AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY REZONING LOT 29 -A, OF <br />U.S. SURVEY 2539, FROM C- CONSERVATION TO RR1 -RURAL RESIDENTIAL ONE, IN <br />ACCORDANCE WITH THE MAP ATTACHED DATED NOVEMBER 6, 2001 (EXHIBIT A) <br />(LOCATED BETWEEN SHANNON POINT AND FRYE POINT ALONG WOMENS BAY) <br />WHEREAS, the landowner, Vulcan Company, wishes to rezone Lot 29 -A, U.S. Survey 2539, <br />approximately 35 acres in area, from C- Conservation to RR1 -Rural Residential One; and <br />WHEREAS, Kodiak Island Borough Planning and Zoning Commission held public hearings on this <br />rezone request at their July 18 and September 19, 2001 regular meetings; and <br />WHEREAS, the Commission found that the rezone is generally consistent with the zoning of other <br />areas in the Bells Flats, Russian Creek, and Monashka Bay Subdivisions; and <br />WHEREAS, after considering this request, the Kodiak Island Borough Planning and Zoning <br />Commission has recommended that the Kodiak Island Borough Assembly approve the rezone from <br />C- Conservation to RR1 -Rural Residential One; <br />NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND <br />BOROUGH THAT: <br />Section 1: <br />Section 2: <br />Section 3: <br />KODIAK ISLAND BOROUGH <br />ORDINANCE NO. 2001 -21 <br />Introduced by: <br />Requested by: <br />Drafted by: <br />Introduced: <br />Public Hearing: <br />Adopted: <br />Manager Carlson <br />Planning & Zoning Commission <br />Community Development Dept. <br />12/20/2001 <br />01/03/2002 <br />01/03/2001 <br />This ordinance is not of general application and shall not be codified. <br />Lot 29 -A, U.S. Survey 2539, as depicted on Exhibit A (attached), is hereby rezoned <br />from C- Conservation to RR1 -Rural Residential One. <br />The findings of the Kodiak Island Borough Planning and Zoning Commission are <br />hereby confirmed as follows: <br />17.72.020 A. Findings as to the Need and Justification for a Change or Amendment. <br />A rezone from C- Conservation to RR1 -Rural Residential One is needed and justified because the <br />zoning district permits development that: <br />Will increase the allowable density of development in order to encourage investment in and <br />development of the site. The RR1 -Rural Residential One zoning district has been applied <br />to similarly slope affected areas of Bells Flats and Monashka Bay subdivisions.
