FY2011 -17 <br /> 8 <br /> 9 AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH <br /> 10 REZONING A PORTION OF TRACT G AND TRACT H (PROPOSED LOTS 1, 2, AND 3), <br /> 11 BELLS FLATS ALASKA SUBDIVISION FROM PL— PUBLIC USE LANDS <br /> 12 TO RR1- RURAL RESIDENTIAL ONE ZONE <br /> 13 <br /> 14 WHEREAS, the Borough Assembly has declared that Tract G and Tract H are surplus to <br /> 15 the public's need; and <br /> 16 <br /> 17 WHEREAS, the Planning and Zoning Commission has previously approved a preliminary <br /> 18 subdivision of these two tract creating four parcels; and <br /> 19 <br /> 20 WHEREAS, it is the desire to reserve one of the lots for water supply, drainage and fish <br /> 21 habit, while disposing the 3 remaining lots at a future borough land sale; and <br /> 22 <br /> 23 WHEREAS, the 2008 Kodiak Island Borough Comprehensive Plan Update has identified <br /> 24 this area of Womens Bay as residentially zoned lands; and <br /> 25 <br /> 26 WHEREAS, this request is consistent with the borough's comprehensive plan; and <br /> 27 <br /> 28 WHEREAS, the Planning and Zoning Commission held a properly noticed public hearing <br /> 29 on this request and is recommending that the Assembly approve the rezone the parcels <br /> 30 identified above from PL- Public Use Lands to RR1 — Rural Residential One. <br /> 31 <br /> 32 NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND <br /> 33 BOROUGH THAT: <br /> 34 <br /> 35 Section 1: This ordinance is not of a general and permanent nature and shall not <br /> 36 become a part of the Kodiak Island Borough Code of Ordinances; <br /> 37 <br /> 38 Section 2: A portion of Tract G and Tract H (proposed lots 1, 2, and 3), Bells Flats <br /> 39 Alaska Subdivision is rezoned from PL- Public Use Lands to RR1 — Rural <br /> 40 Residential One. <br /> 41 <br /> 42 Section 3: The findings of the Kodiak Island Borough Planning and Zoning Commission <br /> 43 are hereby confirmed as follows: <br /> 44 <br /> 45 <br /> 46 <br /> 47 <br /> 48 <br /> Kodiak Island Borough Ordinance No. FY2011 -17 <br /> Pagel of2 <br />
