2001-21 Rezoning Portions of USS 2539AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY REZONING LOT 29 -A, OF U.S. SURVEY 2539, FROM C- CONSERVATION TO RR1 -RURAL RESIDENTIAL ONE, IN ACCORDANCE WITH THE MAP ATTACHED DATED NOVEMBER 6, 2001 (EXHIBIT A) (LOCATED BETWEEN SHANNON POINT AND FRYE POINT ALONG WOMENS BAY) WHEREAS, the landowner, Vulcan Company, wishes to rezone Lot 29 -A, U.S. Survey 2539, approximately 35 acres in area, from C- Conservation to RR1 -Rural Residential One; and WHEREAS, Kodiak Island Borough Planning and Zoning Commission held public hearings on this rezone request at their July 18 and September 19, 2001 regular meetings; and WHEREAS, the Commission found that the rezone is generally consistent with the zoning of other areas in the Bells Flats, Russian Creek, and Monashka Bay Subdivisions; and WHEREAS, after considering this request, the Kodiak Island Borough Planning and Zoning Commission has recommended that the Kodiak Island Borough Assembly approve the rezone from C- Conservation to RR1 -Rural Residential One; NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: Section 2: Section 3: KODIAK ISLAND BOROUGH ORDINANCE NO. 2001 -21 Introduced by: Requested by: Drafted by: Introduced: Public Hearing: Adopted: Manager Carlson Planning & Zoning Commission Community Development Dept. 12/20/2001 01/03/2002 01/03/2001 This ordinance is not of general application and shall not be codified. Lot 29 -A, U.S. Survey 2539, as depicted on Exhibit A (attached), is hereby rezoned from C- Conservation to RR1 -Rural Residential One. The findings of the Kodiak Island Borough Planning and Zoning Commission are hereby confirmed as follows: 17.72.020 A. Findings as to the Need and Justification for a Change or Amendment. A rezone from C- Conservation to RR1 -Rural Residential One is needed and justified because the zoning district permits development that: Will increase the allowable density of development in order to encourage investment in and development of the site. The RR1 -Rural Residential One zoning district has been applied to similarly slope affected areas of Bells Flats and Monashka Bay subdivisions. This site has a number of issues relating to access and on -site water and wastewater disposal that the petitioner is undertaking to resolve as part of the corresponding subdivision case for Lot 29A, U.S. Survey 2539.
