2002-12 Amending Election Code - Simple MajorityKODIAK ISLAND BOROUGH ORDINANCE NO. 2002 -12 Introduced by: Borough Clerk Requested by: Borough Clerk Drafted by: Borough Clerk Introduced: 07/18/2002 Public Hearing: 08/01/2002 Adopted: 08/01/2002 AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY AMENDING KODIAK ISLAND BOROUGH CODE OF ORDINANCES TITLE 7 ELECT IONS CHAPTER 7.30 PROCEDURES FOR CONDUCT OF ELECT IONS SECTION 7.30.030 BALLOTS - -FORM AND AMENDING CHAPTER 7.40 CANVASSING AND CERTIFICATION OF ELECTION RETURNS BY ADDING SECTION 7.40.025 SIMPLE MAJORITY- - VOTES REQUIRED FOR ELECTION TO OFFICE WHEREAS, the Kodiak Island Borough Assembly would like to ensure that the privacy of voters is protected by printing the ballot number only on the ballot stub and not on the ballot; and WHEREAS, Alaska Statutes states that unless otherwise provided by ordinance, a runoff election shall be held if no candidate receives over 40 percent of the votes cast for the office of the mayor, members of the governing body, or school board if candidates run for a designated seat; and WHEREAS, the Kodiak Island Borough Assembly would like to ensure that this Alaska Statute provision is addressed in the Kodiak Island Borough Code; NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: This ordinance is of a general and permanent nature and shall become a part of the Kodiak Island Borough Code of Ordinances. Section 2: Title 7 Elections Chapter 7.30 Procedures for Conduct of Elections Section 7.30.030 Ballots- -Form is amended as follows: 7.30.030 Ballots - -Form. The clerk shall prepare all official ballots to facilitate fairness, simplicity, and clarity in the voting procedure, to reflect most accurately the intent of the voter, and to expedite the administration of elections. The following directives shall be followed when applicable: C. Ballots shall be prepared in the manner prescribed by law for state elections, insofar as such prescription is applicable to nonpartisan elections.
