AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY AMENDING
KODIAK ISLAND BOROUGH CODE OF ORDINANCES TITLE 8 HEALTH AND SAFETY
CHAPTER 8.04 HOSPITAL AND HEALTH FACILITIES ADVISORY BOARD SECTION 8.04.010
CREATED--MEMBERSHIP AND CHAPTER 8.08 MENTAL HEALTH CENTER ADVISORY BOARD
SECTION 8.08.010 CREATED--MEMBERSHIP
WHEREAS, Kodiak Island Borough and Sisters of Providence in Washington d /b /a Providence
Health System in Alaska ( "Providence ") entered into lease agreements relating to the Kodiak
Island Hospital and Care Center and Kodiak Island Mental Health Center; and
WHEREAS, the contracts contemplate that Kodiak Island Borough will establish hospital and
mental health advisory boards and that Providence will have certain rights of participation in the
advisory boards; and
WHEREAS, the provisions of the contracts are not in complete harmony with the ordinances
establishing the advisory boards; and
WHEREAS, 07 AAC 13.030 sets out requirements for hospital governing and advisory boards,
and 07 AAC71 .030 sets out requirements for mental health services governing and advisory
boards; and
WHEREAS, the parties want to assure that their contracts and ordinances are in harmony with
one another and in full compliance with all applicable statutes and regulations;
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH
THAT:
Section 1: This ordinance is of a general and permanent nature and shall become a part of the
Kodiak Island Borough Code of Ordinances.

8.04.010 Created -- Membership. There is created
which shall consist of nine - (0) seven (7) borough

The hospital manager shall serve as a non - voting ex- officio member of the
board and the mayor may, with the concurrence of the assembly, appoint additional non - voting
ex- officio members. The board shall designate its chair and conduct its meetings in accordance
with chapter 2.39 of this code. The hospital and health facilities advisory board shall be inactive
and its seats unfilled so long as the governing and advisory functions and responsibilities "required
under state law are being provided by the operator of the hospital, and health facility.

8.08.010 Created -- Membership. There is created a mental health center advisory board which
