2001-08 Amending Title 17 Zoning - RNCKODIAK ISLAND BOROUGH ORDINANCE NO. 2001 -08 Introduced by: Manager Jensen Requested by: Planning & Zoning Commission Drafted by: Community Development Department Introduced: 03/15/2001 Public Hearing: 04/05/2001 Adopted: 04/05/2001 AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY AMENDING KODIAK ISLAND BOROUGH CODE TITLE 17 ZONING CHAPTER 17.22 RNC -RURAL NEIGHBORHOOD COMMERCIAL DISTRICT TO INCREASE THE MINIMUM LOT AREA AND LOT WIDTH REQUIREMENTS AND TO INCORPORATE SCREENING, LANDSCAPING, AND BUFFERING STANDARDS (FROM KIB CODE SECTION 17.21.050) WHEREAS, the Kodiak Island Borough Planning and Zoning Commission held a public hearing on the proposed amendment at the February 21, 2001 regular meeting; and WHEREAS, by definition, the RNC zoning district is designed to accommodate commercial uses located in areas not served by public utilities; and WHEREAS, a detached single - family dwelling can also be permitted on a RNC zoned lot in conjunction with a commercial use; and WHEREAS, This kind of potential density might not be able to be supported by lots that can be as small as 40,000 square feet (200 ft. x 200 ft.); and WHEREAS, a minimum of two hundred (200) feet separation is required between wells and septic systems by State statute for Class A and B commercial uses; and WHEREAS, increasing the minimum lot area and lot width in the RNC -Rural Neighborhood Commercial zoning district will significantly reduce the possibility that small lots in rural commercial areas can be negatively impacted - -and conceivably, in some cases, rendered undevelopable -- through cross pollution of wells by septic systems in close proximately on adjacent commercial properties. WHEREAS, after reviewing the proposed amendment to increase lot area and width and to incorporate new screening, landscaping and buffering standards, the Kodiak Island Borough Planning and Zoning Commission recommends that the Kodiak Island Borough Assembly approve and adopt the recommended changes to Kodiak Island Borough Code Chapter 17.22 (RNC -Rural Neighborhood Commercial); Kodiak Island Borough, Alaska Ordinance No. 2001 -08 Page 1 of 2 NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: This ordinance is of a general and permanent nature and shall become a part of the Code of Ordinances of the Kodiak Island Borough. Section 2: Chapter 17.22 (RNC -Rural Neighborhood Commercial), is hereby amended as follows: 17.22.050 Minimum lot area and width requirements. There is a minimum lot area of €arty two (2) acres and a minimum lot width requirement of one hundred twcnty (120) fcct eighty (180) feet. 17.22.100 Performance standards. All permitted and conditional uses shall comply with the performance standards listed in this section. A. Groundcover. All areas not devoted to buildings, structures surfaced drives, walks or parking areas, shall be covered, and maintained with grass, s hrubbery, trees, rocks or gravel, or other suitable groundcover materials to mini mize dust; erosion and sedimentation B. or security purpose property. Lighting. Any lighting uses for advertising, display, shall not produce glare on a public highway or neighboring'residential C. Screening Where a business use is adjacent to a residential use or district, that business shall provide and maintain screening as approved by the commission.
