AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY
AMENDING KODIAK ISLAND BOROUGH CODE TITLE 17 ZONING,
CHAPTER 17.11 WH- WILDLIFE HABITAT DISTRICT,
SECTION 17.11.050 AREA AND YARD REQUIREMENTS, AND
SECTION 17.11.060 SETBACK REQUIREMENTS

WHEREAS, the Kodiak Island Borough Planning and Zoning Commission held two work
sessions to consider the addition of minimum lot dimensions and setbacks to the WH-
Wildlife Habitat Zoning District, culminating in a public hearing on September 19, 2001;
and
WHEREAS, the Kodiak Island Borough Planning and Zoning Commission has
recommended that the Kodiak Island Borough Assembly approve and adopt the
recommended amendments to Kodiak Island Borough Code Chapter 17.1 1, Conservation
Zoning District.
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: This ordinance is of a general and permanent nature and shall become a part
of the Kodiak Island Borough Code of Ordinances.
Section 2: Section 17.1 1.050 Area and yard requirements, is hereby amended as
follows:
17.11.050 Area and -yard requirements. ,
Kodiak Island Borough, Alaska
A. Lot area. The minimum lot area required is five (5) acres.
B. Lot width. The minimum lot width required is two hundred and fifty
(250) feet.

Section 3: Section 17.11.060 Setback requirements is hereby established as follows:
17.11.060 Setback requirements.
A. Setbacks from property lines.
1. there is a required front yard setback of twenty -five feet (25'),
except that lots fronting on marine waters are exempt from any front yard
setback.
2. there is a required side yard setback of twenty -five feet (25').
3. there is a required rear yard setback of twenty -five feet (25').
Setbacks from anadromous fish water bodies.
1. there is a required setback (preventing clearing, filling, excavation,
or structural development) of fifty feet (50') from the bank vegetation of
anadromous fish water bodies that are specified pursuant to AS
16.05.870(a) and 5 AAC 95.010, except in the case of timber harvesting
activities, whose required setback will be regulated by AS 41.17.10 -950,
as amended, and the regulations enacted thereunder. This provision shall
not prevent removal in the setback area associated with a habitable
residential, or recreational structure of:
a. up to fifty percent (50 %) of the trees; and
b.' other vegetation if a suitable ground cover such as grass) is
planted.
