2001-04 Rezoning Spruce Cape Road/Jackson LaneKODIAK ISLAND BOROUGH ORDINANCE NO. 2001 -04 Introduced by: Requested by: Drafted by: Introduced: Public Hearing: Adopted: Manager Jensen Planning and Zoning Commission Community Development Department 2/15/2001 03/01/2001 03/01/2001 AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY REZONING LOTS 1 THROUGH 6 AND LOT 16, U.S. SURVEY 3233 FROM RR1 -RURAL RESIDENTIAL ONE TO R3 -MULTI FAMILY RESIDENTIAL; AND OF LOTS 25A, 25B, 25C, 25D, 26, 27, AND 28, U.S. SURVEY 3099 FROM R1- SINGLE FAMILY RESIDENTIAL TO R3 -MULTI FAMILY RESIDENTIAL (LOCATED AT 2716, 2732, 2756, 2785, 2820 SPRUCE CAPE ROAD; 761A AND 771 JACKSON LANE) WHEREAS, the owner, Jackson's Mobile Home Park, Inc., has requested these lots be rezoned From RR1 -Rural Residential One and R1- Single Family Residential To R3 -Multi Family Residential; and WHEREAS, the Kodiak Island Borough Planning and Zoning Commission held a public hearing on this rezone request at their January 17, 2001 regular meeting; and WHEREAS, upon consideration of the request, the Kodiak Island Borough Planning and Zoning Commission has recommended that the Kodiak Island Borough Assembly approve the rezoning of Lots 1 through 6 and Lot 16, U.S. Survey 3233 from RR1 -Rural Residential One to R3 -Multi Family Residential; and of Lots 25A, 25B, 25C, 25D, 26, 27, and 28, U.S. Survey 3099 from R1- Single Family Residential to R3 -Multi Family Residential; NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: This ordinance is not of general application and shall not be codified. Section 2: Lots 1 through 6 and Lot 16, U.S. Survey 3233 are hereby rezoned from RR1 -Rural Residential One to R3 -Multi Family Residential; and Lots 25A, 25B, 25C, 25D, 26, 27, and 28, U.S. Survey 3099 are hereby rezoned from R1- Single Family Residential to R3 -Multi Family Residential. Section 3: The findings of the Kodiak Island Borough Planning and Zoning Commission are hereby confirmed as follows: Kodiak Island Borough Ordinance No. 2001 -04 Page 1 of 2 17.72.020 A. Findings as to the Need and Justification for a Change or Amendment. A rezone from RR1 -Rural Residential One and R1- Single Family Residential to R3 -Multi Family Residential is needed and justified because the R3 -Multi Family Residential zoning district permits development that: C. Is consistent with the objectives of the 1968 KIB Comprehensive Plan. 17.72.020 B. Findings as to the Effect a Change or Amendment would have on the Objectives of the Comprehensive Plan. A change of zoning from R1 and RR1 to the R3 -Multi Family Residential zoning district is necessary because R3- Multi Family Residential permits mobile home parks, which is consistent with the objectives of the 1968 KIB Comprehensive Plan. Section 4: This rezone shall become effective upon adoption, and the official zoning map shall be updated to reflect this rezoning. ADOPTED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THIS FIRST DAY OF MARCH, 2001 ATTEST: A. Will bring the traditional mobile home park use of the area into conformance with zoning code; B.
