The Planning and Zoning Commission at the August 15, 1984 meeting
'approved your request for a variance from Section 17.34.030 (Area
Requirements), to permit zero-lot-line construction on a lot that
exceeds the 3:1 lot depth to width ratio.
The Commission attached the following cOndition:'
"The cutting of trees is prohibited ten(10) feet beyond
the proposed dwelling unit and driveway, and within forty (40)
feet of the seventy-six (76) foot rear yard lot line common
with lot 6."
This action becomes effective ten (10) days after the date of the
Commission's decision and remains valid for twelve months. A formal
subdivision application submitted to the Engineering Department is

Mr. Maciak's letter regarding Mr„ `ten's exception request for
gravel extraction was read into t 'ecord by Ms. Freed. Mr.
' Maciak voiced total objection to any exception being granted to
Mr. Tweten and stated that gravel extraction should only occur In
industrial -zoned land when done for commercial purposes. He
stated "Mr. Tweeten's intent is to extract rock for commercial
interest in residential zone area and then decide.whether to
develop the land for residential usage."
VI PUBLIC HEARINGS
CHAIRMAN GREGG requested that public hearing testimony be limited to three
minutes per individual.
A) CASE 84 -79. An Ordinance of the Kodiak Island Borough creating a
new rural residential zoning district. (Planning and Zoning.
Commission)
Staff noted that one public hearing notice had been returned and
requested to be read into the record.

ROBIN HEINRICHS spoke in favor of creating the new zoning district. '
He felt it provided a good transition between RR1 lots and R1 lots.
Mr. Heinrichs noted that this new district would be beneficial to the
area on the back side of Island Lake where sewer and water are cur-
rently being installed.
TONY PEREZ spoke in opposition of the ordinance. Mr. Perez spoke on
behalf of the residents on Spruce Cape (USS 3100 & USS 3101) and
displayed a map showing how the residents of that area requested 7200
square foot lots for theLr area. "This is just to give you an idea
that most of the people, or a large majority of people, would like to
see the grid system maintained of 7200 feet. If people want to
subdivide their lots into larger lots that's their prerogative, but
the basic is 7200 and you work up."
TOM SIMMONS (letter read into the record by Ms. Freed) was in favor of
the ordinance. Pastor Simmons felt that the 20,000 square foot lots
would be economically beneficial to buyers by providing them smaller
lots in a lower price range. He also felt lots of that size would not
add significantly greater density of people and homes to area zoned
RR11.

COMMISSIONER RENNELL MOVED TO REMOVE CASE 84 -079 FROM THE TABLE. The
motion was seconded and CARRIED by unanimous roll call vote. .
Commissioner James suggested introducing the RR1/2 district with the new
comprehensive plan. The Commission also discussed as an alternative
revising the existing RR1 zoning district to allow 20,000 square foot
lots when sewer and water were provided. This alternative would
eliminate the need for the public hearing process each time an area
received public sewer and water and individuals wanted to subdivide
their lots.
COMMISSIONER CROWE MOVED TO TABLE CASE 84 -079 until the September 1984
meeting and directed staff to investigate revising the RR1 zoning
district. The motion was seconded CARRIED by unanimous voice vote.
B) CASE 84 -095. Request for a Variance from Section 17.34.030 (Area
Requirements) of Borough Code to permit zero -lot -line construc-
tion on a lot that exceeds the 3:1 depth to width ratio. Lot 8,
Block 4, Elderberry Heights Subdivision. (E. B. Garrington)
Staff reported that additional public hearing notices had been
returned and had been copied for the Commission.

JIM HEIKES, an adjacent property ow neither spoke for or against
the request, but requested that the nission add a condition on the
variance, if granted, to state that ''Tree contractor and /or owner shall
not cut any trees that lie outside of the existing plan for building
and driveway.' Mr. Heikes requested this condition because he was
concerned that if the trees were clear -cut off the subject property it
would cause the trees on his property to become loosened and eventu-
ally destroyed.
TOBY COOK, agent for the property owner, spoke in favor of the re-
quest. Mr. Cook assured Mr. Heikes that no trees adjacent to the two
property lines would be cut down; only the trees within a ten foot
radius of the building and driveway access were proposed to be cut
down.

COMMISSIONER CROWE MOVED TO GRANT A VARIANCE from Section 17.34.030
(Area Requirements) of Borough Code to permit a zero -lot -line
structure on a lot that exceeds the 3:1 lot depth -to -width ratio with
the following condition: ,
1. That the cutting of trees is prohibited within 40 feet of the
rear lot line that is common with Lot 6, Block 3, Russell Estates
(Second Addition).
The motion was seconded. Chairman Gregg and Commissioner Knight
questioned whether the condition would be at all enforceable by the
Borough and felt that the condition would either have to be a
gentleman's agreement between the property owners or a restriction in
the deed. A roll call vote" was taken and the motion CARRIED
unanimously.

C) CASE 84 -096. Request for a Variance from Section 17.52.060 (Main
Building) of Borough Code to permit the construction of a barn on
Rural Residential One (RR1) zoned property in the absence of a
residence. Located on a portion of U.S. Survey 1822. (Donald
and Barbara Zimmerman)
Staff reported that no public hearing notices had been received.

DON ZIMMERMAN, applicant, spoke in favor of the request. Mr. Zimmer-
man noted that the problems previously associated with this case had
been negotiated with the adjacent property owners and those problems
no longer existed. Mr. Zimmerman stated that he would agree to a
three -year time limit to build a main dwelling on the lot.
DR. BOB JOHNSON, an adjacent property owner, reported that an"agree-
ment had been negotiated between the parties involved and that there
was no longer any objection to the request.

COMMISSIONER HILL MOVED TO GRANT A REQUEST FOR A VARIANCE from Section
17.52.060 (Main Building) of Borough Code to permit the construction
of an agricultural building (horse barn) in the absence of a main
dwelling used as a residence on a portion of U.S. Survey 1822. The
motion was seconded. Commissioner Crowe expressed concern that
property owners or circumstances could change and that all that would
remain on the subject property would be a barn on a residential piece
of land. COMMISSIONER PATTERSON MOVED TO AMEND THE MOTION BY ADDING:
1. That, if within three years, the main residence has not been
built that the barn be removed; and
2. That if the ownership of that lot changes, the barn be removed.
The amendment was seconded and CARRIED with Commissioner Rennell
voting NO.
A roll call vote on the main motion as amended was taken and CARRIED
with Commissioner Rennell voting NO.

RE: CASE 84-095. Request for a Variance from Section 17.34.030 (Area
Requirements) of Borough Code to permit zero-lot-line construc-
tion on a lot that exceeds the 3:1 depth-to-width ratio. Lot 8,
Block 4, Elderberry Heights Subdivision. (E. B. Garrington)
Twenty-seven (27) public hearing notices were mailed on August 2, 1984.
1. Applicant: E.B. Garrington, 7470A SR, Kodiak, AK 99615.
2. Land Owner: Same as applicant.
3. Request: Request for a variance from Section 17.34.030 (Area
Requirements) of Borough Code.
4. Purpose: The purpose of this request is to construct a zero-lot-line
structure.
5. Existing Zoning: R2.
6. Zoning History: The 1968 Comprehensive Plan indicates this area as
"Residential-Unclassified." On April 3, 1980, all Unclassified land was
zoned to Rural Residential. In 1981, Ordinance 81-26-0 rezoned this
area from Rural Residential to R2.
7. Location: Lot 8, Block 4, Elderberry Height Subdivision, Fourth
Addition; no physical address assigned (Lynden Way).
8. Lot Size: 13,399 square feet.
9. Existing Land Use: Vacant.

11. Comprehensive Plan: The Comprehensive Plan indicates the area as
"public and open space."
12. Applicable Regulations: Chapter 17.34 (Zero- Lot -Line Development),
Section 17.34.030B (Lot Width) states "The minimum lot width is thirty
feet per dwelling unit, with a depth -to -width ratio not to exceed
three -to -one (3:1)."
COMMENTS:
The proposed zero -lot -line structure will be offset between the two
residential units to take advantage of the odd lot configuration as well as
the topography to maximize the view to the southeast. The lot has ample
area to qualify for a zero -lot -line development, but does not meet the
required lot depth -to -width ratio of 3:1.
The lot has a strange configuration because of a 4560 square foot
parcel that has been added to the rear of the lot and the cul -de -sac at the
front. Calculations indicate that the depth -to -width ratio for this lot is
not met. Physical characteristics of the lot provide some mitigation for
this deficit. If a straight line is drawn across the front of the lot
below the curve of the cul -de -sac, the width of the lot averages 87 feet and
the depth averages 155 feet. Although these measurements do not allow the
lot to meet the 3:1 ratio, these measurement bring the calculation closer.
Much of the extra 32 feet in lot depth is necessary for practical access to
the building site on the lot. The lot sits above the grade of Lynden Way
by approximately twelve feet, and the distance into the lot needed for a
safe and practical access will require the house to sit further back on the
lot than the minimum setback requirement. All these factors affect the
impact of the lot depth -to -width ratio.
The proposed offset design of the proposed zero - lot -line structure fits
the shape and topography of the lot and also meets the following
requirements for granting a variance.
1. Exceptional physical circumstances or conditions applicable to the property
or intended use of development, which generally do not apply to other
properties in the same land use district.
The lot's strange configuration makes the normal determination of
required setbacks difficult. The topography of the area is such that
the lot sits twelve feet above Lynden Way.
2. Strict application of the zoning ordinances would result in practical
difficulties or unnecessary hardships.
The required three -to -one ratio, though generally appropriate, is
difficult to meet because of the irregular shape of the lot and the
lot's height above road grade. The strict application of the zoning
ordinance would not allow this lot to be developed for a zero -lot -line
structure.

. The granting of the variance will not result in material damages or
prejudice to other properties in the vicinity nor be detrimental to
the public's health, safety, and welfare.
The lots in this area are vacant with R2 zoning. Duplexes and other
zero-lot-line structures are permitted in the neighborhood.
4. The granting of the variance will not be contrary to the objectives of
the Comprehensive Plan.
The property is zoned residential and will remain in residential use.
RECOMMENDATION:
Staff recommends approval of this variance request because it fulfills the
requirements for granting a variance.
APPROPRIATE MOTION:
Move to grant a variance from Section 17.34.030 (Area Requirements) of
Borough Code to permit a zero-lot-line structure on a lot that exceeds the
3:1 lot depth-to-width ratio.

17.34.030 Area Requirements. A. Lot Area. The minimum lot area
required is 4,000 square feet per dwelling unit, not including water bodies
or private roads.
B. Lot Width. The minimum lot width is thirty feet per dwelling
unit, with a depth -to -width ratio not to exceed three -to -one.
17.34.040 Yards. The required setbacks for front and rear yards are
identical to those found in the specific zoning district in which the
zero -lot -line development is located. The common -wall side yard setback is
abated, with the opposite side yard setback being a minimum of ten feet.
17.34.050 Bui]ding Height. The maximum building height permitted is
two - and -one -half stories or thirty -five feet.
17.34.060 Maximum Lot Coverage. The maximum lot coverage allowed
(including accessory buildings) is fifty percent.
17.34.070 Accessory Building. One accessory building per dwelling
unit is permitted.
17.34.080 Special Agreements. A. A common -walL agreement running
with the land shall be placed as a note on the plat.
B. Construction shall be performed in pairs with no future enlarge-
ment or additions of the principal structure allowed.
17.34.090 Site Plan Requirement. Developments of more than three
common -wall structures shall provide a site plan containing the information
' required by Section 17.67.030. Said site plan shall be reviewed and
approved by the planning commission prior to issuance of a building permit.

17.34.010 Description and Intent. Common-wall development standards
are established to permit the construction of single-family attached
dwellings where one common wall is shared by adjacent dwelling units. The
shared wall also corresponds to a side lot line. The land under each unit
is in separate ownership.
In creating these standards, the specific intentions of this chapter
are:
