGS OF FACT
17.195.050 A.1. Exceptional physical circumstances or conditions applicable to the property or
intended use of development, which generally do not apply to other properties in the same land
use district.
17.195.050 A.2. Strict application of the zoning ordinances would result in practical difficulties or
unnecessary hardships.
17.195.050 A.3. The granting of the variance will not result in material damages or prejudice to
other properties in the vicinity nor be detrimental to the public's health, safety and welfare.
17.195.050 A.4. The granting of the variance will not be contrary to the objectives of the
Comprehensive Plan.
17.195.050 A.6. That the granting of the variance will not permit a prohibited land use in the district
involved.

Commissioner Delgado remarked that it was great to see one another again.
Commissioner Schmitt noted the upcoming Thanksgiving holiday and how thankful he was to
live in Kodiak.
