LaMont) The above referenced exception was granted by the Planning and Zoning Commission on June 19, 1985 subject to nine (9) conditions of approval, as follows: 1. The welding business will be conducted entirely within the existing structure on the lot. 2. There will be no more than one part-time employee for the welding business. 3. There will be no outside storage of any goods or materials that are part of the welding business. 4. The hours of operation will be between 8:00 a.m. and 9:00 p.m. 5. There will be no outdoor advertising or signs. 6. The property owner will allow neighbors to inspect the premises for the presence of hazardous materials. 7. All customer parking shall not block the roadway or driveways. 8. There will be no expansion of the welding business beyond the current scope of operations. 9. The exception shall be reviewed in one year by the Planning and Zoning Commission for compliance with the above conditions. This item is before the Planning and Zoning Commission for review in light of Condition #9. Staff has reviewed departmental files and can find no indication that any conditions have been violated. In addition, unannounced site inspections were conducted on May 28 and 30, 1986 and it appears that all the conditions are being met. The Kodiak Island Borough Planning and Zoning Commission at their meeting on July 17, 1985, adopted the following findings of fact in support of their June 19, 1985 decision approving -your request for the exception`, cited above: A. The proposed use will not endanger the public's health, safety, or general welfare since the conditions of approval adequately address concerns of storage of hazardous materials and potential traffic and parking problems in a residential area. B. The proposed use will not interfere with the development or continuation of single - family dwellings in the district, will not generate other than normal vehicular traffic on streets serving residents on those streets, and will not create requirements for increased public services. C. The proposed use should not adversely impact other properties in the neighborhood. The conditions of approval ensure that the use will be compatible with on -site characteristics and surrounding land uses. Exceptional physical circumstances or conditions applicable to the property or intended use of development, which generally do not apply to other properties in the same land use district. Exceptional physical circumstances and conditions exist on this lot which do not generally apply to other properties in the same RR1 district. The lot has two natural level building sites separated by a hillside, each served by an independent driveway. The original lot contained 4D,946 square feet and is presently below 40,000 square feet through correction of a property encroachment. 2. Strict application of the zoning ordinances would result in practical difficulties or unnecessary hardships. The subdivision could not take place, creating an unnecessary hardship to the property owner. 3. CASE 85-039 -1- June 19, 1985 COMMENTS: This case results from numerous citizen complaints about the operation of a welding shop (a business activity) in an R1, Single-family Residential, district. On September 21, 1983, the Planning and Zoning Commission denied a request by Mr. LaMont for a conditional use permit for a welding shop as a home occupa- tion. On April 26, 1985, the zoning officer agreed to delay legal action on the alleged business activity so that Mr. LaMont could review his alterna- tives. Pursuant to Chapter 17.18.010, business activities are not permitted in the R1 district, hence this exception request. In order to grant an exception, the Commission must find that the use proposed in the application meets all of the following: 1. That the use as proposed in the application, or under appropriate condi- tions or restrictions, will not (A) endanger the public's health, safety, or general welfare, (B) be inconsistent with the general purposes and intent of this title, and (C) adversely impact other properties or uses in the neighborhood. A. The proposed use will endanger the public's health, safety, or general welfare as granting the exception will result in the storage and use of tanks of explosive materials. An exception would also result in increased traffic and parking in a residential area. B. The proposed use will be inconsistent with the general purposes and intent of Title 17 and with the specific description and intent of Chapter 17.18, the R1, Single-family Residential, district. C. The proposed use appears to adversely impact other properties in the area. Numerous citizen complaints have been received citing concerns of (1) increased traffic, (2) increased noise from machinery, (3) outside storage of materials that could be an attractive nuisance to children, and (4) storage and use of explosive materials. RECOMMENDATION: Staff finds that this request does not meet the standards for an exception and recommends that the Commission deny this request. APPROPRIATE MOTION: Should the Commission agree with the staff recommendation, the appropriate motion is specified below.
