This is in response to your May 5, 2017, application for a Department of the Army
(DA) permit on behalf of Mill Bay Investments, to discharge 200 cubic yards of clean
shot rock into .10 acres of waters of the U.S., in order to construct a parking lot for
nearby businesses. It has been assigned file number POA -2017-243, Lilly Lake which
should be referred to in all future correspondence with this office. The project site is
located within Section 32, T.27 S., R. 19 W., Seward Meridian; USGS Quad Map
Kodiak D-2; Latitude 57.8001 N., Longitude 152.3850 W.; Kodiak Borough, Lots 22, 23,
and 24 Airport Park Subdivision, 1615 Mill Bay Road in Kodiak, Alaska.
Based on our review of the information you furnished and available to us, we have
preliminarily determined the above property contains waters of the United States (U.S.),
under the Corps' regulatory jurisdiction. See the attached Preliminary Jurisdictional
Determination (PJD) Form. Please sign and return the form to our office. A PJD is not
appealable.
DA permit authorization is necessary because your project would involve placement
of fill material into waters of the U.S. under our regulatory jurisdiction.
Based upon the information and plans you provided, we hereby verify that the work
described above, which would be performed in accordance with the enclosed plan
(sheets 1-3), dated May 5, 2017, is authorized by Nationwide Permit (NWP) No. 39,
Commercial Development. NWP No. 39 and its associated Regional and General
Conditions can be accessed at our website at:
