KODIAK ISLAND BOROUGH <br />ORDINANCE NO. 2001 -13 <br />Section 1: This ordinance is not of general application and shall not be codified. <br />Introduced by: Manager Jensen <br />Requested by: Planning & <br />Zoning Commission <br />Drafted by: Community <br />Development Dept. <br />Introduced: 04/19/2001 <br />Public Hearing: 05/03/2001 <br />Adopted: 05/03/2001 <br />AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY REZONING LOTS 1, 2, A <br />PORTION OF LOT 3, AND A PORTION OF LOT 6, BLOCK 1, TRACT A, BELLS FLATS ALASKA <br />SUBDIVISION, FROM PL- PUBLIC USE LAND TO RR1 -RURAL RESIDENTIAL ONE <br />(709, 597, AND 665 SARGENT CREEK ROAD) <br />WHEREAS, the Kodiak Island Borough Assembly has determined that Lots 1, 2, a portion of 3 and <br />a portion of 6, Block 1, Tract A, Bells Flats Alaska Subdivision, are surplus to the public' s need, <br />and <br />WHEREAS, the PL- Public Use Land zoning district is not appropriate for privately owned land and <br />the RR1 -Rural Residential One zoning district is consistent with the 1982 Womens Bay <br />Comprehensive Plan; and, <br />WHEREAS, Kodiak Island Borough Planning and Zoning Commission held a public hearing on <br />this rezone request at their March 21, 2001 regular meeting; and <br />WHEREAS, upon consideration of the request, the Commission has recommended that the <br />Assembly approve the rezoning of Lots 1, 2, a portion of Lot 3 and a portion of Lot 6, Block 1, Tract <br />A, Bells Flats Alaska Subdivision. <br />NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND <br />BOROUGH THAT: <br />Section 2: Lots 1, 2, a portion of Lot 3, and a portion of Lot 6, Block 1, Tract A, Bells Flats <br />Alaska Subdivision, are hereby rezoned from PL- Public Land Use to RR1 -Rural <br />Residential One. <br />Section 3: The findings of the Kodiak Island Borough Planning and Zoning Commission are <br />hereby confirmed as follows: <br />17.72.020 A. Findings as to the Need and Justification for a Change or Amendment. <br />A rezone from PL- Public Use Land to RR1 -Rural Residential One is needed to allow for the future <br />disposal of the rezone area. This land was designated surplus to the public' s need by the Kodiak <br />Island Borough Assembly (Resolution 2001 -02).
