FY2012 -14 <br /> 6 <br /> 7 AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH <br /> 8 REZONING A PARCEL OF LAND AT THE INTERSECTION OF REZANOF DRIVE AND <br /> 9 OTMELOI WAY FROM RR1- RURAL RESIDENTIAL ONE ZONING DISTRICT TO B- <br /> 10 BUSINESS ZONING DISTRICT (P&Z CASE 12 -014) <br /> 11 <br /> 12 WHEREAS, the Planning and Zoning Commission received a request to rezone a single <br /> 13 lot located at the intersection of Rezanof Drive and Otmeloi Way; and <br /> 14 <br /> 15 WHEREAS, the Commission voted to recommend to the Borough Assembly that this <br /> 16 parcel be rezoned, finding that the public necessity, convenience and general welfare, and <br /> 17 good zoning practice would be forwarded by such action; and <br /> 18 <br /> 19 WHEREAS, the Commission hereby recommends that this rezone request be reviewed <br /> 20 and approved by the Borough Assembly. <br /> 21 <br /> 22 NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND <br /> 23 BOROUGH THAT: <br /> 24 <br /> 25 Section 1: This ordinance is not of a general and permanent nature and shall not <br /> 26 become a part of the Kodiak Island Borough Code of Ordinances. <br /> 27 <br /> 28 Section 2: Lot 4, Block 5, Miller Point Alaska Subdivision be rezoned from RR1- Rural <br /> 29 Residential One to B- Business. <br /> 30 <br /> 31 Section 3: The findings of the Kodiak Island Borough Planning and Zoning Commission <br /> 32 are hereby confirmed as follows: <br /> 33 <br /> 34 17.205.020A. Findings as the Need and Justification for a Change or <br /> 35 Amendment. <br /> 36 A.1. As stated in the KIB Comprehensive Plan: To regulate and manage <br /> 37 land uses to balance the rights of private property owners with <br /> 38 community values and objectives. The need for a change is to <br /> 39 maximize compatibility of adjacent land uses. The Lot in this case is <br /> 40 across the street from long term sites used for commercial use; <br /> 41 Bayside Fire Department across Rezanof Dr and Kodiak Electric <br /> • 42 Company storage lot across Otmeloi Dr. <br /> 43 A.2. Current use fits the rezone request. <br /> 44 A.3.
