KODIAK ISLAND BOROUGH <br />ORDINANCE NO. 2001 -08 <br />Introduced by: Manager Jensen <br />Requested by: Planning & Zoning <br />Commission <br />Drafted by: Community <br />Development Department <br />Introduced: 03/15/2001 <br />Public Hearing: 04/05/2001 <br />Adopted: 04/05/2001 <br />AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY AMENDING <br />KODIAK ISLAND BOROUGH CODE TITLE 17 ZONING CHAPTER 17.22 RNC -RURAL <br />NEIGHBORHOOD COMMERCIAL DISTRICT TO INCREASE THE MINIMUM LOT AREA <br />AND LOT WIDTH REQUIREMENTS AND TO INCORPORATE SCREENING, <br />LANDSCAPING, AND BUFFERING STANDARDS <br />(FROM KIB CODE SECTION 17.21.050) <br />WHEREAS, the Kodiak Island Borough Planning and Zoning Commission held a public <br />hearing on the proposed amendment at the February 21, 2001 regular meeting; and <br />WHEREAS, by definition, the RNC zoning district is designed to accommodate <br />commercial uses located in areas not served by public utilities; and <br />WHEREAS, a detached single - family dwelling can also be permitted on a RNC zoned lot <br />in conjunction with a commercial use; and <br />WHEREAS, This kind of potential density might not be able to be supported by lots that <br />can be as small as 40,000 square feet (200 ft. x 200 ft.); and <br />WHEREAS, a minimum of two hundred (200) feet separation is required between wells <br />and septic systems by State statute for Class A and B commercial uses; and <br />WHEREAS, increasing the minimum lot area and lot width in the RNC -Rural <br />Neighborhood Commercial zoning district will significantly reduce the possibility that small <br />lots in rural commercial areas can be negatively impacted - -and conceivably, in some <br />cases, rendered undevelopable -- through cross pollution of wells by septic systems in <br />close proximately on adjacent commercial properties. <br />WHEREAS, after reviewing the proposed amendment to increase lot area and width and <br />to incorporate new screening, landscaping and buffering standards, the Kodiak Island <br />Borough Planning and Zoning Commission recommends that the Kodiak Island Borough <br />Assembly approve and adopt the recommended changes to Kodiak Island Borough Code <br />Chapter 17.22 (RNC -Rural Neighborhood Commercial); <br />Kodiak Island Borough, Alaska <br />Ordinance No. 2001 -08 <br />Page 1 of 2 <br />
