ROLL CALL Commissioners present were Scott Arndt, Barry Altenhof, Chris Hatch, Dave Townsend, and Jay Baldwin. Excused was Maria Painter. A quorum was established. Community Development Department staff present was Jack Maker and Daniel Mckenna-Foster. COMMISSIONER HATCH MOVED to excuse Maria Painter. A) 17-027 (Postponed at the June 21, 2017 regular meeting). Request a Variance to allow an existing single-family residence to encroach 14' into the required front yard setback and 2 feet into the required side yard setback on Lot 9, Block 2, Port Lions Subdivision (KIBC 17.75.050.A&B and 17.195). The applicant is Roy Fairman. The location is 415 Bayview Drive, Port Lions, and the zoning is R1 -Single-family Residential. Case 17-027 postponed at the June 21, 2017 Motion on the floor made at the October 19, 2016 regular meeting: COMMISSIONER PAINTER MOVED to approve a variance to allow an existing single-family residence to encroach 14 feet into the required front yard setback and 2 feet into the required side yard setback on Lot 9, Block 2, Port Lions Subdivision (KIBC 17.195 and KIBC 17.75.050) subject to the condition outlined in the staff report, and to adopt the findings of fact listed in the staff report dated May 18, 2017 and entered into the record as "Findings of Fact" for Case No.17-027. Kodiak Island Borough Planning & Zoning Commission Guidelines June 27, 2018 Page 1 Mckenna-Foster reported this case was postponed several times and one condition that the commission was looking at was the applicant provide an as -built which he submitted last week. The as -built showed there is no side yard setback encroachment but there is an increased front yard encroachment of 19 feet instead of 14 feet as originally presumed. The main motion on the floor should be amended to reflect the actual variance required. Since a greater variance is required it would be prudent to re -advertise this case and any amended requests must be re - noticed so to accommodate that notice the request must be postponed until the August 15, 2018 regular meeting. He said Maker pointed out that because the motion was already on the table we couldn't approve or change this language without, it would be better to go through the process of re -advertising it with the correct language. Kodiak Island Borough Planning & Zoning Commission Guidelines June 27, 2018 Page 2 None STAFF COMMENTS Jack Maker said it is public record so he's going to email everyone Director Sara Mason's uniform table of minor offenses presentation for those of you who weren't there for that, as well as the audio minutes for the meeting where she gave that presentation. He also said there is only one discussion item on the joint work session agenda which is to establish potential Title 16, 17, & 18 Code Revision priorities based on all the past discussions. Scott Arndt wanted to know where we are on Killarney Hills and what are the next steps. He heard we were getting comments so maybe that is something we can discuss at our next work session. Daniel Mckenna-Foster said re: Killarney Hills, we are still accepting feedback to lead into the Scenario/Development phase. If we don't have enough basic information about existing conditions and possible opportunities or constraints we won't be able to provide a very comprehensive background to the public to develop the scenarios. We just haven't gotten enough from the community to give anything to the public. Last night we had a Parks and Recreation Committee meeting and we spent quite a bit of time talking about the Parks and Rec Comprehensive Plan Update and he thinks they made good progress. COMMISSIONER COMMENTS Dave Townsend thanked Julie Kavanaugh for coming to their meetings. Barry Altenhof said he hasn't seen anything in the paper about Killarney Hills. He doesn't know when the last notice went out or if there has been anything in the newspaper. Whatever direction this process takes, it will have a huge impact. Scott Arndt said he attended the assembly meeting and requested the borough not to stop the advertising in the Kodiak Daily Mirror which is scheduled to stop on July 1s'. It is a cost of $10,000 that is money well spent. There are a lot of people that use that notification notice for the different meetings that he needs to go to. He is hopeful that they will rescind the previous action from the budget and continue to advertise. He will bring it up again at a future assembly meeting.
