A RESOLUTION OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH TO DISPOSE
OF A t 35 ACRE PORTION OF THE REMAINDER OF LOT 1, U.S. SURVEY 2539 BY
DIRECT NEGOTIATION OF A LEASE AT FAIR MARKET VALUE TO B&R FISH
BYPRODUCTS INC. FOR THE PURPOSES OF RESOURCE EXTRACTION AND
STOCKPILING (P & Z CASE NO. 17-013)
WHEREAS, Kodiak Island Borough Code (KIBC) 18.20.060 allows citizens to apply for a
disposal of interest in Borough land; and
WHEREAS, the Kodiak Island Borough received a request from B&R Fish Byproducts Inc. for
the disposal of a t 35 acre portion of the Remainder of Lot 1, U.S. Survey 2539 by direct
negotiation of a lease at fair market value for the purposes of resource extraction and
stockpiling; and
WHEREAS, KIBC 18.20.030 requires each proposed disposal of Borough land to be reviewed
by the Planning and Zoning Commission before submission to the Assembly; and
WHEREAS, the Planning and Zoning Commission is required under KIBC 18.20.030 to make
a recommendation to the Assembly by resolution regarding the proposed land disposal; and
WHEREAS, the principal purpose of the Planning and Zoning Commission review is to
consider if the land identified is surplus to the Borough's need; and
WHEREAS, the Planning and Zoning Commission has found that the identified portion of the
subject parcel selected for disposal is surplus to the public's need based on its review; and
WHEREAS, the Planning and Zoning Commission held a public hearing on January 18, 2017
and is recommending the disposal of the site listed below.
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH that
Section 1: The Kodiak Island Borough Assembly, in accordance with Title 18 of the Kodiak
Island Borough Code, approves the disposal of the t 35 acre portion of the
Remainder of Lot 1, U.S. Survey 2539, generally identified in Exhibit A.
Section 2: The Kodiak Island Borough Planning & Zoning Commission, in accordance with
Title 18 of the Kodiak Island Borough Code, has determined, after a public
hearing on January 18, 2017, that the aforementioned property is surplus to the
public's need.

Section 3: The Kodiak Island Borough Assembly authorizes the Borough Manager to
negotiate a lease of the aforementioned property at fair market value to B&R Fish
Byproducts Inc. for the purposes of resource extraction and stockpiling.
