2020-09-16 Regular MeetingSCANNED KODIAK ISLAND BOROUGH PLANNING AND ZONING COMMISSION Date: :Init: MINUTES September 16, 2020 Regular Meeting 6:30 p.m. - Borough Assembly Chambers CALL TO ORDER CHAIR TOWNSEND called to order the September 16, 2020 regular meeting of the Planning & Zoning Commission at 6:30 p.m. PLEDGE OF ALLEGIANCE CHAIR TOWNSEND led the pledge of allegiance. ROLL CALL The Chair shall cause the record to reflect the absence of the member, the REASON for the absence, and whether the absence is excused by the Commission. Commissioners present were Dave Townsend, Alan Schmitt, Kent Cross, Joseph Delgado, and Sarah Harrington. Absent were Kyle Blondin and Matthew Novello. A quorum was established. Community Development Department staff present were Erin Welty, Janel Day, and Laurie Pardoe. APPROVAL OF AGENDA COMMISSIONER SCHMITT moved to approve the agenda. VOICE VOTE ON MOTION CARRIED UNANIMOUSLY. APPROVAL OF MINUTES COMMISSIONER SCHMITT moved to approve the July 15, 2020 minutes. VOICE VOTE ON MOTION CARRIED UNANIMOUSLY. CITIZENS' COMMENTS Johnathan Strong spoke regarding a similar use determination application that he submitted regarding small assisted living homes. PUBLIC HEARINGS A. CASE 21-002. Request a rezone of Lots 1, 2 & 3, Block 13, Aleutian Homes Subdivision, from R2-Two-Family Residential District to UNC — Urban Neighborhood Commercial District (KIBC 17.205). Kodiak Island Borough Planning & Zoning Commission Minutes September 16, 2020 Page 1 of 5 COMMISSIONER SCHMITT moved to recommend the rezone of Lots 1, 2 & 3, Block 13, Aleutian Homes Subdivision, from R2 - Two -Family Residential District to B - Business (KIBC 17.205) and to forward the proposed rezone to the Kodiak Island Borough Assembly for further review and consideration, and adopt the findings of fact in the staff report dated August 24, 2020 entered into the record for this case as "Findings of Fact" for Case No. 21-002. Janel Day gave a staff report. Chair Townsend opened the public hearing. Cache Seel spoke regarding his plans and intent for this property. Chair Townsend closed the public hearing. Commission discussion FINDINGS OF FACT Rezoning the subject parcel: 1. Is consistent with the overall commercial corridor trend seen in the current zoning along Lower Mill Bay Road and Mill Bay Road; 2. Would provide for new commercial and housing opportunities in the immediate area; 3. Would increase the borough's tax base; and 4. Is consistent with the goals and objectives of the 2008 Kodiak Island Borough Comprehensive Plan. ROLL CALL VOTE ON MOTION CARRIED FIVE TO ZERO. B. CASE 21-003. Request a rezone of a portion of Tract 37, Township 30 South, Range 29 West, Section 32, Seward Meridian from C — Conservation to R1 — Single Family Residential and PL — Public Use Land (zoning will correspond to lots created by abbreviated subdivision S21-002). COMMISSIONER CROSS moved to recommend the rezone of a portion of Tract 37, Township 30 South, Range 29 West, Section 32, Seward Meridian from C — Conservation to R1 — Single Family Residential (proposed Lot 2) and PL — Public Use Land (proposed Lot 1), subject to the recommended effective clause in the staff report dated August 20, 2020, to forward the request to the Kodiak Island Borough Assembly for further review and consideration and to adopt the finding of fact as provided in the Staff report. Director Welty gave a staff report. Chair Townsend opened the public hearing. Randy Blondin spoke in opposition to Case No. 21-003. Chair Townsend closed the public hearing. Rezoning the subject parcel is required to facilitate subdivision of the parcel. 2. Rezoning the parcel to correspond with the proposed lots granted preliminary approval would bring the parcel/s from non -conforming to conforming in accordance with current use and minimum lot size requirements. 3. The land exchange that will be facilitated by the rezone and subdivision of this parcel will benefit the community of Larsen Bay. 4. This rezone request is consistent with the goals and objectives of the 1984 Larsen Bay Comprehensive Plan. ROLL CALL VOTE ON THE MOTION CARRIED FIVE TO ZERO. C. CASE 21-001. Request an ordinance amending various chapters of KIBC Title 17 (Zoning) to address issues such as necessary updates, corrections, and procedural clarifications. COMMISSIONER SCHMITT moved to recommend that the Assembly of the Kodiak Island Borough approve the ordinance amending Title 17 (Zoning), and adopt the findings of fact in the staff report dated August 20, 2020 entered into the record for this case as "Findings of Fact' for Case No. 21-001. Director Welty gave a staff report. Chair Townsend opened the public hearing. Seeing and hearing none, Chair Townsend closed the public hearing. Commission discussion. COMMISSIONER CROSS moved to amend the motion to strike changes to KIBC 17.175.05. ROLL CALL VOTE ON MOTION TO AMEND CARRIED FIVE TO ZERO. FINDINGS OF FACT 1. Amendments to Title 17 will address outdated references, and errors and omissions, and will provide procedural clarifications and expanded development options. 2. This ordinance is consistent with local government and land use goals and implementation actions identified in the 2008 Comprehensive Plan. 3. The Planning and Zoning Commission recommended that the Borough Assembly approve this ordinance. ROLL CALL VOTE ON MOTION AS AMENDED CARRIED FIVE TO ZERO. Abbreviated and Final Approvals - Subdivisions STAFF COMMENTS DirectorWelt welcomed Commissioner Harrington to her first meeting and announced that Janel Day would be leaving the department to accept a position with the Municipality of Anchorage. CITIZENS' COMMENTS — None. COMMISSIONER COMMENTS Commissioner Cross complimented staff on the content of the agenda packet. Commissioner Schmitt commented regarding amendments to the comprehensive plan and noted his preference for rotating the order of voting. Commissioner Delgado complimented staff on the thoroughness of the content of the packet and welcomed Commissioner Harrington. Commissioner Harrington expressed gratitude for her opportunity to serve on the Commission. She commended Mr. Blondin for being willing to take part in the public comment process. She noted that if valuation were involved in every decision that came before them, it would significantly complicate the Commission's ability to follow the rules they are charged to keep. Commissioner Townsend spoke regarding the public comment process, noted his preference for rotating the order of voting, wished Ms. Day good luck on her new adventures, and appreciated the paper packet.
