2001-05 Amending Title 17 Zoning - Conservation Zoning DistrictKODIAK ISLAND BOROUGH ORDINANCE NO. 2001 -05 Introduced by: Requested by: Drafted by: Introduced: Public Hearing: Adopted: Manager Jensen Planning & Zoning Commission Community Development Department 03/01/2001 04/05/2001 04/05/2001 AN ORDINANCE OF THE KODIAK ISLAND BOROUGH AMENDING KODIAK ISLAND BOROUGH CODE TITLE 17 ZONING, CHAPTER 17.06 DEFINITIONS, AND CHAPTER 17.13 CONSERVATION ZONING DISTRICT WHEREAS, the Kodiak Island Borough Planning and Zoning Commission held five work sessions over the past year, culminating in a public hearing on January 17, 2001; and WHEREAS, the Planning and Zoning Commission finds that this code revision is consistent with the following objective stated in the Pasagshak /Narrow Cape Area Plan: "Acknowledge that all agricultural uses, including commercial grazing, should be permitted outright in the C- Conservation zoning district "; and WHEREAS, the Planning and Zoning Commission finds that the code revision is consistent with the historic use of the livestock grazing, based on leases originally assigned by the Federal government, in the northeast portion of Kodiak Island designated and on Chirikof and Sitkinak Islands; and WHEREAS, the Planning and Zoning Commission finds that in order to minimize potential conflicts between livestock and wildlife, especially bear; measures have been taken to maintain adequate separation between areas where commercial livestock grazing is designated as a permitted use and the boundaries of the Kodiak National Wildlife Refuge; and WHEREAS, upon review of the appropriate code changes, the Kodiak Island Borough Planning and Zoning Commission has recommended that the Kodiak Island Borough Assembly approve and adopt the recommended changes to Kodiak Island Borough Code Title 17, Zoning, Chapter 17.06 Definitions, and Chapter 17.13 Conservation Zoning District; NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: This ordinance is of a general and permanent nature and shall become a part of the Code of Ordinances of the Kodiak Island Borough. A There is created commercial livestock grazing. "Commercial livestock grazing" means rearing and grazing of livestock (horses cattle, buffalo, elk, reindeers; llamas) for slaughter and commercial sale of meat, for hunting, or for rent for recreational uses, when these activities are carried for profit. Section 3: Section 17.13.020 Permitted principal uses and structures is hereby amended as follows: ATTEST: Kodiak Island Borough B. Agricultural activities and related structures, cxccpt including commercial livestock grazing; with a written conservation plan between the land ; owner or lease holder and the Kodiak Soil, and Water Conservation 'District, in those areas:, historically established for livestock grazing consisting of the northeast portion of Kodiak Island east of a line drawn. from Crag Point on Sharatin Bay to the mouth of Wild Creek in Ugak Bay, and including Chirikof Island and Sitkinak Island. Churches Section 4: 17.13.040 Conditional uses is hereby amended as follows: C. Commercial livestock grazing, excluding those areas historically established for livestock grazing as described in Kodiak Island Borough Code Section 17.13.020.B., where it is a permitted use.
