2002-07 Rezone Ptarmagin Pass RoadKODIAK ISLAND BOROUGH ORDINANCE NO. 2002 -07 Introduced by: Manager Carlson Requested by: Planning & Zoning Commission Drafted by: Community Development Department Introduced: 05/02/2002 Public Hearing: 05/16/2002 Adopted: 05/16/2002 AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY REZONING LOT 12B, BLOCK 3, ISLAND LAKE SUBDIVISION FROM B- BUSINESS TO R2 -TWO FAMILY RESIDENTIAL IN ACCORDANCE WITH THE ATTACHED MAP (EXHIBIT A) LOCATED AT 3100 PTARMIGAN PASS ROAD WHEREAS, the petitioner, Douglas Bunting, wishes to rezone Lot 12B, Block 3, Island Lake Subdivision, from B- Business to R2 -Two Family Residential, and, WHEREAS, Kodiak Island Borough Planning and Zoning Commission held a public hearing on this rezone request, at their March 20, 2002 regular meeting; and WHEREAS, the Commission found that the rezone is generally consistent with the provisions of the Kodiak Island Borough Comprehensive Plan (as amended), and, WHEREAS, after considering this request, the Kodiak Island Borough Planning and Zoning Commission recommends that the Kodiak Island Borough Assembly approve the rezone from B- Business to R2 -Two Family Residential. NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: This ordinance is not of general application and shall not be codified. Section 2: Lot 12B, Block 3, Island Lake Subdivision, as depicted on Exhibit A (attached), is hereby rezoned from B- Business to R2 -Two Family Residential. Section 3: The findings of the Kodiak Island Borough Planning and Zoning Commission are hereby confirmed as follows: 17.72.020 A. Findings as to the Need and Justification for a Change or Amendment. A rezone to R2 -Two family residential would conform to the existing duplex use of the property as well with the duplex use on the adjacent lot. It would also be consistent with the rezoning of all of the Tots in Block 1 of Island Lake Subdivision to R2 two years ago (Ordinance 2000 -20). The proposed rezone from B- Business to R2 can be viewed as a voluntary down zoning which will potentially reduce density and alleviate overcrowding in an area characterized by Kodiak Island Borough, Alaska Ordinance No. 2002 -07 1 of 2 ATTEST: Tots substandard in size and roads substandard in width and lacking improvements. 17.72.020 B. Findings as to the Effect a Change or Amendment would have on the Objectives of the Comprehensive Plan. A rezone of Lot 12B to R2 would not only be consistent with the medium density residential designation in the KIB Comprehensive Plan, but also with the adjacent zoning and use on Lot 3 immediately south and, in general, with the prevailing zoning and use further south in Shahafka Acres and Miller Point Alaska, First Addition Subdivisions.
