2012-09-06 Regular Meeting RECEIVED KODIAK ISLAND BOROUGH PROJECT ADVISORY COMMITTEE AUG - 8 2013 MINUTES September 6,2012 5:30 p.m.i the F$IC FIFICE CALL TO ORDER CHAIR VINBERG called to order the September 6,2012 Project Advisory Committee work session at 5:38 p.m. ROLL CALL Committee members present were Alan Torres,Sonny Vinberg, Dan Rohrer,Ted Panamarioff,Janet Buckingham,Mark Anderson,Oliver Holm,and Andy Shcroeder.Absent was Luke Smith.Ex-officio member Louise Stutes was absent. A quorum was established. Community Development Department staff present was Duane Dvorak,Bud Cassidy,and Sheila Smith. APPROVAL OF AGENDA COMMITTEE MEMBER ROHRER MOVED to approve the agenda. VOICE VOTE CARRIED UNANIMOUSLY MINUTES OF PREVIOUS MEETINGS COMMITTEE MEMBER TORRES MOVED to approve the March 5, 2012 minutes. VOICE VOTE ON MOTION CARRIED UNANIMOUSLY AUDIENCE COMMENTS Maria Painter showed the committee all the tabs in copy of the draft,the pink is most important,and then the orange were semi,and blue was maybe if we could get to it.She said she spoke with LSL over various issues. Some are in your packets and a lot of people made comments and her question is how are you going to review at today's meeting and discuss them so changes can be made. People have made comments and they are legitimate and she hopes you can review,discuss,and make some changes.You know my issues and hope that you will read the other comments made and make some decisions. Marie Rice stated she's been involved in agriculture since 1962 in Kalsin Bay.Over the last several years interests have been toward hoophouses and code revisions to make that a doable thing here.There are about 48 hoophouses here now.She went through the draft codes very carefully with anything that had to do with agriculture in any way,and the Soil&Conservation Board has reviewed and worked on it.A few things have been corrected and we have a written section that we would like to have consideration for re-wording. 1. Hoophouses,they went through a lot and it's in there only under residential accessory structures and it was approved to be a primary structure,on page 80-2,so it's in that section as accessory structures and she wonders who put it there.She would like it on the record that it was approved to not have to be an accessory structure. COMMITTEE MEMBER SCHROEDER arrived at 5:55 p.m. Joe Decenso,Manager of the Soil&Water Conservation District stated the board went through and in your packets of input we've already specified some sections of the code that should be re-written. Most of them are in 17.120.040. 81 through B4 and all should be re-written. B2 Duncan Fields sent comments in but 131, B3, and B4,but Decenso has a draft,we have what we think should be written and he can email it in. 17.120.040.84 is the one we spent the most time on and that specified an applicant had to meet certain requirements to raise livestock on lands not publicly owned in a RC District,and we didn't even think that was possible to do;you had to show certain things would not happen before you actually operated and there is no way anyone could do that so we re-wrote it to make it possible for proposed livestock grazing to at least be considered and we have language to that affect. It still acknowledges the concerns.This is based on a State PAC Minutes Page 1 of 3 September 6,2012 Plan for that area on the Shearwater Peninsula and that state plan even though it says the same thing is a policy statement,it's not a regulation.You are codifying this in borough code that's enforceable and it's enforceable.They have the flexibility to consider livestock grazing and he thinks the borough should too. OLD BUSINESS A) Review of the Draft Codes Discussion of the change in this document from the one submitted for public review was based on 2 meetings in the City of Port Lions and basically had LSL move them from the remote and rural category to the urban and suburban.The City of Port Lions made it clear they didn't want the mixed use-village area zone,if LSL has been paid in full or do we still owe them money, it sounds like if we don't look at these comments point by point no one else will,do we segregate the technical aspects that should be staff work and then the items that have been subjective do we want to attack those, numerous people have brought up the issue of roosters but when you order chickens you don't know if you're getting roosters or not and obviously something needs to be figured out in regards to that, why can't people who have a single dump truck business along with the fisherman keeping their fishing gear at their house but a single shiny dump truck can't be parked in their yard. One member is frustrated because of the recurring chicken thing, we told staff and LSL to go back to what we had and basically do what we had because it was working. We agreed on this 2 or 3 meetings ago. There were 3 main groups that Anderson noticed; one being the livestock issue with chickens in particular, the second was the homebased businesses storing equipment, and the third being accessory buildings, and the fourth being B&B's which kind of fit in with those last two. Dvorak said they did fix this, changes were made and maybe you don't understand the changes. It could possible take another 2 or 3 meetings to finish this and we need to be comfortable with the changes that have or not made before we make a recommendation to forward this.The committee addressed Anderson's 3 concerns. COMMITTEE MEMBER TORRES MOVED to strike in 17.80.090.B-sub paragraph S,in the second to the last sentence that reads"except that male chickens (roosters) may not be kept on a lot less than 20,000 square feet. Discussion of references to the same thing in several different locations in the codes. ROLL CALL VOTE CARRIED UNANIMOUSLY Discussion regarding horses and structures for horses. COMMITTEE MEMBER TORRES MOVED to in 17.80.90,sub-paragraph B,strike the complete last sentence that reads"Livestock such as horses and similar animals shall not be used for commercial purposes on the site,such as commercial stables or similar." ROLL CALL VOTE ON MOTION CARRIED UNANIMOUSLY COMMITTEE MEMBER TORRES MOVED to take a 10 minutes break at 6:57 p.m. VOICE VOTE ON MOTION CARRIED UNANIMOUSLY CHAIR VINBERT reconvened the meeting at 7:07 p.m. Discussion about home based businesses,accessory dwelling units,detached duplexes,and mother in law apartments. COMMITTEE MEMBER TORRES MOVED to amend the draft language for 17.40.010.D-Scheduled Uses to add an accessory line item there of detached accessory dwelling units and have it a permitted use in the RS1, RS2, and RU2 Districts. ROLL CALL VOTE ON MOTION CARRIED 7-1. The ayes were Alan Torres,Andy Schroeder,Sonny Vinberg, Dan Rohrer,Janet Buckingham, Ted Panamario[f,and Oliver Holm. The no was Mark Anderson.
