RESOLUTION NO. 84 -104 —R
A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY AUTHORIZING
LANDSALE NUMBER NINE AND ESTABLISHING ITS TERMS.
WHEREAS, the Borough Assembly and the Planning and Zoning Commission
have determined the below listed lands are surplus to the Borough's needs, and
WHEREAS, the Borough Assembly must determine the terms and
conditions under which the lands will be offered, and set the sale date.
NOW, THEREFORE, BE IT RESOLVED by the Borough Assembly that in
accordance with Title 18 of the Borough Code, it authorizes the Borough
Manager or his designee to offer the following land parcels for sale at a
public outcry auction on Saturday, November 17, 1984:
1. Lot 1, Sawmill Subdivision
2. U.S. Survey 1701 (Shuyak Island area)
3. Tract R, Russian Creek Alaska Subdivision
4. Lot IA, Block 1, Chiniak Alaska Subdivision
5. Lot 1B, Block 1, Chiniak Alaska Subdivision
6. Lot 16, Block 2, Chiniak Alaska Subdivision
7. Lot 17, Block 2, Chiniak Alaska Subdivision
8. Lot 7A, U.S. Survey 3098
9. Lot 9A, U.S. Survey 3098
BE IT FURTHER RESOLVED by the Borough Assembly that parcels sold at
Land Sale Number Nine shall be subject to the following terms and conditions:
1. The said parcel shall be appraised at fair market value as
determined by the Borough Assessor or his designee;
2. The required minimum down payment at the time of sale shall be
twenty percent (20 %) of the amount bid for Parcels 8 and 9, and ten percent
(10 %) of the amount bid for Parcels 1 through 7;
3. The term of the loan for the unpaid balance shall be ten (10)
years for Parcels 1 through 7, and five (5) years for•Parcels 8 and 9;
4. The interest rate on the unpaid balance shall be ten (10)
percent per annum;
5. Level term monthly payments shall be required paying off the
promissory note for the unpaid balance;
6. The purchaser shall execute a promissory note for the unpaid
balance plus the interest and a deed of trust on the property to secure
payment of the note; and
7. Unsold parcels shall be reoffered again at the conclusion of
offering Parcel Nine. Any remaining unsold parcels shall then be made
available over the counter at 9:00 a.m., November 20, 1984 at the Finance
Director's office.
8. Parcel 1, Sawmill Subdivision, is to be offered with a
preference right to the former lessee to meet the high bid. The improvements
on the property are to be appraised separately. If the preference right
holder does not meet the high bid the new owner is to pay the preference right
holder the appraised value for the improvements. The parcel is to be offered
subject to a foot wide setback along the Monashka Bay Road right -of-
way.
9. Parcel 2, U.S. Survey 1701, is to be offered with a preference
right to the former lessees to meet the high bid. The improvements on the
property are to be appraised separately. If the preference right holders do
not meet the high bid the new owner is to pay the preference right holders
the appraised value for the improvements located on the property.

A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY RECOMMENDING THE
DISPOSAL OF CERTAIN BOROUGH PROPERTIES.
WHEREAS, Title 18 of the Borough code requires that the disposal
of Borough land be reviewed by the Planning and Zoning Commission; and
WHEREAS, Title 18 of the Borough code requires that the Commission,
by resolution, shall make a recommendation to the Assembly regarding this
proposed land disposal;
WHEREAS, a need exists to place surplus, publicly -owned lands into
the private sector; and
WHEREAS, the Borough owns land suitable for disposal at a public
sale.
NOW, THEREFORE, BE IT RESOLVED that the Kodiak Island Borough
Assembly recommends that the following parcels should be declared excess to
the Borough's needs and therefore offered for sale:
1. Tract R, Russian Creek Subdivision;
2. Lots 1, 2, and 3, Block 1, Chiniak Alaska Subdivision; and
3. Lots 16 and 17, Block 2, Chiniak Alaska Subdivision.

RE: CASE 84-074' Request for Review by the Planning and Zoning
Commission, under Section 18,20,030, to recommend on the
disposal of Borough land:
Lot 7, Block 2, Monashka Bay Alaska Subdivision (Bay View Drive);
Lots 1, 2, & 3, Block 1, Chiniak Alaska Subdivision (Cape Chiniak Road);
Lots 16 and 17, Block 2, Chiniak Alaska Subdivision (Cape Chiniak Road);
Tract R, Russian Creek Alaska Subdivision (Gara Drive); and
A portion of Lot 1, U.S' Survey 2539 (Nixon Ranch).
In November of 1982, the Planning and Zoning Commission resolved that
a number of Borough properties should be prepared for Land Sale Number
Eight (Resolution No 82-1]6-R)' Although these properties were not
offered for sale at Land Sale Number Eight, they are ready to be offered
at Land Sale Number Nine, scheduled for September 1984'
The following properties had been previously identified by the Commission
as possibilities for disposal:
Tract R, Russian Creek Subdivision;
Lots l°2, and 3, Block 1, Chiniak Subdivision;
Lots 16 and 17^ Block 2, Chiniak Subdiv[syon� and
A portion df Lot 1, U.S. Suf-vay 2539 (Nlxoh Ranch).
In addition, the Borough Assembly has asked that the Planning and Zoning
Commission review for disposal:
Lot 7, Block 2, Monashka Bay Alaska Subdivision.
Staff believes that the first three sets of lots should be declared excess
to the Borough's needs, as some of them currently have squatters living
on the property. In addition, the Borough has a lease with Covey/Gould
for the Nixon Ranch which expires in March of 1985, or until a Borough
land sale involving the property is conducted. The last lot of the group
(Lot 7, Block 2, Monashka Bay Alaska Subdivison) is in a residential area
that will shortly be getting constructed road access. The lot is proposed
for rezoning from public lands to rural residential, with future subdivision
into two residential lots for disposal at Land Sale Number Nine. The need
for this lot to remain in public ownership is questionable. There are
two other larger tracts of land in the area zoned public lands that can
meet the need for the provision of public facilities in the future.

RECOMMENDATION
Staff recommends that the Planning and Zoning Commission pass the
attached resolution recommending that the following properties are
excess to the Borough's needs:
1. Lot 7, Block 2, Monashka Bay Alaska Subdivision;
2. Tract R, Russian Creek Subdivision;
3. Lots 1, 2, and 3, Block 1, Chiniak Alaska Subdivision;
4- Lots 16 and 17, Block 2, Chiniak Alaska Subdivision; and
5. A portion of Lot 1, U.S' Survey 2539 (Nixon Ranch).
