Between Lots 3 and 4 and Lot 10, Block 19, Kodiak Townsite The Community Development Department would like to thank you for your efforts to comply with the Planning and Zoning Commission's requirement that the Sheffield Hotel provide additional screening between business] and residential lots as a condition of approval for the above -referenced case. Based on an August 14, 1985 site inspection, I have determined that the spruce trees planted so far meet or exceed the three-foot height and; 6 -foot spacing stipulations of the planting condition. I have shown the "extent of the trees planted in green on the attached map. 1 have also indicated in red the area for additional trees to be planted in order to achieve full compliance with the screening requirement. I would also like to confirm our discussion of August 14, 1,1985 as to the timing for planting the remaining trees. As we agreed, it is presently impractical to plant the additional trees due to the construction activity taking place on Lots 15A and 16, Block 19, Kodiak Townsite':. Once the piles of, earth are moved or removed from lots 15A and 16, the Sheffield Hotel will plant the remaining trees. The Community Development Department will periodically monitor the construction activity in order to determine when planting should begin. If construction is completed during the fall or winter, the trees will not have to be planted until the fCllowing spring planting season. The Planning and Zoning Commission made a finding at the December 14, 1983 special meeting that permitted additional parking, required as part of the hotel's expansion plans, to be located on a lot that was not adjacent to the hotel as required by Section 17.57.030 of the Borough Code. As part of this approval the Commission reserved the right to specify screening between these business lots and adjacent residential lots. Our department received a letter from an adjacent property owner asking the Commission to review the screening provided and determine if it satisfied the intentions of the Commission as provided in the original approval. The Commission, at their September 19, 1984 meeting, approved a motion to require additional screening in the form of three (3) foot spruce trees at six (6) foot intervals along the entire boundary between business and resi- dential lots. Any action of the Commission may be appealed. A written notice of appeal must be filed at the City Clerk's office ten (10) days subsequent to the Commission's decision. Findings of Fact for denial of a request for an Exception from Section 17.17.020 (Permitted Uses) of Borough Code to permit the extraction of approximately 90,000 cubic yards of rock material from a rural residential lot; Lot 2, Block 3, Monashka Bay Alaska Subdivision. (Arnold Tweten) TABLED from July 18, 1984. COMMISSIONER HILL MOVED TO REMOVE CASE 84-083 FROM THE TABLE. The motion was seconded and CARRIED by unanimous voice vote. COMMISSIONER HILL MOVED TO ADOPT AS FINDINGS OF FACT; 1. The request does not meet the conditions for granting an exception in that it: a. Is inconsistent with the general purpose and intent of the rural residential zoning district; and b. It will adversely impact other properties and uses in the neighborhood. These adverse impacts include: excessive noise due to blasting and rock removal on site, and a radical change in the character of the neighborhood. 2. The proposal to remove large quantities of rock from this lot is not the sole alternative to develop this lot; and 3. Adverse public testimony. COMMISSIONER KNIGHT noted that the applicant's testimony was not clear on his development plan, and he felt that the applicant wanted to negotiate on the amount of rock to be extracted. COMMISSIONER KNIGHT MOVE TO AMEND THE MOTION BY ADDING: 4. The applicant did not have a concrete development plan as a specific figure on the amount of rock he wanted to remove from the site. Regular Meeting -11- September 19, 1984 September 13, 1984 Linda Freed Kodiak Island Borough Kodiak, Alaska 99615 Dear Ms. Freed: Please accept this as a request to have the consideration granted the Kinnert's at this week's P&Z meeting extended to include my property. I am the owner of Lot 16, Block 19 Kodiak Subdivision, and am immediately adjacent to the Kinnert property. My lot also overlooks the Sheffield Hotel and would suffer, from the same issue of privacy as their home. I understand the considera- tion was to place trees rather then a fence and I am delight- ed at that solution. It is most appropriate and I applaud the decision. I would also add that it would save the Sheffield House some money to accomplish this at the same time the Kinnert's lot is addressed. I am also certain. that Joyce Gregory, who is the owner of lot 15-A, Block 19 Kodiak"Subdivision would also desire the same consideration. By addressing all three lots simultaneously it would forever satisfy the problem. Thank you for your consideration of my request. The Commission made a finding that it was impractical to locate the re- quired parking of the Sheffield Hotel Expansion "on the lot.of the building or an adjacent lot" in December 1983. A condition of approval included: "That the Planning and Zoning Commission reserves the right to specify screening between the applicant's business lot and adjacent residential lots." Mrs. Kathryn Kinnear wrote to the Commission asking for a review of the landscaping, feeling it was not adequate. Her suggested; solution is to plant small spruce trees in such a manner that a screen would be created as they mature. Recommendations Staff recommends that a screen has not been provided between the lots and uses in question and the planting of 3 foot spruce trees', 6:feet apart would provide adequate buffering. Please be advised that the Planning and Zoning CommissiOn, at a Special Meeting of December 14, 1983, took action on your request for a finding under Section 17.57.030 of the Borough Code. At the meeting, the Commission unanimously passed the following motion: "The Planning and Zoning Commission finds that it is indeed impractical for the applicant to meet Section 17.57.030 of the Borough Code, requir- ing that parking be on the lot of the building or an adjacent lot, and that the applicant be permitted to provide off-street parking per the plan reviewed at the meeting on Lots 3 and 4, Block 19, Kodiak Townsite. The motion also included the following request: "That staff note on the building permit that the Planning and Zoning Commission reserves the right to specify screening between the appli- cant's business lot and adjacent residential lots."
