2002-06 Rezoning U.S. Survey 1995 - East Marine WayKODIAK ISLAND BOROUGH ORDINANCE NO. 2002 -06 Introduced by: Requested by: Drafted by: Introduced: Public Hearing: Adopted: Manager Carlson Planning & Zoning Commission Community Development Department 05/02/2002 05/16/2002 05/16/2002 AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY REZONING LOT 11, U.S. SURVEY 1995, FROM R3- MULTIFAMILY RESIDENTIAL TO I- INDUSTRIAL, IN ACCORDANCE WITH THE ATTACHED MAP (EXHIBIT A) GENERALLY LOCATED ALONG THE SOUTH SIDE OF EAST MARINE WAY WHEREAS, the petitioner, International Seafoods, wishes to rezone Lot 11, U.S. Survey 1995, from R3- Multifamily Residential to I- Industrial, and, WHEREAS, Kodiak Island Borough Planning and Zoning Commission held a public hearing on this rezone request, at their April 17, 2002 regular meeting; and, WHEREAS, the Commission found that the rezone is generally consistent with the provisions of the Kodiak Island Borough Comprehensive Plan (as amended), and, WHEREAS, after considering this request, the Kodiak Island Borough Planning and Zoning Commission recommends that the Kodiak Island Borough Assembly approve the rezone from R3- Multifamily Residential to I- Industrial. NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: Section 2: This ordinance is not of general application and shall not be codified. Lot 11, U.S. Survey 1995, as depicted on Exhibit A (attached), is hereby rezoned from R3- Multifamily Residential to I- Industrial. Section 3: The findings of the Kodiak Island Borough Planning and Zoning Commission are hereby confirmed as follows: 17.72.020 A. Findings as to the Need and Justification for a Change or Amendment. The rezone of Lot 11, Block 2, U.S. Survey 1995 from R3 Multi- family Residential to I- Industrial, is necessary and justified because the I- Industrial zoning district permits development that: 1. Is consistent with the existing zoning surrounding this property; 2. Will facilitate consolidation of land and uniformity of zoning in anticipation of commercial /industrial redevelopment; Kodiak Island Borough, Alaska Ordinance No. 2002 -06 1 of 2 ATTEST: 3. Will bring the existing land use into conformity and not create additional non- conforming land uses; 4. Will not result in greater negative traffic impacts. 17.72.020 B. Findings as to the Effect a Change or Amendment would have on the Obiectives of the Comprehensive Plan. The 1968 Borough Comprehensive Plan designates this area primarily for Light Industrial Development. This rezone to I- Industrial would be consistent with the comprehensive plan as well as the zoning on surrounding parcels.
