2003-02 Rezone Case 03-001KODIAK ISLAND BOROUGH ORDINANCE NO. 2003 -02 Introduced by: Manager Carlson Requested by: Planning and Zoning Commission Drafted by: Community Development Department Introduced: 03/06/2003 Amended: 03/06/2003 Public Hearing: 03/25/2003 Adopted: 03/25/2003 AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY REZONING LOTS 1, 2, 3, 4, 5 AND 6, 7 AND 8, 9, 10, 11 AND 12, AND LOT 13A, BLOCK 36, EAST ADDITION FROM R1- SINGLE - FAMILY RESIDENTIAL TO R2- TWO- FAMILY RESIDENTIAL GENERALLY LOCATED AT 1210, 1212 1214 & 1220 REZANOF DRIVE AND 1211, 1215, 1219, 1221, 1223, & 1225 ISMAILOV STREET (P &Z CASE 03 -001) WHEREAS, the Small World, Inc., requested a zone change for Lot 13A, Block 36, East Addition, from R1- Single- family Residential to R2- Two - family Residential; and, WHEREAS, the Planning and Zoning Commission, after a public hearing on January 15, 2003, expanded the scope of the rezone to include all lots in Block 36, East Addition; and, WHEREAS, the Planning and Zoning Commission held a second public hearing on February 19, 2003 for this case; and, WHEREAS, upon consideration of the request, the Commission recommends that the Kodiak Island Borough Assembly rezone the lots investigated by this request from R1 - Single- family Residential to R2- Two - family Residential; NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: This ordinance is not of general application and shall not be codified. Section 2: Lots 1, 2, 3, 4, 5 and 6, 7 and 8, 9, 10, 11 and 12, and Lot 13A, Block 36, East Addition, are hereby rezoned from R1- Single- family Residential to R2 -Two- family Residential. Kodiak Island Borough, Alaska Ordinance No. 2003 -02 Page 1 of 2 Section 3: The findings of the Kodiak Island Borough Planning and Zoning Commission are hereby confirmed as follows: 17.72.020 A. Findings as to the Need and Justification for a Change or Amendment. A rezone from R1 to R2 is needed and justified because the zoning district permits development that: A. Is in conformance with the medium density residential designation for this area indicated by the Year 2000 Land Use Plan contained in the 1968 Kodiak Island Borough Comprehensive Plan. B. Will not create a nonconforming land use in the rezone area. C. Will not create negative impacts resulting from increased traffic. 17.72.020 B. Findings as to the Effect a Change or Amendment would have on the Objectives of the Comprehensive Plan. A change of zoning from R1 to R2 is consistent with the objectives of the comprehensive plan, which designates this area as Medium Density Residential. In addition, the surrounding single - family zoned area should be investigated for rezoning to R -2 Two - family Residential. This would be consistent with the comprehensive plan designation and would provide a choice of single - family or two - family residential density to property owners in the area, subject to meeting the requirements of the district and applicable parking requirements. It would also permit the consideration of professional offices, schools, hospitals and beauty shops as permitted uses. ATTEST: y z,z4 O. A.
