2001-01 Amending Title 17 Zoning - Accessory BuildingsKODIAK ISLAND BOROUGH ORDINANCE NO. 2001 -01 Introduced by: Requested by: Drafted by: Introduced: Public Hearing: Amended: Adopted: Manager Jensen Planning & Zoning Commission Community Development Dept 01/18/2001 02/01/2001 02/01/2001 02/01/2001 AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY AMENDING TITLE 17 ZONING OF THE KODIAK ISLAND BOROUGH CODE OF ORDINANCES BY AMENDING CHAPTER 17.51 ACCESSORY BUILDINGS TO ALLOW THE PLACEMENT OF NON - MOTORIZED CONTAINER VANS TO STORE EMERGENCY RESPONSE EQUIPMENT IN THE KODIAK ISLAND BOROUGH WHEREAS, the Kodiak Island Borough Planning and Zoning Commission held a public hearing on December 20, 2000; and WHEREAS, the Commission has determined the need to store emergency response equipment in the outlying communities on Kodiak Island; and WHEREAS, storing emergency response equipment in strategic locations within the outlying communities on Kodiak will allow for optimum emergency response and enhance public safety and protection of the environment; and WHEREAS, using non - motorized container vans for storage of emergency response equipment will not change existing zoning and building code requirements for accessory buildings and /or storage vans except for this specific purpose in the outlying communities on Kodiak Island; and WHEREAS, the Planning and Zoning Commission has recommended that the Kodiak Island Borough Assembly adopt recommended changes to Kodiak Island Borough Code; NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: This ordinance is of a general and permanent nature and shall become a part of the Code of Ordinances of the Kodiak Island Borough. Section 2: Section 17.51.020 of the Kodiak Island Borough Code of Ordinances is amended as follows: 17.51.020 Definition. "Accessory building" means: A. A detached building, the use of which is appropriate, subordinate and customarily incidental to that of a main building located on the same lot as the main Kodiak Island Borough, Alaska Ordinance No. 2001 -01 Page 1 of 2 building and which is not designed or intended to be used for living or sleeping purposes. B. An accessory building shall be considered to be a part of the main building when joined to the main building located by a common wall not Tess than four (4) feet long or by a roofed passageway which shall not be less than eight (8) feet in width. C. Any structure, regardless of type of foundation or base support, including skid - mounted or other movable structure, that also requires a building permit for construction (for example, structures where the projected roof area exceeds one hundred twenty (120) square feet). A minor structural development that does not require a building permit is not regulated by this chapter. D. A non - motorized container van when used for the sole purpose of storing emergency response equipment in the Kodiak Island Borough and not placed on a permanent foundation. Section 3: Section 17.51.030 of the Kodiak Island Borough Code of Ordinances is amended as follows: 17.51.030 Permitted districts. A. Accessory buildings are permitted in all land use districts that specifically allow for them. B. In residential zoning districts, no accessory building shall be located on any lot in the absence of a main building used as a residence; except that in the case of a vacant lot, zoning compliance for an accessory building (used solely for the storage of tools and materials needed for the construction of the permitted residence) may be issued at the same time zoning compliance and a building permit are issued for a residence. C. An accessory building as defined by section 17.51.020 'D of this chapter is permitted in all zoning districts with authorization from the local municipality and issuance of a zoning compliance permit.
