KODIAK ISLAND BOROUGH <br />ORDINANCE NO. 2001 -19 <br />Introduced by: <br />Requested by: <br />Drafted by: <br />Introduced: <br />Public Hearing: <br />Adopted: <br />Manager Carlson <br />P & Z Commission <br />Community Development <br />Department <br />09/06/2001 <br />09/20/2001 <br />09/20/2001 <br />AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY <br />REZONING PORTIONS OF U.S. SURVEY 4947 (NEAR ISLAND) <br />FROM PL- PUBLIC USE LAND TO RB- RETAIL BUSINESS, IN ACCORDANCE WITH THE <br />MAP SUBMITTED BY THE CITY OF KODIAK, DATED JUNE 22, 2001 <br />(NORTH END OF NEAR ISLAND BETWEEN DOG (SALMON) BAY ROAD AND TRIDENT WAY) <br />WHEREAS, the City of Kodiak wishes to rezone a portion of U.S. Survey 4947, <br />approximately 14 acres in area, from PL- Public Use Land to RB- Retail Business; and, <br />WHEREAS, Kodiak Island Borough Planning and Zoning Commission held public hearings <br />on this rezone request at their July 18 and August 15, 2001 regular meetings; and <br />WHEREAS, the Commission found that the rezone is generally consistent with the provisions <br />of the 1987 Near Island Comprehensive Plan, and, <br />WHEREAS, after considering this request, the Kodiak Island Borough Planning and Zoning <br />Commission has recommended that the Kodiak Island Borough Assembly approve the rezone <br />from PL- Public Use Land to RB- Retail Business. <br />NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND <br />BOROUGH THAT: <br />Section 1: This ordinance is not of general application and shall not be codified. <br />Section 2: <br />Section 3: <br />A portion of U.S. Survey 4947, as depicted on Exhibit A (attached), are hereby <br />rezoned from PL- Public Use Land to RB- Retail Business <br />The findings of the Kodiak Island Borough Planning and Zoning Commission <br />are hereby confirmed as follows: <br />17.72.020 A. Findings as to the Need and Justification for a Change or Amendment. <br />The proposed rezone is needed and justified because the RB- Retail Business zone allows <br />uses and structures that will support existing and planned development on Near Island. In <br />addition, the RB- Retail Business zone provides more flexibility in the development of uses <br />that are not predicated on government ownership or operation, thereby making it more likely <br />that the private sector will invest in Near Island development. <br />Kodiak Island Borough, Alaska Ordinance No. 2001 -19 <br />Page 1 of 2 <br />
