KODIAK ISLAND BOROUGH <br />ORDINANCE NO. 2001 -15 <br />Introduced by: Manager Jensen <br />Requested by: P &ZC <br />Drafted by: Community <br />Development Department <br />Introduced: <br />Public Hearing: <br />Adopted: <br />04/19/2001 <br />05/03/2001 <br />05/03/2001 <br />AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY REZONING A <br />PORTION OF TRACT E, U.S. SURVEY 4793 DESCRIBED AS OH- LEASE -1, <br />CONSISTING OF 40,609 SQUARE FEET, <br />FROM R1- SINGLE FAMILY RESIDENTIAL TO B- BUSINESS <br />WHEREAS, the City of Old Harbor has requested a rezone of a portion of Tract E, U.S. <br />Survey 4793 described as OH- LEASE -1, consisting of 40,609 square feet, from R1- Single <br />Family Residential to B- Business, and <br />WHEREAS, an existing vehicle repair shop and a new fuel dispensary are proposed to <br />serve the New Town portion of Old Harbor; and, <br />WHEREAS, Kodiak Island Borough Planning and Zoning Commission held a public hearing <br />on this rezone request at their March 21, 2001 regular meeting; and <br />WHEREAS, upon consideration of the request, the Commission has recommended that <br />the Kodiak Island Borough Assembly approve the rezone of a portion of Tract E, U.S. <br />Survey 4793 described as OH- LEASE -1, from R1- Single Family Residential to B- Business. <br />NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND <br />BOROUGH THAT: <br />Section 1: This ordinance is not of general application and shall not be codified. <br />Section 2: <br />Section 3: <br />A portion of Tract E, U.S. Survey 4793, described as OH- LEASE -1 is hereby <br />rezoned from R1- Single Family Residential to B- Business. <br />The findings of the Kodiak Island Borough Planning and Zoning Commission <br />are hereby confirmed as follows: <br />17.72.020 A. Findings as to the Need and Justification for a Change or Amendment. <br />This tract is located near an emerging residential area in New Town, midway between the <br />dock and boat harbor and the new airport. This is the site of an existing auto repair /service <br />station on a City lease tract. The City has determined that this is a suitable site for dispensing <br />fuel, offering maximum flexibility when considering possible future gas station sites and /or <br />management options. That should reasonably serve as a guiding principle in local land use <br />decisions. This rezone could also serve and the first step in an expanded, more <br />Kodiak Island Borough, Alaska Ordinance No. 2001 -15 <br />Page 1 of 2 <br />
