U'6--Ralifi OFFICE IAK,Ab93KA _ CALL TO ORDER CHAIR SALTONSTALL called to order the February 12, 2013 Parks & Recreation Committee Regular Meeting at 7 p.m. ROLL CALL Requested excusal was Pam Foreman,Andy Schroeder, and Jeff Huntley. Committee members present were Patrick Saltonstall, Rick Lindholm, Sandra West, Michael Marion, Helm Johnson, and Michael Scalzo. Excused members were Pam Foreman, Andy Schroeder, and Jeff Huntley. Ex-officio member present was Alan Schmitt. Absent ex-officio members were Jack Ransom,Aaron Griffin, and Steve Doerksen. A quorum was established. Community Development Department staff present was Sheila Smith. Information Technology Department staff present was Maya Daurio and Paul Van Dyke(arrived 7:45). COMMITTEE MEMBER WEST MOVED to excuse Pam Foreman,Andy Schroeder,and Jeff Huntley. VOICE VOTE ON MOTION CARRIED UNANIMOUSLY APPROVAL OF AGENDA COMMITTEE MEMBER MARION MOVED to approve the agenda as presented. VOICE VOTE ON MOTION CARRIED UNANIMOUSLY MINUTES OF PREVIOUS MEETINGS COMMITTEE MEMBER MARION MOVED to approve the January 8, 2013 and the January 22, 2013 Trail Summit minutes. VOICE VOTE ON MOTION CARRIED UNANIMOUSLY • AUDIENCE COMMENTS AND APPEARANCE REQUESTS Phillip Tschersich talked about his comments submitted on the Russian Ridge TMO's. On page 10 of the trail comments there's a map, the area on the left of thereddish color is city property and is closed to off-road vehicle use, and the area on the right of the reddish line is borough property where ATV use is allowed.The yellow line is the boundary between the borough and city. The lower reservoir is right in the center of the picture and we're aware of the partial fence around the reservoir and the access road represents a very steep berm that's impassable so quite a bit of that area would be impassable to a motor vehicle transiting north/south, and then the blue line near the top represents the service access road is what people use to use to get from town out to Monashka Bay Road as a shortcut to Monashka Bay. It's a short run from the current reservoir fence down to Monashka Bay Road so if enforcement of the current rules in the ATV closure area were to be entertained it would be easy to erect fencing from the current reservoir fence down to Monashka Bay Road. What changes attitudes is slow cultural shifts, there used to be ATV use at the end of the road at Monashka Bay and then that was designated Natural Use area. Russian Ridge has many access points and there's been so much historical use up there. Even if people are opposed to ATV use in certain areas that there's an attitude that it's always happened so we're going to look the other way. If enforcement were to occur there's already quite a bit of the ridge that's impassable to 2/12/2013 Page 1 of 4 P&R Minutes vehicles.There are still access points further out the road with rocks and signage, and gates.At least you could suggest to people that what they are doing is inappropriate and slowly cultural shifts can occur. He's not opposed to ATV use in areas where the community has decided that's what they want. Tschersich said there is a lot of cutting of mature, live trees being felled to the right side of the blue line,city property. If areas were closed to ATV's then maybe the area would be spared. EX-OFFICIO MEMBER SCHMITT suggested taking this to the city council. OLD BUSINESS A) Trail Summit Review During discussion was incorporating wording such as steepness and such not being suitable for some activities, trying to incorporate the public comments into the TMO's would have to be added as an appendices or change the TMO because there is so much public comment not just from one user group, it's across the board that live not only in town or borough but also Bells Flats, and that's who is supposed to be represented with this group. Daurio stated they're basically just documentation of the condition of the trail so it makes sense to add those comments that are specific like where these live trees are being cut, regarding general comments about what people would like or not like according to trail use she doesn't know if the TMO is the most appropriate place to store that information. CHAIR SALTONSTALL stated we aren't here to kick people out or set up to make laws; we are just an advisory board anyway. The committee directed Smith to put the April 24, 2012 Trail Summit comments on the next agenda and including this year's Trail Summit comments. B) TMO's (Maya Daurio) Daurio stated she made some changes to the TMO's and incorporated the comments that Van Dyke gave her from the Trail Summit. The specific dates have been changed and she added a map showing what trail segments are being assessed in the TMO and on the back is a map of all the trail areas to orientate you where that particular trail area is. She hasn't incorporated the comments that were on the maps themselves yet from the meeting. During discussion the committee relayed their changes for TMO's All through A13 for Daurio to incorporate for review and possible approval at the next meeting. Also re-routes were discussed due to property development, the benched and degraded areas, level of use, trail maintenance, hardening, and geoblock. C) Sun'aq Buskin Land Deal EX-OFFICIO MEMBER SCHMITT stated at a meeting he attended in December Cassidy was the staff rep and SCHMITT followed up with him and it made it into your packet for 1 or 2 meetings. It's a section from the Alaska Native Claims Settlement Act that in his view there aren't to be anymore claims of Federal land based on native rights of some kind. The committee directed Smith to put this item on the next agenda. COMMITTEE MEMBER JOHNSON suggested inviting Bob Polaski to the next meeting. D) Winter Rules of the Lake CHAIR SALTONSTALL said the assembly reminded him that that's what we are to do so. About 4 years ago there were quite a few problems there but since then there haven't been any problems there. He was there last week and the signs are still up. The committee was in consensus that the rules still look good. E) Update on the Natural Use Zoning Around the Landfill CHAIR SALTONSTALL said he wanted this on the agenda because they weren't notified. When he 2/12/2013 Page 2 of 4 P&R Minutes went to the assembly meeting there were many comments made and they postponed voting on it because it's controversial. EX-OFFICIO MEMBER SCHMITT stated when it came to the commission the staff recommendation was to rezone the whole area, it was split zoning; Natural Use and Conservation, they want to rezone all the borough land around the dump to Industrial. The staff report mentioned that by a previous ordinance the borough had designated this greenbelt buffer along the residential area. Local people testified during the public hearing preferring the greenbelt area not be rezoned. We amended staffs motion to say to rezone it all into Industrial except the greenbelt. He understands that part of it was left out so the assembly postponed it to allow them to look at it further. Andy Schroeder testified on behalf of Island Trails regarding trails in the local area being used that aren't on the trail map. Discussion on greenbelts and ordinances. NEW BUSINESS A) February 20, 2013 Planning&Zoning Commission Public Hearings Discussion of the public hearings, there was interest in the land disposal in Chiniak. EX-OFFICIO MEMBER SCHMITT gave an update based on the commission's agenda packet. COMMUNICATIONS There were no communications. REPORTS Meeting Schedule: • February 26, 2013 Parks & Recreation Committee meeting at 7:00 p.m. in the KIB School District Conference Room • March 12, 2013 Parks & Recreation Committee meeting at 7:00 p.m. in the KIB School District Conference Room COMMITTEE MEMBER WEST MOVED to accept reports. VOICE VOTE ON MOTION CARRIED UNANIMOUSLY AUDIENCE COMMENTS There were none. COMMITTEE MEMBER'S COMMENTS Rick Lindholm welcomed Michael Scalzo to the committee. Michael Scalzo said it's just kind of a familiarization round for him. Alan Schmitt said recently the P&Z had a controversial case, under the commission's bylaws there's a deadline for submitting information because it goes into the packet. This case had a lot of comments given to staff after that deadline which staff put them in the packet; we got 50 to 100 additional pages of comments so the commission did not consider them because they were submitted after the deadline. The applicant didn't like the result of the case and appealed it to the assembly, and initially the Clerk's Office put all those comments that we didn't consider into the assembly agenda packet, so it wasn't right. The borough got the attorney's opinion that said the comments should not have been given to the assembly.We've recently amended our bylaws and the assembly has approved them, if something comes in after the deadline it's not to go to the commission. For the P&R, the commission has a work session on Wednesday, don't give us something in writing,you will have to come in person to the work session and the regular meeting. Smith said you cannot give testimony at a work session. If the commissioners have questions for the applicant or agent they can ask the questions and they can be answered but they can't give public 2/12/2013 Page 3 of 4 P&R Minutes testimony at a work session; public testimony has to take place at the regular meeting. Smith showed them the schedule as far as comments, 15 days before the regular meeting. The commission is supposed to have their packets on the Friday before the work session. I put in your packet the public hearings on the upcoming agenda. Smith stated as your comments come in from P&R staff usually gives an update on your recommendations or does a supplemental staff report for the P&Z. If the P&R is allowed to submit comments late it could cause problems elsewhere because we used to get bombarded with comments at the last minute the day of the meeting. Sandra West said she's glad to see Helm Johnson and Mike Scalzo as part of the group and she welcomed them. She appreciates the citizen's comments. West stated she is putting in her resignation because she's been offered a job off island. Smith asked West to do a simple email resignation and email it to her and she'll scan it and send it to the Clerk's Office. Mike Scalzo said he's glad to be here and will read all the info so he can bring more to the table next time, and he's going to get out and hike some of these trails. Mike Marion welcomed Mike Scalzo also and he looks forward to the next meeting and finishing Russian Ridge between the TMO's and overview, deciding if we need to do anything else. He doesn't know if we need to do regarding the city. Patrick Saltonstall stated we're really going to miss you. He's really happy to have the new members because it's good to have new blood. He and Huntley are the oldest members. Smith updated the new members on the emails, email reminders, being excused depends on whether they let her know if they'll attend, and she's Parliamentarian and we have to go by the Open Meetings Act and Robert's Rules especially when it comes to motions, and this is her job to ensure certain guidelines are followed.We also have to have a quorum of 5 for P&R. Mike Scalzo stated he's on active duty quite a bit. ADJOURNMENT COMMITTEE MEMBER WEST MOVED to adjourn.
