ROLL CALL Requested excusal was Dave Townsend. Commissioners present were Scott Arndt, Barry Altenhof, Maria Painter, and Chris Hatch. Excused was Dave Townsend. A quorum was established. COMMISSIONER HATCH MOVED to excuse Dave Townsend for business travels. VOICE VOTE ON MOTION CARRIED UNANIMOUSLY Community Development Department staff present was Jack Maker and Sheila Smith. CASE 19-011. Request an ordinance of the Kodiak Island Borough amending KIBC 17.205 (Amendments and Changes) to incorporate procedures for changing the Comprehensive Plan Future Land Use Designation for approved rezones that are not consistent with the assigned Comprehensive Plan Future Land Use Designation (KIBC17.205). The applicant is the Kodiak Island Borough. The location is borough -wide, and the zoning varies. COMMISSIONER ALTENHOF MOVED to recommend that the Assembly of the Kodiak Island Borough approve the ordinance amending Chapter 17.205 (Amendments and Changes) to incorporate procedures for changing the Comprehensive Plan Future Land Use Designation for approved rezones that are not consistent with the assigned Comprehensive Plan Future Land Use Designation, and adopt the findings of fact in the supplemental staff report dated November 8, 2018 entered into the record for this case as "Findings of Fact" for Case No. 19-011. Recently, the manager through the mayor directed staff to no longer process these. Open public hearing: None Close public hearing: Commission discussion FINDINGS OF FACT 1. A rezone of a parcel or parcels that is not consistent with the Comprehensive Plan Future Land Use Designation (FLUD) assigned to the subject parcel or parcels may be approved if the rezone is consistent with, and further implements, a sufficient number of Comprehensive Plan goals, policies, and implementation actions. 2. When such rezone requests have been approved, the FLUD has correspondingly been changed to a designation that is consistent with the new zoning. 3. Title 17 (Zoning) of the Kodiak Island Borough Code provides no specific process for changing the FLUD when such rezones are approved. 4. The rezone procedures listed in KIBC 17.205 (Amendments and Changes) have historically been used to process such FLUD changes as a separate request that proceeded the corresponding rezone request. That procedure resulted in a duplicate process that created unnecessary administrative burdens for the applicant, staff, Planning and Zoning Commission, and Borough Assembly. 5. These amendments to KIBC 17.205 (Amendments and Changes) incorporate specific procedures that eliminate those administrative burdens by automatically changing the FLUD of a parcel or parcels to a designation that is consistent with an approved corresponding rezone of the parcel or parcels. 6. This ordinance is consistent with, and will further implement, certain land use goals and implementation actions identified in the 2008 Comprehensive Plan. 7. The Planning and Zoning Commission recommends that the Borough Assembly approve this ordinance. ROLL CALL VOTE ON MOTION CARRIED 4-0. OLD BUSINESS A. Case 19-004 (Postponed at the October 17, 2018 regular meeting). Request to adopt Findings of Fact in support of the Commission's denial of a Rezone of Lot 26A, U.S. Survey 3098 from R1 -Single -Family Residential District to B -Business District (KIBC 17.205). The applicant is James Cole. The location is 110 Bancroft Drive and the zoning is R1 -Single-family Residential. CHAIR ARNDT stated that we don't have four votes to pass this so he would entertain a motion to postpone this to the December regular meeting. COMMISSIONER ALTENHOF MOVED to postpone to the December 19, 2018 regular meeting. Discussion ROLL CALL VOTE ON MOTION CARRIED 4-0. NEW BUSINESS None COMMUNICATIONS A. None STAFF COMMENTS Maker said goodbye to the outgoing chair and he told COMMISSIONER ALTENHOF that he will be the chair for the remainder of the year. He also pointed out that we have vacancies if anyone has any interest. Also, a couple of our sitting commissioner's terms are up this year and if you plan to re -apply he would recommend you do that as soon as possible so we can get you on a meeting so there is no overlap. We could very well find ourselves in dire straits and short on commissioners. COMMISSIONER COMMENTS Maria Painter congratulated Scott Arndt on his seat on the assembly. It's been a great five years with you. Scott Arndt said that he enjoyed his time on the commission. When he started five years ago, it was very contentious and dealing with the code rewrite, which was a mess, we ended up in the largest meeting ever held, which had to be held in the auditorium, that was his first meeting as chair. It's been enjoyable and he's hoping to help clarify some things at the assembly level that have got messed up in the past. Arndt thanked everyone for all their support, it's been a pleasure working with everyone. ADJOURNMENT COMMISSIONER HATCH MOVED to adjourn the meeting.
