AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY
AMENDING KODIAK ISLAND BOROUGH CODE OF ORDINANCES TITLE 17 ZONING,
CHAPTER 17.03 GENERAL PROVISIONS AND USE REGULATIONS,
SECTION 17.03.090 SIMILAR USES MAY BE PERMITTED
TO MAKE SIMILAR USE DETERMINATIONS SUBJECT TO REVIEW AND APPROVAL BY
THE PLANNING AND ZONING COMMISSION
WHEREAS, the Borough is required to provide for appeals from administrative decisions; and
WHEREAS, with regard to similar use determinations, the Commission has determined it would be
preferable to amend the similar use determination process rather than making administrative similar use
determinations appealable; and
WHEREAS, the Commission held a public hearing on September 18, 2002 and decided to forward a
recommendation on this issue to the Assembly while it considers further recommendations to the appeal
procedures and to certain administrative decisions;
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: This ordinance is of general application and shall be codified.
Section 2: Kodiak Island Borough Code Section 17.03.090 is hereby amended as follows:
17.03.090 Similar uses may be permitted.

BA. Land uses other than those specifically permitted or conditionally permitted in a district may be
allowed if they are similar to those listed and are found by the commission, after a public hearing, to be similar
in character and impact.
EB. In all cases, the outdoor storage of materials and equipment is prohibited unless it is listed as a
permitted or conditional use in a district.
