PLEDGE OF ALLEGIANCE CHAIR TOWNSEND led the pledge of allegiance. ROLL CALL The Chair shall cause the record to reflect the absence of the member, the REASON for the absence, and whether the absence is excused by the Commission. Joe Delgado requested to be excused due to being out of town for work. Commissioners present were Dave Townsend, Duane Dvorak, Alan Schmitt, and Kent Cross. Excused was Joe Delgado. A quorum was established. CDD staff present was Erin Welty and Sheila Smith. DVORAK MOVED to excuse Joe Delgado. The applicant is Alutiiq Aviation Services Inc. COMMISSIONER SCHMITT MOVED to adopt the findings in the staff report dated August 7, 2019 as "Findings of Fact" for Case 519-014. FINDINGS OF FACT (In support of denial) 1. The comment letter from the City of Kodiak Public Works indicates that the city still sees value in maintaining this right-of-way for future utility use by the public. 2. Evidence exists to confirm the recreation and transportation value of this right-of-way for the public. 3. The potential need for this right-of-way for road purposes still exists. 4. This request for vacation unduly diminishes the public's interests. 5. This request for vacation would unduly prejudice surrounding private property interests. ROLL CALL VOTE ON MOTION CARRIED 4-0. B. CASE 20-001. Request a review, according to KIBC 2.105.030.A, of the Near Island Development Plan — Concept A — Minimized Development, as adopted by the City of Kodiak, as a proposed new element of the Kodiak Island Borough Comprehensive Plan once adopted by the Assembly. The applicant is the City of Kodiak and the agent is Mike Tvenge. The location is Near Island and the zoning varies. COMMISSIONER DVORAK MOVED to recommend to the Borough Assembly to review the Near Island Development Plan Concept A — Minimum Development, December 2017 by the City of Kodiak and DOWL and that it be adopted as a component to the Kodiak Island Borough 2000 Comprehensive Plan Update and to adopt the findings in the staff memo dated August 1, 2019 as "Findings of Fact" for Case 20-001. The City of Kodiak has forwarded to the Planning and Zoning commission a request to adopt the Near Island Development Plan 2017 Concept A — Minimum Development. 2. The Commission recognized the substantial public input and quality of this work product by DOWL and the City of Kodiak in the development of this plan. 3. CASE 19-027. (Postponed at the July Regular Meeting). Request a Variance to allow the replacement and expansion of a grandfathered arctic entry that will encroach 8 feet into the required 25 foot setback, making a total encroachment of 20.7 feet on Lot 2, Block 6, Erskine Subdivision (KIBC 17.80.040.A and 17.195). The applicant is St. Herman's Theological Seminary and the agent is Michael Hoffman. The location is 413 Mission Road and the zoning is B -Business. The applicant has withdrawn the request, no action taken. D. CASE 19-030. (Postponed at the July Regular Meeting). Request an ordinance amending KIBC Chapters 17.160 KIBC (Accessory Buildings and Accessory Dwelling Kodiak Island Borough August 21, 2919 Regular Meeting Planning and Zoning Commission 2 of 4 Units), and related chapters 17.65 KIBC (RR -Rural Residential) and Chapter 17.70 (RRA — Rural Residential One District) to change permitted uses, conditional uses and development standards related to parking and size limit. The applicant is the Kodiak Island Borough. The location and zoning is Borough -wide. Motion on the Table from the 7/17/19 P&Z RM: COMMISSIONER DVORAK MOVED to recommend that the Assembly of the Kodiak Island Borough approve the ordinance amending Chapter 17.160 KIBC (Accessory buildings and accessory dwelling units) and related chapters 17.65 (RR -Rural Residential) and Chapter 17.70 (RR1-Rural Residential One District) to change permitted uses, conditional uses and development standards related to parking and size limit, and adopt the Findings of Fact in the staff report dated July 3, 2019 for this case as "Findings of Fact" for Case 19-030. FINDINGS OF FACT 1. Based on applications to Planning and Zoning, the 480 square foot size limit does not satisfy the needs of many ADU applicants. 2. This ordinance is consistent with local government, land use and housing goals and implementation actions identified in the 2008 Comprehensive Plan. 3. The Planning and Zoning Commission recommended that the Borough Assembly approve this ordinance. ROLL CALL VOTE ON MOTION TO AMEND CARRIED 4-0.
