AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY AMENDING KODIAK ISLAND
BOROUGH CODE OF ORDINANCES TITLE 2 ADMINISTRATION AND PERSONNEL
CHAPTER 2.15 BOROUGH MAYOR SECTION 2.15.040 DUTIES, AND
CHAPTER 2.39 BOARDS, COMMITTEES, AND COMMISSIONS
SECTION 2.39.030 APPOINTMENTS, SECTION 2.39.070 VACANCIES, AND
SECTION 2.39.080 NOTICE OF IMPENDING VACANCY
TO CLARIFY THE APPOINTMENT AND VACANCY PROCESS
WHEREAS, Alaska Statutes Sec.29.45.200 states that the governing body sits as a board of
equalization for the purpose of hearing an appeal from a determination of the assessor, or it may
delegate this authority to one or more boards appointed by it; and
WHEREAS, the Kodiak Island Borough Assembly wishes to ensure that members of boards,
committees, and commissions are appointed or appointed and confirmed appropriately; and
WHEREAS, the Kodiak Island Borough Assembly wishes to ensure that board, committee, and
commission seats are declared vacant appropriately;
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH
THAT:
Section 1: This ordinance is of a general and permanent nature and shall become a part of the
Kodiak Island Borough Code of Ordinances.
Section 2: Title 2 Administration and Personnel Chapter 2.15 Borough Mayor, Section 2.15.040
Duties is amended as follows:
2.15.040 Duties.
A. The mayor shall act as ceremonial head of the borough. The mayor shall preside at all
assembly meetings, and sign ordinances and other documents on the borough's behalf upon
assembly authorization. The failure of the mayor to sign an ordinance or resolution does not
invalidate them.
B. Members of boards, committees, and commissions, except for members of the board of
adjustment, members of the board of equalization, and elected
service area board members, sh&I -be are appointed by the mayor and confirmed by the assembly
in accordance with section 2.39.030 of this title.
Section 3: Title 2 Administration and Personnel Chapter 2.39 Boards, Committees, and
Commissions Section 2.39.030 Appointments is amended as follows:
2.39.030 Appointments. Members of boards, committees, and commissions, except for members
of the board of adjustment, members of the board of equalization, and
elected service area board members, are appointed by the mayor and confirmed by the assembly
unless otherwise specifically provided elsewhere in this code. An appointment not confirmed by the
assembly shall not become effective. The mayor shall appoint a new applicant until an appointment
is confirmed by the assembly. The mayor may not appoint again the same person whose

confirmation was failed by the Assembly for the same board, committee, or commission until the
next annual appointment process unless authorized by the assembly.
Section 3: Title 2 Administration and Personnel Chapter 2.39 Boards, Committees, and
Commissions Section 2.39.070 Vacancies is amended as follows:
2.39.070 Vacancies.
A. Vaeancies A vacancy, other than by expiration of the member's term, are is created as - follows
when the seat is declared vacant by the assembly for one or more of the following reasons:
1. the member leaves the borough with the intent of remaining absent more than ninety (90)
days;
2. the member fails to attend four (4) consecutive regularly scheduled meetings;
3. the member fails to attend, without excuse, at least eighty percent (80 %) of the regularly
scheduled meetings within any calendar year;
4. the member submits a resignation presented in writing which is accepted by the board,
committee, or commission;
5. the member dies;
6. the member fails to accept the appointment within thirty (30) days of the appointment` or
7. the member fails to qualify in accordance with section 2.39.040 of this chapter at any time
during the appointment.
C. In the event of a vacancy on a board, committee, or commission for any reason other than
normal expiration of a term of office, the clerk shall cause notice thereof to be published at.Ieast
twice in a newspaper of general circulation within the borough. The notice shall set. forth the
vacancies and any qualifications of members. tThe appointing authority shall appoint a new member
for the remaining unexpired term
in accordance with section 2.39.030 of this chapter.
Section 4: Title 2 Administration and Personnel Chapter 2.39 Boards, Committees, and
Commissions Section 2.39.080 Notice of impending vacancy is amended as follows:
2.39.080 Notice of impending vacancy. At least thirty (30) days prior to the end expiration of the
term of an incumbent board, committee, or commission member, the clerk shall cause notice thereof
to be published at least twice in a newspaper of general circulation within the borough. The notice
shall set forth the vacancies and any qualifications of members.
