SPECIAL MEETING MINUTES
Friday, August 22, 2014, 6 p.m., Bayside Fire H. II g0a.ouGHCLERIC5OfF10E
The meeting convened at 6 p.m. Those present were: Chairperson Reed Oswalt, Jim
Carmichael, Fred Roberts, and Jim Schauff. Absent was Peter Ivanoff. Borough Manager
Bud Cassidy and Clerk Nova Javier were also present. Member of the public present was
Steven Ivanoff.

Items for Discussion
1. Bay View Service Area Guard Rail
The Board members discussed the following:
• Accidents in the past few years in the area
• The need for a guard rail for safety-reasons
• Steep embankment adjacent to right of way. Residents who lose control, not only
slide off the road when they attempt a right hand turn from Monashka Circle on to
Bay View Road, but continue over embankment.
• Borough ownership of the road makes the Borough responsible for guard rail
installation
• Maintenance of the road is the service area's responsibility, not guardrail
installation
• Initial construction drawings were stamped by a professional engineer but not
reviewed and verified by another person
• Because the plans were not reviewed, there are possibly liability and litigation
issues. The board advocated avoiding getting into a lawsuit
• Manager spoke with State DOT project manager regarding old "good" guardrail
that is being left in Kodiak. State DOT did verify this information.
• Bids solicited by the service area from multiple companies, lowest bid was at
$15K to install the guard rail. The quote is by the vendor who is in town installing
guardrail on the Monashka Bay repaving project. Other vendors would require a
mobilization fee. This mobilization would occur from Anchorage.
• Service Area explored the possibility of putting logs along the side of the road
instead of a guard rail, borough attorney express liability concerns.
Manager Cassidy explained that a legal opinion was being sought regarding where the
Borough responsibility ended and the Service Areas responsibility began. Once the
opinion is available from the borough attorney, it would be shared with the service area
board members.

2. Cul-de-Sac at the Bottom of Monashka Circle
Board members wished to vacate the 200 foot in diameter down to the Borough
standard 100'. Anything that was beyond the minimum borough requirement would be
transferred to the adjacent property owners. This would be beneficial for the property
owners, the service area, and the borough. Some were baffled why this cul-de-sac
ended up so big in size and they wished to find out the history behind it. Platting costs to
reduce the size of the cul-de-sac and show additional land enlarging neighboring parcels
will be the responsibility of the property owners who benefit.
Manager Cassidy noted that he would research the history of the cul-de-sac. The board
could also start this moving forward by initiating discussion with CDD Director Bob
Pederson and work at starting a draft plat. (NOTE: Mr. Ecklund passed away a number
of months ago — but he was a great source of knowledge. He surveyed in Kodiak for
approximately 40 years before passing.)

no objection, the special meeting was adjourned at 6:46 p.m.
