KODIAK ISLAND BOROUGH <br />ORDINANCE NO. 2001 -17 <br />Introduced by: Manager Carlson <br />Requested by: Planning and Zoning <br />Commission <br />Drafted by: Community Development <br />Department <br />Introduced: 05/17/2001 <br />Public Hearing: 06/07/2001 <br />Adopted: 06/07/2001 <br />AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY <br />REZONING A PORTION OF LOT 7, BLOCK 1, LAKESIDE SUBDIVISION, <br />FROM R2- TWO- FAMILY RESIDENTIAL TO PL— PUBLIC USE LAND <br />( 2050 SELIEF LANE) <br />WHEREAS, the Kodiak Island Borough Assembly has determined that a portion of Lot 7, <br />Block 1, Lakeside Subdivision is surplus to the public's need; and <br />WHEREAS, the 50 -foot wide PL- Public Use Land zoned greenbelt located south of Lot 7 <br />should be extended along the southeast end of Beaver Lake Drive extension and along the <br />southeast side (rear) of Lot 7; and <br />WHEREAS, the Kodiak Island Borough Planning and Zoning Commission held a public <br />hearing on this rezone request at their March 21, 2001 regular meeting; and <br />WHEREAS, upon consideration of this request, the Planning and Zoning Commission <br />recommended that the Assembly approve the rezoning of a portion of Lot 7, Block 1, Lakeside <br />Subdivision. <br />NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND <br />BOROUGH THAT: <br />Section 1: This ordinance is not of general application and shall not be codified. <br />Section 2: The 50 -feet located along the southeast boundary (rear) of Lot 7, Block 1, <br />Lakeside Subdivision and the 50 -feet along the southeast boundary (end) of <br />Beaver Lake Drive, is hereby rezoned from R2- Two - family Residential to PL- <br />Public Use Land. <br />Section 3: The findings of the Planning and Zoning Commission are hereby confirmed as <br />follows: <br />17.72.020 A. Findings as to the Need and Justification for a Change or Amendment. <br />The rezone of a portion of Lot 7, Block 1, Lakeside Subdivision, and a portion of the Beaver <br />Lake Drive extension, from R2- Two - family Residential to PL-- Public Use Land is necessary <br />and justified because: <br />Kodiak Island Borough, Alaska Ordinance No. 2001 -17 <br />Page 1 of 2 <br />
